Eligibility Criteria

  • LLM with at least 55% marks or an equivalent grade. Professional qualification such as CA/ ICWA/ CFA/ CS (both 5 year integrated or 3 years after graduation) with minimum 55% marks.
  • Master’s degree in a discipline relevant to the proposed research with at least 55% marks or equivalent grade.
  • Applicants with more than 3 years industry/ teaching/ practicing/ managerial/ professional experience will be given preference.
  • Relaxation of 5% of marks, from 55% to 50%, or an equivalent relaxation of grade, may be allowed for those belonging to SC/ST/Differently-Abled categories or for those who had obtained their Master’s degree prior to 19th September, 1991. The eligibility marks of 55% (or an equivalent grade in a point scale wherever grading system is followed) and the relaxation of 5% to the categories mentioned above are permissible based only on the qualifying marks without including the grace mark procedures.

Categories of Admission

Applicants shall be admitted to the Ph.D. Programme under one of the following categories:

  • Full-time Ph.D. Student (with or without fellowship) “means a person enrolled in the Ph.D. Programme devoting full-time to completing the requirements of the degree.”
  • Part-Time Ph.D. Student (without fellowship) “means a person who is registered in the Ph.D. Programme devoting part of his/ her time for completing the requirements of the degree while discharging other employment obligations.”

LLM-Ph.D in Law

The ICFAI Law School offers both full time research program (Ph.D) in Law.

Full Time LLM-Ph.D. Program: Candidates registered for full time research shall work and conduct research on a full time basis under a recognized research supervisor. The duration of Ph.D. course for a full time research scholar is four (4) years from the date of admission.

Part Time Ph.D. Program Candidates registered as part time research scholars shall work and conduct research for four (4) years under a recognized supervisor. Candidates seeking admission as part time research scholars have to submit no objection certificate from the employer to pursue Ph.D. Course and also during summer term for attending classes of Ph.D. course work conducted in two spells in the first two years of the program.

Eligibility

A student who has passed 5 year integrated Honours Law Program on a regular basis having minimum 55% aggregate and 7.5 CGPA or equivalent grade or point scale where ever grading system is followed.

Two years Post graduate Law Program after 3 year LLB Law Program or 1 year LLM after 5 year integrated law program with at least 55% in aggregate.

Duration of the Course:

  • Duration of the Course for the regular full time is 4 years including course work, teaching/ training program and PHD research work and maximum period will be 6 years from date of admission and maximum additional 2 years can be given through a process of re-registration and the total period of completion of PHD program should not exceed 8 years from the date of admission
  • Female PhD Scholars may be provided with maternity leave/ Child care leave up to 240 days in the entire duration of the PhD program

Pattern of Ph.D. Eligibility Test

The eligibility test is of objective type with multiple choice questions covering the subjects of Constitutional Law, Indian Penal Code, Law of Torts, Corporate Law, Labour Law and Jurisprudence. Duration of the test is of 2 hours. The minimum marks for qualifying the Ph.D. eligibility test shall be 50%

Ph.D. Admission Interview

Candidates who have qualified in the Ph.D. eligibility test shall be called for Ph.D. Admission Interview. After the Ph.D. Admission Interview the list of eligible candidates for registration for full time and part time Ph.D. program will be finalized.

Research Fellowships

The Student selected for LLM - Ph.D Program will be awarded with research fellowship during the entire period of program subject to Ph.D regulations.

Bar Council of India Legal Education (Post-Graduate, Doctoral, Executive, Vocational, Clinical and other Continuing Education), Rules, 2020

  The said Rules have been notified in light of Sections 7(1)(h), (i); (ia); (ib); (ic); (2)(b); (c); 15(1); 49(1)(af); (d); (e) with a view to strengthen legal education at each level of undergraduate, post graduate, legal research, technology & court management, continuing legal education and professional and clinical skill development courses conducted off-line and on-line.

♦ Chapter-I of the said Rules consists of the General Provisions under which Definitions and the Qualification requirement of Faculty members are covered.

♦ Chapter-II is about the Post Graduate Degree Course in Law.

Under Chapter two a very significant point has been highlighted under Rule 6 which states that One Year Master Degree to be abolished .

A Master Degree Program in Law of one year duration introduced in India in 2013(as per notification) by the University Grants Commission shall remain operative and valid until the Academic Session in which these Regulations are notified and implemented but not thereafter at any University throughout the country.

A Master degree in any specialized branch of Law offered in the Open System to any graduate, such as Business Law or Human Right, or International Trade Law without having LL.B./BA.LLB as the requisite entry-level qualification shall not be designated as Master’s Degree in Law (LL.M.) but can be designated in any other manner attracting the immediate attention of anyone that such a degree holder may not be a Law graduate.

Master’s degree in Business Law may be designated as (MBL); Master’s in Governance and Public Policy as (MGPP), Master’s in Human Rights as (MHR), Master’s in Industrial Laws (MIL) etc., which cannot be considered equivalent to LL.M.

All India Common Entrance Test

Bar Council of India (either directly or through its Trust) may annually conduct a Post Graduate Common Entrance Test in Law (PGCETL) for admission in Master Degree course in Law in all Universities and until the PGCETL is introduced the present system followed by respective Universities shall be followed.

♦Chapter III consists of Rules with regard to Educational upgradation and efficiency enhancement and Professional Education.

Bar Council of India through the B. C. I. Trust shall introduce two professional efficiency enhancement continuing education courses only for Advocates who are enrolled with any State Bar Council.

Para legal/Court management Courses

  BCI Trust may conduct para-legal (including land survey work, notarization, registration and all other judicial work of court and lawyers’ chamber management) and technology & Court Management courses of suitable duration on-line and/or off-line to facilitate para-legal works and court-management to cover updated education and training .

♦  Chapter IV comprises Rules for Equivalence and Miscellany

  Equivalence of Post Graduate Degree obtained from a Foreign University

  (1) In order to qualify for test of equivalence of LL.M. degree obtained from any foreign University the Masters’ Degree in Law course must have been taken only after obtaining the LL.B. degree from any foreign or Indian University which is equivalent to the recognized LL.B. degree in India.

(2) LL.M. degree obtained from a Foreign University, which has been prosecuted without an equivalent LL.B. degree shall not be equivalent to Indian LL.M. degree such as follows:

(i) LL.B. is a three/four year first undergraduate course in which case One year or Two years of study in LL.M. in the foreign University forms part of the LL.B. program to consider the LL.B. with or without a Bridge course as equivalent to Indian LL.B.

(ii) LL.M. is obtained without having any equivalent LL.B.

(3) One year LL.M. obtained from any foreign University is not equivalent to Indian LL.M. degree. However, one year LL.M. degree obtained after an equivalent LL.B. degree from any highly accredited Foreign University may entitle the person concerned to be appointed as a visiting professor in an Indian University for at least one year so as to consider such One year LL.M. degree with one-year teaching experience as a Visiting Faculty/internee faculty/clinical faculty the Master degree obtained on one year term may be considered equivalent.

Till 2012, Master of Laws program at NALSAR offered a range of specializations on strictly segregated basis. Students were required to opt for their specialized stream at the start of the course and then appeared for the various papers listed in the specialization. In 2012 it was decided to loosen the stranglehold of specialization by permitting students to opt for an optional paper from a stream different than their specialization.

In 2013, the one year LLM was introduced. Specializations were offered in a range of streams, however in a departure from the earlier system, it was decided that students would reach and not opt for a specialization. Thus if a student opted for four or more papers in a particular stream, then the student would be awarded a LLM degree in that specialization. However if that does not happen the student would be awarded a general LLM. A student not opting to go for any particular specialization would be awarded a general LL.M. by the end of the course. A large number of students in the current batch have opted for the general LLM.

Apart from the elective courses every student is required to do three mandatory courses i.e. Research Methods and Legal Writing, Comparative Public Law/Systems of Governance, Law and Justice in Globalizing World. Before finishing the course each student is also required to submit a dissertation on any area of research of student’s choice. A large number of electives on offer ensure that the class size remains appropriately small and this allows faculty members as well as the students to interact in a far more individualized manner.

The university offers a credit based teaching assistantship to the LL.M. students in their final semester. The responsibility involves helping the teacher in preparing reading materials, conducting the tutorials and providing consultation to the undergraduate students in the projects. This prepares them well for the increasingly attractive career in academics. Teaching assistantship program at NALSAR has helped the institution to contribute, both qualitatively and quantitatively, to the law faculty pool in the country.

PO1- (Academics): Acquire academic excellence through a rigorous process of acquiring and creating domain knowledge. PO2- (Research): Contribute to legal scholarship by engaging in research including collaborative through critical appraisal of laws, theories and concepts in the spirit of pursuit of justice.  PO3- (Professional ethics and Academic Integrity): Demonstrate exemplary ethical conduct and integrity in all professional engagements including research and collaboration.   PO4- (Social Justice): Engage in bringing about social change and transformation through inclusive approach(es), innovative ideas and designing intelligent solutions 

Programme Specific Outcome - LLM

Criminal Law PSO1- Critically appreciate theories, principles and doctrines of criminal law mindful of contemporary issues and challenges in Criminal Justice System.

Corporate and Commercial Law   PSO1- Understand the significance of theoretical insights into the functioning of corporations and the economy  PSO2- Systematically analyse responses to  to regulatory changes and challenges in corporate practice.

Intellectual Property law PSO1- Articulate arguments for changes and reform of intellectual property law and their likely impact on creativity and innovation. PSO2- Apply various statutory provisions cutting across boundaries for the protection of Intellectual property including those relating to indigenous knowledge or culture information technology and biotechnology.

Public Law and Legal Theory PSO1- Appraise the embeddedness of public law in dynamic political and social context. PSO2- Critically examine the underlying theoretical premises in addressing emerging social problems. 

International Trade and Business Law PSO1- Analyse the nature and scope of International and domestic laws in regulating international trade and businesses in the context of influence of customary law and treaty law. PSO2- Design mechanisms to facilitate international dispute resolution for governments and business.

LLM Programme in Insolvency and Bankruptcy Laws 

The LL.M course offered by the National Academy of Legal Studies and Research (NALSAR University) and Indian Institute of Corporate Affairs (IICA) is first of its kind LL.M. Degree Programme in Insolvency and Bankruptcy Laws and Procedures Law in India. India has a huge, emerging sector for helping distressed and bankrupt companies come out of financial difficulty. But it faces a huge shortage of bankruptcy professionals who can oversee the process. As of 2023, the country had nearly 3000 insolvency professionals; however, the number of Insolvency Professionals and Insolvency Associates are very less considering the number of filings taking place every day at NCLT. On an average, one Insolvency Professional needs at least 20 associates to assist in big-ticket CIRP and Liquidation cases. Therefore, there is a serious need to produce good insolvency associates and eco system at mass level for providing the support to IPs, IPEs, Consultancies, Law Firms, ARCs and Academia. Therefore, the Master level course / orientation in Insolvency and Bankruptcy Laws is the need of the hour. There is a vacuum in this area in the legal educational system in the country and this course seeks to fill up this vacuum.

NLSIU offers a one year LL.M. Degree Programme. Similar to the BA LLB (Hons) programme, the LL.M. programme is organised around three trimesters every academic year. With the help of a cutting-edge curriculum and innovative pedagogical approaches, it is meticulously designed to equip students with skills and knowledge needed to navigate the intricate landscape of law. Our one-year LL.M. programme provides a unique blend of core and elective courses, allowing students to deepen their expertise in their preferred areas of interest and thrive in diverse fields such as academia, research, legal practice, policy making and judicial services.

In Academic Year 2024-25, NLSIU is introducing four concentrations, in addition to the general stream. This distinctive concentration model enables LL.M. students to delve deeper into specific domains of law, enhancing their knowledge and expertise in those specific domains. The four concentrations that are being offered for AY 2024-25 are:

  • Criminal Law
  • Commercial Laws
  • Law and Technology

The maximum intake in a concentration shall be 30 and the minimum number of students required for offering any concentration shall be 15 students.

To fulfill the requirements of a concentration, students must complete:

  • 3 LL.M. Core Compulsory courses;
  • 1 Concentration Core course;
  • 3 Concentration Electives;
  • 4 General Electives; and
  • Dissertation (in the area of Concentration).

Transcripts will reflect the chosen concentration, and upon graduation, the University will issue a uniform Master’s in Law Degree Certificate. For students opting for the general stream, general electives will replace concentration electives. Additionally, they will have the flexibility to select dissertation topics from any area of interest.

Admission to the LL.M. Degree Programme is purely on the basis of merit as assessed through the Common Law Admission Test (CLAT) administered by the Consortium of NLUs.

Eligibility

  • The candidate must have an LL.B. Degree or an equivalent examination with a minimum of: (i) Fifty percent (50%) of marks or its equivalent grade in case of candidates belonging to General/OBC/PWD categories, and (ii) Forty five percent (45%) of marks or its equivalent grade in case of candidates belonging to SC/ST categories.
  • The candidate will have to appear for the Common Law Admission Test (CLAT) to secure admission into the postgraduate programme.
  • Candidates appearing for the qualifying examination in the year of admission are also permitted to take the Admission Test, but their admission to the course shall be subject to fulfilling the conditions stipulated in the Regulations, and producing supporting documentary evidence at the time of admission.
  • There is no upper age limit for the PG programme in CLAT.

International Students

Candidates can apply for the NLSAT – International Examination for “international student” category, if they fulfil the following conditions:

  • They should be a citizen of a country other than India; AND
  • They should have completed a minimum of ten years of their education in a school/college/university outside India.

Intake and Reservation for AY 2024-25

The total intake capacity shall be 120 (One Hundred and Twenty) students for AY 2024-25 with the following breakup:

  • Scheduled Castes – 15%
  • Scheduled Tribes – 7.5%
  • Other Backward Classes (Non-creamy layer) – 27%
  • Economically Weaker Sections – 10%
  • Persons with Disabilities (Horizontal reservation) – 5%
  • Women (Horizontal reservation) – 30%
  • Karnataka Students* (Compartmentalised Horizontal reservation) – 25%

* Karnataka Students Category:

(i) Candidates who have studied for not less than 10 years in a recognized educational institution in Karnataka shall be eligible to be considered as ‘Karnataka Students.’

(ii) Candidates who have not completed ten years of study in Karnataka shall be eligible to apply under the Karnataka Students category if they fall under any of the below categories:

1. Children of defence personnel/ex-servicemen, who at the time of joining service, have declared their hometown to be in the State of Karnataka, and who have served or are serving outside Karnataka, corresponding to the candidate’s years of study outside Karnataka.

2. Children of employees of the Karnataka State Government who have served or are serving outside Karnataka corresponding to the candidate’s years of study outside Karnataka.

3. Children of serving or retired employees belonging to the Karnataka cadre of the All India Services (IAS/IFS/IPS), who have served or are serving outside Karnataka corresponding to the candidate’s years of study outside Karnataka.

4. Children of working or retired employees in the Central Armed Police Force service, who upon joining service declared their hometown to be in the State of Karnataka, and who have served or are serving outside Karnataka, corresponding to the candidate’s years of study outside Karnataka.

Illustration: If the candidate has studied in Karnataka for three (3) years, they must prove that their parent/s were serving outside Karnataka for at least seven (7) years corresponding to their own period of study outside Karnataka.

If the candidate has not studied in Karnataka continuously for at least one (1) year, they must prove that their parent/s were serving outside Karnataka for at least ten (10) years corresponding to their own period of study outside Karnataka.

(iii) Eligible candidates must keep their Study Certificates issued by their School/s and other relevant documents ready to be submitted at the time of counselling/admission.

Procedure to apply for a concentration in the LLM programme

Students will be submitting their LL.M. concentration preferences through an online form.

The maximum intake in a concentration shall be 30. The minimum number of students required for offering any concentration shall be 15 students. In the event that the number of applicants for any particular concentration exceeds 30, the allocations will be based on CLAT rank, i.e., a higher CLAT rank will be prioritised.

Candidates must be Indian citizens.

Application process

This scholarship emphasises the applicant’s statement of purpose, extracurricular activities, and English test results in addition to academic achievements. A Thinking Skills Assessment and a personal interview follow the first applicant screening procedure.

Scholars are chosen for the loan scholarship based on their interview performance, online test score, and GRE/GMAT/IELTS/TOEFL results, as well as their co-curricular and extra-curricular activities, research work, statement of purpose, and job experience.

Over the course of eight weeks, the programme will provide young attorneys in India with firsthand experience of the workings of the legal system in England and Wales, while young legal practitioners from England and Wales will get the opportunity to see the Indian legal system in turn.

Spending three to four weeks at each of two separate sets of barristers’ chambers in London that practise in the candidate’s preferred areas of law will be part of the scholarship. Certain placements frequently include opportunities to observe advocacy in action, as well as requests for the scholar to assist with research and/or drafting, with the goal of providing insight into how these areas of law are handled in England and Wales. After Software Engineers, LLMs Are Coming After AI Researchers

Stanford University recently published a paper titled ‘Can LLMs Generate Novel Research Ideas?’ The study found that ideas generated by LLMs (large language models) were rated significantly more novel than those from human experts. 

To reach this conclusion, over 100 NLP researchers were asked to come up with new ideas and review both LLM-generated and human-generated ideas without getting to know their source. The results showed that LLM ideas were considered more innovative (with statistical significance, p < 0.05), although they were rated slightly lower in terms of feasibility.

The approach is similar to Japanese AI startup Sakana AI’s AI Scientist , which automates the entire research lifecycle. It generates novel research ideas, writes necessary code, executes experiments, summarises results, visualises data, and presents its findings in a complete scientific manuscript.

Interestingly, the startup claimed that each idea is implemented and developed into a full paper at approximately $15 per paper.

Generating new ideas is relatively easy for LLMs, thanks to their extensive training on large datasets and ability to combine various concepts. However, they continue to face challenges with advanced reasoning. 

Meanwhile, OpenAI is preparing to release its new model, Strawberry, which is expected to offer improved reasoning capabilities.

Chai Discovery, a biology startup founded by a former OpenAI employee, recently introduced Chai-1, an advanced foundation model that predicts molecular structures crucial for drug discovery. Innovations like these show that LLMs are close to driving significant research breakthroughs.

“The ability of LLMs to combine concepts from vast datasets in ways not typically thought of by humans can lead to ideas that are considered more novel. This might be because LLMs aren’t constrained by the same cognitive biases or conventional thinking patterns that humans have,” said DigitalVibes.ai founder Anthony Scaffeo . 

He added that LLMs can make connections across different fields or unrelated data points, which might not be intuitive or immediately obvious to human experts.

“My student’s comment on the paper about LLMs generating more novel research ideas than humans is making the rounds. I think this says more about NLP researchers than about LLMs. Ouch,” joked Subbarao Kambhampati , professor of computer science at Arizona State University.

“I am not gonna let no LLM beat me in generating novel NLP research ideas!,” he quipped. Interestingly, Kambhampati has been quite vocal about LLMs being bad at reasoning and planning.  

He said that models like GPT-3, GPT-3.5, and GPT-4 are poor at planning and reasoning, which he believes involves time and action. According to him, these models struggle with transitive and deductive closure, with the latter involving the more complex task of deducing new facts from the existing ones.

Can They Really Do Research?

Today several researchers have not experimented much with LLMs to generate new novel ideas, instead they have been predominantly using it to review the research papers.

Apparently, Meta AI chief Yann LeCun argues that while LLMs cannot reason and plan, they are still a good tool for reviewing papers. “Reviewers (as in human reviewers) should be able to use the tools they want to help them write reviews. The quality of their reviews should be assessed based on the result, not the process,” he said.

Meta AI launched Galactica, an LLM for research, in November 2022, just weeks before ChatGPT. However, it was taken down after three days due to criticism over generating misleading or offensive information. LeCun remains unhappy about it to this day . 

However, not everyone agrees with LeCun.

“AI-generated reviews of scientific papers are increasing, vacuous, and need to be stopped quickly. They reduce the author’s trust in the review process. Proposal: someone who is judged to have submitted such a review is banned from submitting to the same conference/journal for two years,” said Micheal Black, director, Max Planck Institute for Intelligent Systems.

Adding to this perspective, Mukur Gupta, an applied scientist at Apple, recounts his frustrating experience with an LLM-generated review.

“I love AI as an assistant. But after getting an LLM-generated review for my NeurIPS paper last month (which was total crap and useless), I’m a little skeptical about AI discovering true novelty,” said Gupta. 

He explained that LLMs could be a game-changer for interdisciplinary research or for uncovering new problems in fields—where human experts, limited by their working memory and attention span, may struggle to grasp more than a handful of domains. 

“LLMs, with their ever-expanding knowledge base, offer the potential for cross-pollination of ideas.”

“But when it comes to deep, niche, and fundamental breakthroughs, I’m not buying it—hence my disappointment with that NeurIPS review,” he added.

Use AI to Brainstorm, Not Write

Lately, there has been a growing trend of researchers using LLMs to write papers. According to recent data, the use of the term ‘ delve ’ in the abstracts gradually increased through 2022, jumped noticeably in 2023 (when ChatGPT became widely available), and has continued to rise in 2024.

The future of research should be a collaboration between humans and LLMs to generate truly innovative ideas. According to Stanford’s paper, human ideas often prioritise feasibility and effectiveness over novelty and excitement, which can limit their creativity. 

On the other hand, LLMs struggle to judge the quality of ideas. By combining the strengths of both humans and LLMs, we can pave the way for exciting research.
