When a person dies without leaving a will, all their assets will be disposed of and distributed to beneficiaries under Singapore’s Intestate Succession Act [ https://sso.agc.gov.sg/Act/ISA1967 ]. This law lays down default rules on who is entitled to the estate of the deceased. The people included are the deceased’s spouse, children, parents, siblings, etc.

Although there are default rules on intestate succession provided for by law, the drawback is that the person will have no control whatsoever over the distribution of their estate. Neither can their successors decide on the proportion of their corresponding shares. On top of this, if there is an absence of all the mentioned people entitled to the estate under the Act, the assets of the deceased will go to the Government of Singapore.

For these reasons, drafting a Will is important. Through a Will, the deceased can provide, during their lifetime, who they want their assets to go to when they pass away. The testator, or person who writes the Will, can provide for the property, the proportion, and the person the assets should be distributed to. This gives room for more control on the part of the deceased in the disposition of the estate.

But a hindrance faced by many is the lack of knowledge on how to draft a Will. And oftentimes, one has no means to hire a lawyer to help them. Fortunately, online Will writing services are here to make writing a Will easier, faster, and more efficient.

This doesn’t however mean that all online Will writing services are created equal. You must consider the quality of the Will these online services can provide for you. A defective Will might face problems at the point of execution. Some of these issues can even result to your will being nullified.

As a general rule, there are three things you have to consider in choosing an online will writing service — ease, functionality and legal compliance.

Functionality

OCBC’s Online Will Generator only allows you to add certain properties and fixed sums of money. You have no liberty to set the types of assets you wish to include, or the amount of money you wish to fix. WillCraft on the other hand, gives you options. It allows up to 5 categories of assets, enabling you to more accurately allocate your resources. This is important to give you more control of the assets you want to distribute. Further, it provides the executor of your will more specific allocations and instructions on how you want your assets to be disposed of.

WillCraft also allows you to have multiple substitute beneficiaries and gives you the freedom to choose and control the terms of distribution. Substitute beneficiaries are important in cases when the person you stipulated predeceases you. If this happens, the substitute beneficiary you indicated will be the one who receives that share. OCBC’s Online Will Generator does not include this function. It sets a default allocation, which provides that if any of your beneficiaries predecease you, their share will be given to the surviving beneficiary. This undermines your control on the distribution of your estate.

An executor is a person who carries out the provisions of your will. He or she follows the instructions you left, and distributes your assets according to what you provided for. An executor’s job is a lot of work. Appointing only one to carry out your will might cause unnecessary delay. This is just one of the benefits of having joint executors. When you have two or more people as executors, you cause the execution of your will to expedite. They can also dispose of your assets more efficiently because their knowledge or skill sets might coincide with certain provisions, making them more efficient.

OCBC’s Online Will Generator does not allow the appointment of joint executors. It only allows you to appoint a main executor and an alternative executor. WillCraft on the other hand provides you with the option of appointing multiple executors. Bear in mind, however, that in Singapore, only a maximum of 4 people are allowed to be appointed as executors of a will with respect to the same property. [1]

In a will, the testator can also provide funeral instructions which lay down how they want their burial to be conducted. OCBC’s Online Will Generator provides for some settings for funeral instructions, but these are incomplete. WillCraft offers more options and specifications to enable you to lay down your last wishes more accurately.

Before finalizing your will, you have to make sure all the information you provide is correct and accurate. Some mistakes might constitute a defect in your will. This is why the online will writing service you choose must have verification procedures. Unlike WillCraft, which allows you to verify, edit, and amend the information you put in, OCBC’s Online Will generator does not provide the same functions. It does not verify information, which might be considered important. An example is the National Registration Identity Card (NRIC), the identification document used in Singapore. OCBC’s Online Will Generator does not verify if NRIC’s are correct before allowing you to proceed.

Security is another important issue to consider. Some provisions in a will are better kept confidential for the privacy and safety of the beneficiaries or other persons involved. WillCraft’s security features are top-notch. They make sure your data is kept safe and secure. ## Legal Compliance Probably the most important question to ask when choosing an online will writing service is if it complies with the laws of Singapore. A testator is free to stipulate whatever they desire in their will, provided it does not go against the law. The courts will not enforce an illegal stipulation.

WillCraft complies with all legal requirements and formalities in drafting a will. The same cannot be said for OCBC’s Online Generator, which includes some functions that might cause negative legal effects in the enforcement of your will.

One example is its function that allows additional instructions. This might sound like a good thing, but it is prone to negative effects. Additional instructions might run counter to other provisions in your will. If there is conflict, some gifts or donations you provided for can be nullified.

OCBC also doesn’t verify the information you input nor does it check whether your beneficiaries are the same. This is a problem because you are not allowed to give the same gift or allocate the same asset to one beneficiary twice.

Generally, you do not need a lawyer to draft a will. Especially with the help of a will writing service, you will be able to write your own will easily. In any case, however, having a lawyer take a look at your will is very helpful in ensuring you have complied with legal requirements. This will eliminate defects that might raise problems during execution.

OCBC’s Online Will Generator does not avail of the services of lawyers in the drafting process. WillCraft, on the other hand, gives you the option to hire a lawyer. SINGAPORE — Getting a lawyer to prepare a basic will typically costs between S$99 and S$500, though there is no legal requirement in Singapore that it must be prepared or witnessed by a lawyer.

A survey conducted last year by OCBC involving 200 participants between the ages of 55 and 69 showed that one in three need more advice on “after-life plans” and leaving an inheritance for their families.

To make will writing more accessible here, OCBC Bank has rolled out a free online service for Singapore citizens and residents aged 21 and above to prepare their wills within 10 minutes on their computers, laptops or mobile devices.

A survey conducted last year by OCBC involving 200 participants between the ages of 55 and 69 showed that one in three need more advice on “after-life plans” and leaving an inheritance for their families, said the bank in a press release on Thursday (Dec 27).

Mr Dennis Tan, head of consumer financial services (Singapore) at OCBC Bank, said the bank wants to make “this seemingly tedious and costly process a fuss-free and free-of-charge online experience that is open to everyone, especially our pioneer generation citizens”.

Users of the OCBC Online Will Generator have to fill in an online form with his or her personal details, and will require at least two witnesses above the age of 21 who are not the beneficiaries to ensure that the will generated is recognised in Singapore.

The individual will be prompted to appoint an executor to carry out his or her will and list the beneficiaries who will receive the various assets after the user’s death. A legal guardian has to be appointed for the listed beneficiaries if they are below 18 years old.

The user will also be prompted to indicate the percentage allocation of overall assets, alongside other options such as specific gifting of Singapore-based property and listing of assets. Other instructions for funeral arrangements and after-life matters can also be included.

They can then download the will for free and sign the printed copy. The will has to be kept in a safe environment and its location registered with the National Will Registry.

OCBC said the free service uses a basic will template for general use, and it does not deal with "every important topic or cover every aspect of the topics with which it deals". Users should seek legal advice from qualified lawyers for more specific requirements.

The service is part of the bank’s Silver Years programme launched in May which offers advisory and lifestyle initiatives to seniors here.

As part of its Silver Years programme, OCBC Bank has rolled out new service that lets Singapore citizens and residents aged 21 and above prepare a basic will online for free in only 10 minutes.

OCBC Bank has rolled out the OCBC Online Will Generator , a service that allows Singapore citizens and residents aged 21 and above to prepare a basic will online at no cost, the bank announced in a press release on Thursday.

The bank developed the service in-house as part of the bank's Silver Year programme that focuses on retirement planning for people aged 55 and above, and includes elements outside traditional banking products, as it noted the inaccessibility of will writing services and demand from this demographic.

«We have seen news articles reporting that people were put off making wills as they are worried about the complexity and costs. We want to change all that by making this seemingly tedious and costly process a fuss-free and free-of-charge online experience that is open to everyone, especially our pioneer generation citizens,» Dennis Tan , Head, Consumer Financial Services Singapore, OCBC Bank, said.

Legal Recognition

In a survey conducted by the bank in 2017, one in three respondents said they wanted more advice on after-life plans and leaving an inheritance for their family. The also bank noted that despite the fact that self-written wills are legally recognized in Singapore, many people still go to laywers when preparing one, which typically costs between $99 and $500. 

The system will prompt the testator to provide personal details and appoint an executor of the will. Other instructions, such as funeral arrangements and any other after-life arrangements, may also be included. To ensure the will is valid in Singapore, two witnesses who are not beneficiaries underthe will are required. The generated will has to be printed and signed, and its location registered in the National Wills Registry .

The bank noted that the will generator is ideal for persons with a straightforward distribution of assets and that it «utilises a basic will template and does not necessarily deal with every important topic or nor cover every aspect of the topics with which it deals.»

OCBC Bank to Offer Free Online Will Writing Service in Singapore

OCBC Bank has rolled out a free online service to help Singapore citizens and residents aged 21 and above prepare their own wills within 10 minutes.

It is common here to seek the help of a lawyer , who typically charges S$99 to S$500 to prepare a basic will. Yet there is no legal requirement in Singapore that a will must be prepared or witnessed by a lawyer. At the same time, few would know how to prepare a will entirely without guidance. In a survey conducted by OCBC Bank in 2017 involving 200 respondents between the ages of 55 and 69, one in three indicated that they need more advice on after-life plans and leaving an inheritance for their family.

When a person’s affairs are straightforward, the OCBC Online Will Generator – developed in-house as part of OCBC Bank’s Silver Years programme – is now an option.

Launched in May 2018, OCBC Bank’s Silver Years programme aims to be holistic in its range of both banking and non-banking products and services. It offers financial advisory and lifestyle initiatives for Singapore’s seniors that aim to minimise the downside of the retirement risk zone. This zone is deemed to be the period of a person’s life at aged 55 years old onwards.

Mr Heng Gee Choo, one of the respondents and a retiree, 65, said:

“The process is simple and easy to use. With this in place, there is really no excuse for me to procrastinate and delay the writing of my will.”

With the launch of the OCBC Online Will Generator, consumers are therefore given the time and privacy to undertake this task in their own home.

OCBC bank rolls out the free online Will writing services on 27 December 2018. Below are the views of Mr Patrick Chang, founding director of Simply Wills on this initiative. Patrick has been in the Will writing services business for more than 17 years. Mr Patrick’s and his team have written more than 15,000 wills to date.

Following are the extracts of the interviews between Jiale from MoneyMap036 and Mr Chang.

   

Jiale : Hi Patrick, can you tell the audience what’s your opinion on this initiative?  

Patrick : I will say that that is a good initiative. I tried it out and after looking at it, I thought yes, for simple cases, they can get this done free of charge it is really adding value to their life.

Jiale : So this is a legit copy?  

Patrick : Yes this is the one from the OCBC and if I get it signed, it is already valid. It is good enough for simple cases. On the other hand, I also ask myself after being in the business for 17 years, can this serve all the people? I am afraid to say that some other people are still preferred to meet me (or my colleagues) on a face-to-face basis because they want someone with a little bit of experience to guide them along, with the one face-to-face interaction. So for those who feel that this one serves their needs they should just go ahead get it done. But if it’s not good enough then look for someone else, pay a little bit of money to get a full version.

Jiale : A poorly constructed Will is worse than No Will. Agree?  

Patrick : Yes, I totally agree and the other had to be fair, not everybody’s situations are that complicated. So if it is not complicated, then it is good enough as a valid Will in Singapore. The only thing is, like what I said, this is not tailor-made. As for most of my clients, (you’ll be surprised0, they’d rather pay a few hundred dollars to get my professional opinion than just do an online free version. Because it does not cater to their needs. So those are the customers who want to see us, and they want to pay a consultation fee to get the Will done.

Jiale : So your stand is that, if their situation is more simple they can go ahead with the OCBC free Will Writing Services, but if they want to speak to someone, they have more elaborated or family situations, it might be better to seek a professional is that correct?  

Patrick : Yes, correct. Will writing can be complicated for some of our clients who like to address multiple policies, multiple properties, and especially if they have business interests in any of the companies, this (OCBC free Will) probably can’t take care of that.

Jiale : Any final thoughts?  

Patrick : I would think that everybody should have a Will written. Whether you do it the free online version, you get a law firm, or you get professional people to do it, you should just get it done. As long as it is a Valid Will done, it is probably 10X better than not having one.

Are online wills legit.

Online wills can be legally binding if they’re specific to your state and properly notarized. Notarization requirements can vary from state to state; in some, you may need only two witnesses to sign and won’t need an attorney. Also, make sure to use a reputable, well-reviewed online will maker if you’re going the do-it-yourself route.

Other ways to write a will

Download a template.

Many websites have free and low-priced will templates available for download. You can find templates specific to your state and estate situation, though more specific forms may cost extra.

A template is a decent starter option if you can’t invest in a more comprehensive effort, but make sure the template meets your needs and state legal requirements.

OCBC launches free online will writing service

OCBC Bank has launched a free online will writing service, the first of its kind in Singapore. 

Developed in-house as part of OCBC Bank’s Silver Years programme, the OCBC Online Will Generator helps Singapore citizens and residents aged 21 and above prepare their own wills within 10 minutes.

In a press release on Thursday, December 27, OCBC noted that a lawyer in Singapore typically charges SGD 99-500 to prepare a basic will. However, it is actually not a legal requirement in Singapore that a will must be prepared or witnessed by a lawyer.

At the same time, few would know how to prepare a will entirely without guidance.

“We have seen news articles reporting that people were put off making wills as they are worried about the complexity and costs," said Mr Dennis Tan, Head, Consumer Financial Services Singapore, OCBC Bank. 

"We want to change all that by making this seemingly tedious and costly process a fuss-free and free-of-charge online experience that is open to everyone, especially our pioneer generation citizens."

In a pilot session conducted among a group of about 10 seniors from the NTUC Health Active Ageing Hub, respondents were given a hands-on experience at trying out the OCBC Online Will Generator. 

Mr Heng Gee Choo, a retiree, 65, said: “The process is simple and easy to use. With this in place, there is really no excuse for me to procrastinate and delay the writing of my will.”

Written by Moore and directed by Oliver Hermanus, the opening episode, titled “The Second Son,” sets the tone for the series and introduces Mary Villiers (Moore) as quite a mastermind in 15th century England. As a commoner, Mary understands that she must play by society’s rules, even if she sees through the thinly veiled nonsense of it all. But, that doesn’t mean she has to stay powerless. Enter her son, George Villiers (Galitzine) who, despite being a second son of a poor family, is positioned to become one of the most powerful men in England thanks to his sexual exploits with the king.

Here is “The Second Son” script with an introduction from Moore, in which he discusses capturing the spirit of the Jacobean era through the lives of Mary and George Villiers — two fascinating figures who hold quite a lot of significance to the British monarch — and explains why he was keen to shed light on this moment in history.

King James VI of Scotland and I of England loved men. With his mind and body.    For a very long time this fact was ignored, denied, or danced around. Most historians turned their backs to it and James has rarely been depicted on screen.    In my view, if you look at all the evidence from the time and deny this part of James it is somewhat akin to denying that the sun is hot. (Clue: it is!)    James would fall so hard (pun intended, sorry) for his male lovers he would give them title after title, immensely powerful political positions, and staggering riches. By ruling James’ heart – and lower – you might get to, essentially, rule the country. It led to attractive young gentlemen being presented before James by powerful competing factions, all trying to lure him into falling for their man…    That was the nature of power in Jacobean England. Not a sensible system of national governance, to put it mildly. It was mad.    I had heard the odd thing about James liking men, but I had no idea as to the extent of his passions. So when Liza Marshall, our (absolutely bloody brilliant) Executive Producer, sent me Benjamin Wooley’s  The King’s Assassin  – which inspired our show – I was stunned. Not just by James’ story but also by a mother and son who shone out so brightly…   Mary Villiers was from the provinces, with question marks over her origins, and no money or significant social connections. She used George her second son (usually worthless things, given they were not heirs), and any and all means possible, to rise and rise. She is buried with George in Westminster Abbey alongside Kings, Queens and all kinds of English (good and bad) legends. Her tomb says she is a ‘direct descendent of five European Kings’, which is almost certainly a total lie. I find it hard not to love that.    This first episode was my attempt to announce Mary. An uncompromising, deeply smart woman who sees through society’s bullshit but also accepts she has to play by its rules. Or at least pretend to. I wanted Mary to be like one of those sharks that cannot sleep. That has to keep moving in order to live. She is ceaseless. Because she has to be. A woman in a man’s world. A commoner in an age of Kings. She should not have achieved all she did.   And yet: her son became the most powerful man in England, first dominating James and then his son, Charles I. For a generation, he was England. His sexual exploits during this time are genuinely staggering. Men. Women. Kings. Queens. He made James seem like a quaint, untouched virgin. But this power – political and sexual – corrupted him. Deeply. By the time of his death, he was so unpopular they had to bury him at night so there would not be riots at his funeral.   Though in this very first episode, George is very far from all that. He is just a young, passionate, fairly innocent young man starting out in the provinces. This felt like a sensible place to begin given that, in the rest of the series, we see how exposure to power gradually begins to change and harden and undo him. The opening episode is the first step on that long, dark journey…   A journey which feels very much of our time, as autocrats, and rulers acting on their baser instincts, seem so on the rise. But it is also a timeless story, Absolute power corrupts absolutely. It always has. And it always will. As it did with George.    Finally, in my writing I wanted to capture the spirit of this era. Jacobean drama mixed the high and low; it cursed, sang, jigged, and was generally not very well-behaved. It mixed the tragic with the comic, in a way that the lives of Mary and George (and James) really did. And most lives do, in truth. This show is not a dry history lesson. It is pretty wet. But so were the Jacobeans. A people in the troubled shadow of their priapic, constantly inconstant lover of a King.
