Extended post-study work rights for graduates of a number of eligible qualifications

The Australian Government has announced it will extend post-study work rights for graduates of a number of eligible qualifications in targeted skills areas.

From 1 July 2023 to mid-2024, post-study work rights for international graduates will be increased from:​

  • two years to four years for select Bachelor degrees​
  • three years to five years for select Masters degrees​
  • four years to six years for all doctoral degrees​

This extension will be added to the Temporary Graduate visa (subclass 485) for eligible graduates; or enabling a new visa application for those select students who already hold a TGV and will be seeking an additional two years.

Types of study covered

The student (subclass 500) visa allows you to study the following study types:

  • higher education
  • Vocational and Education Training (VET)
  • pathway courses
  • English Language Intensive Courses for Overseas Students (ELICOS)
  • primary and secondary school
  • secondary school exchange programs
  • postgraduate research
  • non-award courses (such as Study Abroad and Exchange semesters), and 
  • postgraduate research programs
  • international students sponsored by the Australian Government’s Department of Foreign Affairs (DFAT) or Defence.

You will need to enrol in a course at an Australian education or training provider first and then apply for a student visa  after   you have been issued a confirmation of enrolment (CoE) from the provider. For more information on applying for courses, visit the how to apply to study  page.

Student visa work restrictions

The number of work hours allowed during study terms and semesters is capped at  48 hours per fortnight.  If you fail to comply with this visa condition, you may have your student visa cancelled. 

Students who have already started their Master degree by research or Doctoral degree have no work hours limit. 

Check the Visa Entitlement Verification Online system (VEVO) to see the work conditions that apply to you.

Fees and processing time 

In Australia, student visa fees are from AUD$650 per visa application* unless you are exempt. Australian student visa processing times vary from person to person. Visa processing times are available on the Department of Home Affairs website . You can also get tips on how to improve your processing time.

Student visa conditions 

There are some important visa conditions that you need to take note of, including that you must:

  • notify your education or training provider of your residential address within 7 days of arriving in Australia
  • meet your course requirements, remain enrolled and maintain satisfactory attendance and course progression – tell your provider if you are sick or have any other issues that may affect your attendance
  • stay within the visa limit on working hours while studying
  • maintain adequate  health insurance for visa holders  for the whole of your stay in Australia, and  
  • not over-stay your visa period in Australia. 

You can check your visa status and full list of conditions any time at the Department of Home Affairs Visa Entitlement Verification Online system (VEVO). 

‘Course packaging’ on a Student visa (subclass 500) 

You can apply to study two or more courses on your Student visa (subclass 500) where there is clear progression from one course to another. This is known as course packaging. 

You will need a Confirmation of Enrolment (CoE) for each course you plan to take. The final course that you will undertake as part of your package will be your main (or ‘principal’) course of study.

For your visa application, the Department of Home Affairs will use your main (principal) course of study to work out what evidence of finances and English language skills you will need to provide.

If your visa application includes a package of courses, course gaps must be less than two calendar months. This gap can be longer (three to four months) if the first course finishes at the end of the Australian academic year (November) and the following course starts at the beginning of the next academic year (February).

Who can i contact if i have any questions about my visa.

The  Visa Entitlement Verification Online system (VEVO)  allows visa holders to check their visa conditions. 

If you have any questions, you can  contact the Department of Home Affairs .

What should I do if I cannot complete an English test, biometrics or health examination within the specified time frame?

Once a visa application is lodged, a decision can be made by the Department of Home Affairs at any time. If your application is incomplete, it may be refused. So, if you cannot complete any of these tests in time, please attach evidence of the steps you have taken to your application in  ImmiAccount . For more information,  visit the Department of Home Affairs website .

How long before the commencement date can I lodge a visa application?

You can submit your student visa application at any time. However, it is recommended that you lodge a complete application at least eight weeks before your course commences .

My Confirmation of Enrolment (CoE) has changed since I lodged my visa application. Do I need to tell the Department of Home Affairs?

If you already hold a student visa, your education provider will provide the Department of Home Affairs with your new CoE. However, if your student visa application is still being assessed by the Department of Home Affairs, you should attach your new CoE to your student visa application through ImmiAccount as soon as possible.

If your new CoE is for study at a lower AQF course level, you may need to apply for a new student visa. The Australian Qualification Framework sets course levels.

International Students and Work Rights in Australia

Most international student visas allow you to work up to 48 hours per fortnight and full time during University session breaks.

If you're in Australia on a student visa, the number of hours you're allowed to work is defined in your student visa conditions. These restrictions may include any work experience undertaken as part of your study.

Work conditions for student visa holders

From 1 July 2023, work restrictions for student visa holders will be re-introduced under your student visa conditions. Once you have commenced studying, you are permitted to work a maximum of 48 hours per fortnight while your course is  in session and unlimited hours when your course is out of session.

If work experience is a requirement of your course and compulsory so that you gain your degree, the hours will not count towards your maximum work hours per fortnight.

If you are a postgraduate research student and have commenced your masters by research or doctoral degree in Australia, there is no limit on the number of hours you can work.

Please note that different visa types have different work requirements. Visit the Australian Government's  Department of Home Affairs website to check you are working in accordance with your individual visa requirements.

Elective subjects with work requirements

If your course doesn’t offer Work Integrated Learning (WIL), Industry Based Learning (IBL) or placements as a part of your study plan, you can add them as electives. To find out more, visit our  Work Integrated Learning and placements page .

Work you do as part of your course may count towards the 48-hour limit depending on whether it is a course requirement according to the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS):

  • If the work is specified as a course requirement with CRICOS, then the work won’t count towards the 48-hour limit.
  • If the work isn't specified as a course requirement (for example, as part of an elective subject), then the work will count towards the 48-hour limit.

These guidelines may apply even if you're not being paid for the work.

To confirm whether your course has a registered work component, please check the  Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) .

Proving to your employer you have work rights

Your employer may ask you to prove your work rights. You can download this letter from La Trobe University to show them.

If you need something more personalised then you can request a To Whom It May Concern Letter . This costs $44 and can take 15 working days.

Your work rights

Everyone in Australia, including international students, have basic rights and protections at work. The Fair Work Ombudsman makes sure your rights are protected. You are entitled to minimum wages and fair conditions. Read more at the Fair Work website .

WORK RIGHTS ON A STUDENT VISA

8105 condition (work rights)   states that the holder must not engage in any work in Australia before the holder’s course of study commences.

From 1 July 2023​​, work restrictions for student visa holders will be re-introduced.

Student visa work restrictions were relaxed throughout the pandemic, and completely removed in January 2022 to allow primary and secondary student visa holders to work over their normal limit of 40 hours per fortnight to address workforce shortages.

The Australian Government has announced that student visa holders  already working  in the aged care sector on 9 May 2023 can continue to work unrestricted hours in the aged care sector until 31 December 2023 .​

From 1 July 2023 , work restrictions for all other student visa holders will be re-introduced and capped at the increased rate of 48 hours per fortnight . This ensures that student visa holders are able to focus on obtaining a quality Australian education and qualification, while remaining able to support themselves financially, gain valuable work experience, and contribute to Australia’s workforce needs.

However you can work full time when:

(a)  to work that was specified as a requirement of the course when the course particulars were entered in the Commonwealth Register of Institutions and Courses for Overseas Students; and

(b)  in relation to a student visa granted in relation to a masters degree by research or doctoral degree  if the holder has commenced the masters degree by research or doctoral degree.

fortnight means the period of 14 days commencing on a Monday.’

An example of how 40 hours a fortnight is calculated: After their course has commenced, a student visa holder works the following numbers of hours over a four week period:

  • week one – 15 hours work
  • week two – 25 hours work
  • week three – 25 hours work
  • week four – 10 hours work.

In the above example, the total hours worked in week two and week three is more than 40 hours. This means the student is non-compliant with the work limitation and may be subject to visa cancellation .

SECONDARY APPLICANT’S ON STUDENT VISAS WORK HOURS

Your partner can work full time as condition 8104 covers both master by research and coursework even though 8105 which is for the MAIN applicant ONLY allows only full time work for master by research or doctoral students.

8104 (all family members)

Condition number Who this applies to Description
All family member visa holders You cannot work more than 40 hours per fortnight. A fortnight means the period of 14 days starting on a Monday.
You must not start work until the primary student visa holder has started their course.
Exceptions – family members of the following students can work unlimited hours once the primary student visa holder has started their course:

Condition 8104 limits visa holders, other than family members of students studying a masters or a doctorate degree, to working no more than 40 hours a fortnight. A fortnight means the period of 14 days starting on a Monday.

Due to current workforce shortages, the Government has temporarily removed the limit on working hours for student and secondary training visa holders. This temporary measure applies to all sectors of the economy. This will end on 30 June 2023.

Until 30 June 2023, if you are a member of the family unit of a primary student visa holder, you may find and start work prior to the student’s course commencement.

After the 30 June 2023, the number of hours a student visa and secondary training visa holder will be allowed to work will again be capped. Further information will be provided closer the date.

Temporary relaxation of working hours for student visa holders

​​​Due to exceptional circumstances during the COVID-19 pandemic and the need to ensure the supply of critical services, the Department of Home Affairs and Australian Border Force will take a flexible approach to student visa holders working beyond their usual work limitations, but only in specified industries.

​NDIS providers

There is no requirement for NDIS providers to register with the Department of Home Affairs. These providers should see the letter provided to them by the NDIS Commission for further details. See a list of  NDIS providers​ .

Employers must continue to follow Australian workplace law. Overseas workers, including international students, have the same rights under Australian workplace law as all other employees.

These temporary measures will be reviewed by the government regularly. Employers will be advised when these measures no longer apply.

While these measures are in place, the Department of Home Affairs and Australian Border Force will:

  • exercise their discretion under s116(1)(b) of the Migration Act 1958 to  not  cancel the visas of students who work in excess of 40 hours each fortnight to support your organisation
  • not  refer student visa holders for investigation of any potential offence under s235 of the Migration Act 1958 that might relate to the hours worked by a student visa holder in breach of their visa conditions
  • not  refer you or relevant third-party labour hire companies, as an employer, for investigation of any potential offence under s245AC of the Migration Act 1958 that might relate to allowing a student visa holder to work in breach of their visa co​ndi​tions.​​

​​Student visa holders​​

Student visa holders do not need to apply for this temporary measure. You should contact your employer.

Working in Australia after you graduate

If you’re interested in staying in Australia to work after you graduate, you’ll need to get a new working visa before your student visa expires. As a graduated international student you may be eligible for:

  • The Post-Study Work stream of the Temporary Graduate Visa (subclass 485) if you have completed a Bachelor, Masters or Doctoral degree.
  • To submit an Expression of Interest through the Australian Government’s SkillSelect, seeking approval to stay in Australia as a professional worker.
  • State and territory government nomination for skilled and business migration .

Do people in Postgraduate Research Sector student visa get full work rights?

On 30th June next year, work restrictions will return to student visas. However, I was looking at the precursor to the Postgraduate Research Sector student visa, the 574 visa, and people who had that had no work restrictions. So my question is, after the 30th of June 2023, will Postgraduate Research Sector student visa holders have full work rights or will their work rights be restricted like all other 500 visa holders?

Masters in Research and PHD students have always had full time work rights so I don't expect this to change

The 500 visa has two work restrictions that may be apply to it (8104 and 8105) although the 8104 is probably the only one really relevant in your case if you are looking at postgraduate courses.. Media releases state that the 8104 will end on 30 June 2023 and that after the 30 June 2023, the number of hours a Student visa holder will be allowed to work will again be capped. Its entirely possible that this will be extended given the ongoing workforce shortages but it is not a given. There really hasn't been a lot released by way of policy from the current government on student visa, and where it fits into the whole review of migration policy that is ongoing. I am not so sure about RD's comment about Masters by Research and PhD student always having full work rights, If my memory is right even the 574 back in its day had the 20 hour per week work restrictions. The only way to guarantee that you would have no work right restrictions is if the condition is not applied to your visa.

The Postgraduate Research Sector (Subclass 574) student visa allows international postgraduate students to enter Australia to work towards a research based Master's degree or Doctoral degree/PhD.

Eligibility

In order to be eligible for this student visa students must:

Provide proof of acceptance onto a Master's or Doctoral degree research program at an Australian university or other research centre, such as an electronic Confirmation of Enrolment code, Confirmation of Enrolment letter, or Letter of Offer.  

Have enough funds to pay travel, tuition, and maintenance costs for themselves and for any family members included on their application.  

Meet the level of English Language proficiency set by the organisation they will be studying with.  

Meet various health requirements, including having health insurance.  

Meet the character requirements, this usually means a criminal record check  

Satisfy Australian officials that they will not overstay their visa. This is known as the Genuine Temporary Entrant requirement.

Students less than 18 years old

Students under the age of 18 must meet specific eligibility requirements to be granted a visa. These students must:

Have a parent or guardian sign their visa application. If the parent or guardian is unable to do this they can instead provide:

A statutory declaration letter, giving their permission for the student to travel to Australia, OR;  

A copy of Australian form 1229

Stay with a parent/guardian, or another relative over the age of 21 (who must be nominated by a parent/guardian) while in Australia. If this is not possible other arrangements can be made, but these must be agreed with the student's education provider in Australia.

Length of Stay

The Postgraduate Research Sector (Subclass 574) student visa allows students to stay in Australia for the duration of their studies, plus a set period determined by the length of the student's course, and what time of the year that it finishes. The extra time on this visa is there to allow students to complete their Master's or Doctoral theses:

Course length of less than 10 months: The visa will last the full length of the course, plus 7 months.  

Course length of 10 months or more, and finishing between January and October: The visa will last the full length of the course, plus 8 months.  

Course length of 10 months or more, and finishing in November or December: The visa will last until September 15 th of the next year.

Students can include the following family members on their visa application

Dependent children (including partners' dependent children)  

Dependent relatives (including partners' dependent relatives)

This visa automatically allows research students to work for an unlimited number of hours per week once their research has officially begun. No separate work authorisation is required.

However, students under the school leaving age for the state they are studying in cannot work during study/term time. For most Australia states the school leaving age is 15. Family members included on the student's visa may also work for an unlimited number of hours per week once the student's research has officially begun.

The Subclass 574 Postgraduate Research Sector student visa enables international postgraduate students to pursue a research-oriented Master’s or Doctoral degree/PhD in Australia.

Since the early 2000’s, the number of international students enrolled in Australian universities has been steadily increasing, proving Australia to is a great place to study. We’ve compiled everything you need to know about the Student Visa: Subclass 500.

The student visa is a temporary visa and the length of stay is determined by the type and length of the course you will be studying.

Length of Course

Length of Stay

Longer than 10 months (finishing November – December)

The visa end date will usually be the 15th of March the following year

Longer than 10 months (finishing January – October)

The visa end date will usually be 2 months longer than the course end date

Shorter than 10 months

The visa end date will usually be 1 month longer than the course end date

There may be special circumstances where these usual periods may be exempt: 

Postgraduate Research Students 

The length of stay or visa end date for Postgraduate research students is generally an additional 6 months on top of the usual visa end date. This is to allow postgraduate students to remain in Australia during the marking of their thesis. 

Primary School Students 

For primary school children enrolled in years 1-4, the maximum period for a student visa is 2 years. To continue their studies, these students must apply for another student visa.

Student Visa Eligibility Requirements

The minimum age requirement is 6 years old. For secondary school eligibility, you must also be: 

less than 17 years old when you begin Year 9. 

less than 18 years old when you begin Year 10. 

less than 19 years old when you begin Year 11. 

less than 20 years old when you begin Year 12. 

Course Enrolment for Tertiary Education 

You must be enrolled in a full-time course of study or training and you must provide evidence of this through documentation accompanied with your application. 

Welfare Arrangements 

If you are under 18 years of age, you must have your welfare arrangements in place before you begin studying in Australia. Your student guardian can be a parent, legal custodian, or relative over 21 years of age. They must have a valid visa to stay with you in Australia for the duration of your student visa, or until you turn 18. 

You will need to complete the  Student Guardianship Arrangements form  and attach it with your student visa application. 

English Language Requirements 

Depending on your country of residence, you might have to provide evidence of your English language proficiency. All applicants who hold a UK, USA, Canada, NZ or Republic of Ireland passport are exempt from this. 

If you do need to provide evidence of your English language proficiency, you can find your  nearest IELTS test centre here .

How to Apply for an Australian Student Visa

Before you apply .

If you reside outside of Australia, make sure to apply for your visa at least 6 weeks before the start date of your enrolled course. If you are currently in Australia, give yourself extra time to apply for your next visa to avoid having your current visa expire before your next visa has been granted. 

Other Considerations: 

You might need to conduct health examinations. Keep this in mind and complete your examinations before applying for your visa. 

Your passport must be valid before you begin your student visa application.

Visa Application Outcome

The outcome of your student visa application will be sent in writing, regardless of whether you were successful or unsuccessful. 

If you were successfully granted your student visa, you will be provided with your visa grant number, the date your visa expires, and your visa conditions. 

If you were unsuccessful in being granted with your student visa, you will be informed of the reasons why your application was denied and whether you are able to review the decision made. 

Please note that your application charge will not be refunded if you were unsuccessful, so ensure that you fill out your application form accurately and provide all necessary documents.
