A Summary and Analysis of Ralph Waldo Emerson’s ‘Nature’

‘Nature’ is an 1836 essay by the American writer and thinker Ralph Waldo Emerson (1803-82). In this essay, Emerson explores the relationship between nature and humankind, arguing that if we approach nature with a poet’s eye, and a pure spirit, we will find the wonders of nature revealed to us.

Emerson begins his essay by defining nature, in philosophical terms, as anything that is not our individual souls. So our bodies, as well as all of the natural world, but also all of the world of art and technology, too, are ‘nature’ in this philosophical sense of the world. He urges his readers not to rely on tradition or history to help them to understand the world: instead, they should look to nature and the world around them.

In the first chapter, Emerson argues that nature is never ‘used up’ when the right mind examines it: it is a source of boundless curiosity. No man can own the landscape: it belongs, if it belongs to anyone at all, to ‘the poet’. Emerson argues that when a man returns to nature he can rediscover his lost youth, that wide-eyed innocence he had when he went among nature as a boy.

Emerson states that when he goes among nature, he becomes a ‘transparent eyeball’ because he sees nature but is himself nothing: he has been absorbed or subsumed into nature and, because God made nature, God himself. He feels a deep kinship and communion with all of nature. He acknowledges that our view of nature depends on our own mood, and that the natural world reflects the mood we are feeling at the time.

In the second chapter, Emerson focuses on ‘commodity’: the name he gives to all of the advantages which our senses owe to nature. Emerson draws a parallel with the ‘useful arts’ which have built houses and steamships and whole towns: these are the man-made equivalents of the natural world, in that both nature and the ‘arts’ are designed to provide benefit and use to mankind.

The third chapter then turns to ‘beauty’, and the beauty of nature comprises several aspects, which Emerson outlines. First, the beauty of nature is a restorative : seeing the sky when we emerge from a day’s work can restore us to ourselves and make us happy again. The human eye is the best ‘artist’ because it perceives and appreciates this beauty so keenly. Even the countryside in winter possesses its own beauty.

The second aspect of beauty Emerson considers is the spiritual element. Great actions in history are often accompanied by a beautiful backdrop provided by nature. The third aspect in which nature should be viewed is its value to the human intellect . Nature can help to inspire people to create and invent new things. Everything in nature is a representation of a universal harmony and perfection, something greater than itself.

In his fourth chapter, Emerson considers the relationship between nature and language. Our language is often a reflection of some natural state: for instance, the word right literally means ‘straight’, while wrong originally denoted something ‘twisted’. But we also turn to nature when we wish to use language to reflect a ‘spiritual fact’: for example, that a lamb symbolises innocence, or a fox represents cunning. Language represents nature, therefore, and nature in turn represents some spiritual truth.

Emerson argues that ‘the whole of nature is a metaphor of the human mind.’ Many great principles of the physical world are also ethical or moral axioms: for example, ‘the whole is greater than its part’.

In the fifth chapter, Emerson turns his attention to nature as a discipline . Its order can teach us spiritual and moral truths, but it also puts itself at the service of mankind, who can distinguish and separate (for instance, using water for drinking but wool for weaving, and so on). There is a unity in nature which means that every part of it corresponds to all of the other parts, much as an individual art – such as architecture – is related to the others, such as music or religion.

The sixth chapter is devoted to idealism . How can we sure nature does actually exist, and is not a mere product within ‘the apocalypse of the mind’, as Emerson puts it? He believes it doesn’t make any practical difference either way (but for his part, Emerson states that he believes God ‘never jests with us’, so nature almost certainly does have an external existence and reality).

Indeed, we can determine that we are separate from nature by changing out perspective in relation to it: for example, by bending down and looking between our legs, observing the landscape upside down rather than the way we usually view it. Emerson quotes from Shakespeare to illustrate how poets can draw upon nature to create symbols which reflect the emotions of the human soul. Religion and ethics, by contrast, degrade nature by viewing it as lesser than divine or moral truth.

Next, in the seventh chapter, Emerson considers nature and the spirit . Spirit, specifically the spirit of God, is present throughout nature. In his eighth and final chapter, ‘Prospects’, Emerson argues that we need to contemplate nature as a whole entity, arguing that ‘a dream may let us deeper into the secret of nature than a hundred concerted experiments’ which focus on more local details within nature.

Emerson concludes by arguing that in order to detect the unity and perfection within nature, we must first perfect our souls. ‘He cannot be a naturalist until he satisfies all the demands of the spirit’, Emerson urges. Wisdom means finding the miraculous within the common or everyday. He then urges the reader to build their own world, using their spirit as the foundation. Then the beauty of nature will reveal itself to us.

In a number of respects, Ralph Waldo Emerson puts forward a radically new attitude towards our relationship with nature. For example, although we may consider language to be man-made and artificial, Emerson demonstrates that the words and phrases we use to describe the world are drawn from our observation of nature. Nature and the human spirit are closely related, for Emerson, because they are both part of ‘the same spirit’: namely, God. Although we are separate from nature – or rather, our souls are separate from nature, as his prefatory remarks make clear – we can rediscover the common kinship between us and the world.

Emerson wrote ‘Nature’ in 1836, not long after Romanticism became an important literary, artistic, and philosophical movement in Europe and the United States. Like Wordsworth and the Romantics before him, Emerson argues that children have a better understanding of nature than adults, and when a man returns to nature he can rediscover his lost youth, that wide-eyed innocence he had when he went among nature as a boy.

And like Wordsworth, Emerson argued that to understand the world, we should go out there and engage with it ourselves, rather than relying on books and tradition to tell us what to think about it. In this connection, one could undertake a comparative analysis of Emerson’s ‘Nature’ and Wordsworth’s pair of poems ‘ Expostulation and Reply ’ and ‘ The Tables Turned ’, the former of which begins with a schoolteacher rebuking Wordsworth for sitting among nature rather than having his nose buried in a book:

‘Why, William, on that old gray stone, ‘Thus for the length of half a day, ‘Why, William, sit you thus alone, ‘And dream your time away?

‘Where are your books?—that light bequeathed ‘To beings else forlorn and blind! ‘Up! up! and drink the spirit breathed ‘From dead men to their kind.

Similarly, for Emerson, the poet and the dreamer can get closer to the true meaning of nature than scientists because they can grasp its unity by viewing it holistically, rather than focusing on analysing its rock formations or other more local details. All of this is in keeping with the philosophy of Transcendentalism , that nineteenth-century movement which argued for a kind of spiritual thinking instead of scientific thinking based narrowly on material things.

Emerson, along with Henry David Thoreau, was the most famous writer to belong to the Transcendentalist movement, and ‘Nature’ is fundamentally a Transcendentalist essay, arguing for an intuitive and ‘poetic’ engagement with nature in the round rather than a coldly scientific or empirical analysis of its component parts.

To go into solitude, a man needs to retire as much from his chamber as from society. I am not solitary whilst I read and write, though nobody is with me. But if a man would be alone, let him look at the stars. The rays that come from those heavenly worlds, will separate between him and what he touches. One might think the atmosphere was made transparent with this design, to give man, in the heavenly bodies, the perpetual presence of the sublime. Seen in the streets of cities, how great they are! If the stars should appear one night in a thousand years, how would men believe and adore; and preserve for many generations the remembrance of the city of God which had been shown! But every night come out these envoys of beauty and light the universe with their admonishing smile.

The Stars Awaken a Certain Reverence, Because Though Always Present, They Are Inaccessible;

but all natural objects make a kindred impression when the mind is open to their influence. Nature never wears a mean appearance. Neither does the wisest man extort her secret, and lose his curiosity by finding out all her perfection. Nature never became a toy to a wise spirit. The flowers, the animals, the mountains, reflected the wisdom of his best hour, as much as they had delighted the simplicity of his childhood. When we speak of nature in this manner, we have a distinct but most poetical sense in the mind. We mean the integrity of impression made by manifold natural objects. It is this which distinguishes the stick of timber of the wood-cutter, from the tree of the poet . The charming landscape which I saw this morning, is indubitably made up of some twenty or thirty farms. Miller owns this field, Locke that, and Manning the woodland beyond. But none of them owns the landscape. There is a property in the horizon which no man has but he whose eye can integrate all the parts, that is, the poet . This is the best part of these men's farms, yet to this, their warranty deeds give no title. To speak truly, few adult persons can see nature. Most persons do not see the sun. At least they have a very superficial seeing. The sun illuminates only the eye of the man but shines into the eye and the heart of the child.

The lover of nature is he whose inward and outward senses are still truly adjusted to each other;

who has retained the spirit of infancy even into the era of manhood. His intercourse with heaven and earth becomes part of his daily food. In the presence of nature, a wild delight runs through the man, in spite of real sorrows. Nature says, — he is my creature, and maugre all his impertinent griefs, he shall be glad with me. Not the sun or the summer alone, but every hour and season yields its tribute of delight; for every hour and change corresponds to and authorizes a different state of the mind, from breathless noon to grimmest midnight.

Nature is a setting that fits equally well a comic or a mourning piece. In good health, the air is a cordial of incredible virtue. Crossing a bare common, in snow puddles, at twilight, under a clouded sky, without having in my thoughts any occurrence of special good fortune, I have enjoyed a perfect exhilaration. I am glad to the brink of fear. In the woods too, a man casts off his years, as the snake his slough, and at what period soever of life, is always a child. In the woods, is perpetual youth. Within these plantations of God, a decorum and sanctity reign, a perennial festival is dressed, and the guest sees not how he should tire of them in a thousand years. In the woods, we return to reason and faith.

There I feel that nothing can befall me in life,

— no disgrace, no calamity, (leaving me my eyes,) which nature cannot repair. Standing on the bare ground, — my head bathed by the blithe air, and uplifted into infinite space, — all mean egotism vanishes. I become a transparent eye-ball; I am nothing; I see all; the currents of the Universal Being circulate through me; I am part or particle of God. The name of the nearest friend sounds then foreign and accidental: to be brothers, to be acquaintances, — master or servant, is then a trifle and a disturbance. I am the lover of uncontained and immortal beauty. In the wilderness, I find something more dear and connate than in streets or villages. In the tranquil landscape, and especially in the distant line of the horizon, man beholds somewhat as beautiful as his own nature.

The greatest delight which the fields and woods minister, is the suggestion of an occult relation between man and the vegetable.

I am not alone and unacknowledged. They nod to me, and I to them. The waving of the boughs in the storm is new to me and old. It takes me by surprise, and yet is not unknown. Its effect is like that of a higher thought or a better emotion coming over me, when I deemed I was thinking justly or doing right.

Yet it is certain that the power to produce this delight, does not reside in nature, but in man, or in a harmony of both. It is necessary to use these pleasures with great temperance. For, nature is not always tricked in holiday attire, but the same scene which yesterday breathed perfume and glittered as for the frolic of the nymphs, is overspread with melancholy today. Nature always wears the colors of the spirit. To a man laboring under calamity, the heat of his own fire hath sadness in it. Then, there is a kind of contempt of the landscape felt by him who has just lost by death a dear friend. The sky is less grand as it shuts down over less worth in the population.

Emerson often referred to nature as the "Universal Being" in his many lectures. It was Emerson who deeply believed there was a spiritual sense of the natural world which felt was all around him.

Going deeper still in this discussion of the "Universal Being", Emerson writes, "The aspect of nature is devout. Like the figure of Jesus, she stands with bended head, and hands folded upon the breast. The happiest man is he who learns from nature the lesson of worship."

It's common sense that "nature" is everything you see that is NOT man-made, or changed by man (trees, foliage, mountains, etc.), but Emerson reminds us that nature was set forth to serve man. This is the essence of human will, for man to harness nature. Every object in nature has its own beauty. Nature writing is a form of creative nonfiction in which the natural environment (or a narrator 's encounter with the natural environment) serves as the dominant subject.

"In critical practice," says Michael P. Branch, "the term 'nature writing' has usually been reserved for a brand of nature representation that is deemed literary, written in the speculative personal voice , and presented in the form of the nonfiction essay . Such nature writing is frequently pastoral or romantic in its philosophical assumptions, tends to be modern or even ecological in its sensibility, and is often in service to an explicit or implicit preservationist agenda" ("Before Nature Writing," in Beyond Nature Writing: Expanding the Boundaries of Ecocriticism , ed. by K. Armbruster and K.R. Wallace, 2001).

While many of our favorite stories describe epic adventures in the great outdoors, nature writing—writing about nature itself—has evolved as a genre in its own right.

This unique genre can inspire curiosity and awe in both its readers and writers, especially in an age characterized by digital screens and virtual experiences.

What Is Nature Writing?

The exact definition of nature writing can be hard to pinpoint. If you ask Wikipedia, it’s “nonfiction or fiction prose or poetry about the natural environment.” So, pretty much anything that describes rolling hills or migrating butterflies goes, right?

Actually, most works that are considered “nature writing” today can best be classified as creative nonfiction . In Beyond Nature Writing , ecocritic and writer Michael P. Branch explains that the term “has usually been reserved for a brand of nature representation that is deemed literary, written in the speculative personal voice, and presented in the form of the nonfiction essay.”

The genre can be traced back to the 18th century, with many regarding English naturalist Gilbert White’s Natural History and Antiquities of Selborne one of the earliest examples.

Nature is full of inspiration, and as such, it can easily serve as a muse for writers. In nature, we might find metaphors for our own human experiences that we never considered before.

For example, in literature, rivers are often regarded as symbols of life and the passage of time: the source of rivers (small mountain streams) represents the beginnings of life, and its meeting with the ocean represents the end of life. And, like life itself, it continues to push on in an endless cycle, no matter what happens.

Thus, writing (and reading) about nature allows us space to reflect on life and the many ways it mirrors our own human experiences.

Over the last century, nature writing has also become a means of advocacy for the environment by calling attention to environmental issues and trying to inspire a greater interest in nature.

How to Practice Nature Writing

Nature writing has grown in popularity as a genre in recent years, but writing about nature in general can also be a great creative exercise, as it encourages you to observe details and put those observations into words.

You can use these tips to practice nature writing:

1. Always keep a notebook handy.

The first thing you want to do is ensure that you always have a notebook and pen handy to jot down your ideas and observations, no matter where you are.

Pocket notebooks easily fit into backpacks, handbags, and yes, even most pockets!

Don’t assume that you can just write everything down when you get home. Many subtle details and nuances can be lost, even just hours later, if you don’t record them there in the moment.

2. Observe.

When you’re spending time in nature, don’t worry about brainstorming the most poetic way to describe the falling leaves; you can always refine your writing later.

For now, just focus on recording your own feelings and observations. Let your thoughts flow freely onto the paper, without pausing to self-edit or worry about proper spelling and punctuation.

3. Focus on sensory details.

As with nearly all types of writing, nature writing is always better when you focus on showing, not telling . This means using sensory details to describe your surroundings and experiences.

However, be careful to avoid cliches . Find your own ways to describe the nature around you, rather than recycling the same tired similes and metaphors that have been written a million times.

4. Make connections.

Yes, nature writing means a lot of writing about nature, but that doesn’t mean your topics of discussion are limited to the sound of the wind and birds chirping.

If you find that certain memories or thoughts come up while you’re spending time in nature, write those down too. This can help you practice building connections, which will enrich your writing and help you convey larger themes .

"In every generation and among every nation, there are a few individuals with the desire to study the workings of nature; if they did not exist, those nations would perish."

In 185 AD, Chinese astronomers recorded a supernova. Among more detached details of its appearance, there is this: "It was like a large bamboo mat. It displayed the five colors, both pleasing and otherwise."

The attempt to ground the unknown within the familiar — and the editorial aside of "otherwise" — cuts to the heart of naturalist writing. Nearly 2000 years later, Carl Sagan did the same in Cosmos , condensing astronomy to its component parts: facts and wonder.

We've been curious about the natural world since before recorded time; the history of naturalism is human history. By the ninth century, al-Jahiz's multi-volume History of Animals combined zoological folklore with scientific observation, including theories of natural selection. In the early 20th century, Sioux author Zitkala-Ša wrote landscapes intertwined with the personal, which became a model for the form. In 1962, Rachel Carson's ecological manifesto Silent Spring was a deciding factor in banning DDT.

The best naturalist writing delivers both a secondhand thrill of obsession and a jolt of protectiveness for what's been discovered. Some of it reveals as much about the author as the surroundings. (Carl Linnaeus' 1811 Tour of Lapland manuscript cuts off a paragraph about wedding customs mid-sentence, picking up again with a breathless catalog of marsh plants.) And naturalists themselves are shaped by the lure of landscapes on the page. Robert MacFarlane's Landmarks explores the British countryside using others' writing as an interior map that challenges him to approach familiar places in new ways.

We love reading about nature for the same reason naturalists love being ankle-deep in marshes: Nature provides enough order to soothe and enough entropy to surprise. It's also why so many involve a person in the landscape; understanding our place in the world is as important as understanding the world itself. We read the work of naturalists to capture that sense of discovery made familiar. They present worlds we've never seen, and make us care as if they were our own backyards.

Not every naturalist sets out to be an activist; this is a literary tradition as much as a scientific one. But there are threads that connect naturalist literature, across continents and centuries. It's driven by an environmental curiosity that integrates the scientific and the spiritual; facts inspire wonder, rather than quench it. And every piece of naturalist literature, from al-Jahiz to today, makes a case for preserving the world it sees.

The Invention of Nature

Some naturalists actually do try to encompass the world entire. In The Invention of Nature , Andrea Wulf follows Alexander Humboldt's expeditions in Latin America and European royal courts, painting a portrait of a man whose hunger for knowledge — and constant pontificating about it — bordered on caricature. Humboldt's legacy is the 'web of life' his work conveyed to a lay audience. That interconnectedness made him an early conservationist; by 1800 he was noting adverse effects "when forests are destroyed, as they are everywhere in America by European planters, with an imprudent precipitation."

But he wasn't the first to catalog the systems of life. A century before Humboldt, German-born naturalist Maria Sybilla Merian was in Surinam, recording her life's passion: butterflies, moths, and insects. Chrysalis , Kim Todd's biography of this amateur scientist who established the idea of a life cycle, aims for a sly impression of Merian, down to the subject matter: "Insects," Todd explains, "generally gave off a whiff of vice." Merian's engravings made life cycles palpable for a public who still believed rotten meat spontaneously transformed into flies; it was impressive enough to change assumptions about the natural world (though Merian's credit waned as male scientists began absorbing her work into their own).

To write about the world around us is to write about people, whether cataloging the unknown or coming to terms with one's backyard. This is the dynamic at the heart of Annie Dillard's Pilgrim at Tinker Creek , which carries a touch of the hymnal (and a grim streak that has a grandmother in Merian's engraving of a tarantula devouring a bird), and Barbara Hurd's Stirring the Mud , a love letter swamps, bogs, and "the damp edges of what is most commonly praised." And few naturalists write themselves into their landscapes quite so drily as M. Krishnan. The essays in Of Birds and Birdsong carry a sense of magical realism; always scientifically rigorous (his bird descriptions are those of a man looking for a particular friend in a crowd of thousands), Krishnan writes himself as a resigned meddler in avian affairs; he could try to be invisible among nature's bounty, but then who'd train his pigeons?

Of course, some writers have to fight to be seen on the landscape at all. Enter The Colors of Nature , an anthology of nature writing by people of color edited by Alison H. Deming and Lauret E. Savoy, providing deeply personal connections to — or disconnects from — nature. Jamaica Kincaid's "In History" considers naturalism in the aftermath of colonialism, asking a crucial question for naturalism in a global context: "What should history mean to someone who looks like me?" And Joseph Bruchac's travel diary is pragmatism shot through with hope; "Our old words keep returning to the land."

For others, the internal landscape and that hope for the natural world must be rediscovered in tandem. In Braiding Sweetgrass , botanist Robin Wall Kimmerer tackles everything from sustainable agriculture to pond scum as a reflection of her Potawatomi heritage, which carries a stewardship "which could not be taken by history: the knowing that we belonged to the land." That sense of connection, or the loss of it, is the spine of the book: mucking out a pond is a microcosm, agriculture becomes rumination on symbiosis, and mast fruiting of pecan trees parallels human and plant communities.

It's a book absorbed with the unfolding of the world to observant eyes — that sense of discovery that draws us in. Happily for armchair naturalists, mysteries of the natural world never stop unfolding; but increasingly, a sense of impending doom accompanies the delight of knowledge. Kimmerer mentions a language between trees as something awaiting more specific study; it arrives later this year in Peter Wohlleben's The Hidden Life of Trees . A no-nonsense writing style — he came, he studied, here's how to date a forest via its weevil population — frames a deeply conservationist argument: Trees harbor not only ecosystems, but feelings, vocabulary, and etiquette. Hidden Life is designed to be an arboreal Silent Spring .

The Whale

For some places, however, no revelations are yet possible; the world being studied is simply too mysterious to be yet wholly understood. With meditative prose, 1986's Arctic Dreams chronicled Barry Lopez's expeditions in an ecosystem so punishing half an animal population can die every winter, and so otherworldly animal fat is preserved on bones after a century. "Something eerie ties us to the world of animals," he says, and it's both a warning and a promise. In The Whale: In Search of the Giants of the Deep, Philip Hoare's marine obsession is similarly dreamlike; for him, what we know about whales and how they make us feel is deeply linked. After all, our 'discovery' of them is still in its first blush. Sperm whales were first filmed in 1984; "We knew what the world looked like before we knew what the whale looked like." The only absolute conclusion in his book is a stern one: Humanity's damaging effects on nature and its fascination with the unknown has been devastating; if we're going to keep whales long enough to know them, that fascination will have to take a more protective turn.

To write about the world around us is to write about people, whether cataloging the unknown or coming to terms with one's backyard. These narratives are crucial, especially now — stories of the worth of nature, even just as a mirror of ourselves, build a narrative in which nature's something worth saving. It's imperfect; making nature an object rather than a subject prevents us from seeing ourselves as part of natural patterns of cause and effect. But in The Colors of Nature, Aileen Suzara pins it down: "The landscape is a narrative, not a narrator, because it has no human voice." The human voice that looked at the dark and saw a dying star is heard 2000 years later. If we're going to have another 2000 years, there's no time like the present to start listening.

Ecocriticism investigates the relation between humans and the natural world in literature. It deals with how environmental issues, cultural issues concerning the environment and attitudes towards nature are presented and analyzed. One of the main goals in ecocriticism is to study how individuals in society behave and react in relation to nature and ecological aspects. This form of criticism has gained a lot of attention during recent years due to higher social emphasis on environmental destruction and increased technology. Earlier theories in literary and cultural studies focussed on issue of class, race, gender, region are criteria and “subjects”of critical analysis. The late twentieth century has woken up to a new threat: ecological disaster. In such a context, literary and cultural theory has begun to address the issue as a part of academic discourse. Large scale debates over “dumping,” North versus South environmentalism (the necessary differences between the en-vironmentalism of the developed and technologically advanced richer nations—the North, and the poorer, subsistence environmentalism of the developing or “Third World”—the South). Donald Worster ‘s Nature’s Economy (1977) became a textbook for the study of ecological thought down the ages. The historian Arnold Toynbee recorded the effect of human civilisation upon the land and nature in his monumental, Mankind and Mother Earth (1976). Various versions of environmentalism developed.Deep ecology and ecofeminism were two important developments. These new ideas questioned the notion of “development” and “modernity,” and argued that all Western notions in science, philosophy, politics were “anthropocentric” (human-centred) and “androcentric”(Man/male-centred). (3) How do our metaphors of the land influence the way we treat it? That is, what is the link between pedagogic or creative practice and actual political, sociocultural and ethical behaviour towards the land and other non-human life forms? (4) How is science —in the form of genetic engineering, technologies of reproduction, sexualities—open to critical scrutiny terms of the effects of science upon the land?

The essential assumptions, ideas and methods of ecocritics may be summed up as follows. (1) Ecocritics believe that human culture is related to the physical world. (2) Ecocriticism assumes that all life forms are interlinked. Ecocriticism expands the notion of “the world” to include the entire ecosphere. (3) Moreover, there is a definite link between nature and culture, where the literary treatment, representation and “thematisation” of land and nature influence actions on the land. (4) Joseph Meeker in an early work, The Comedy of Survival: Studies in Literary Ecology (1972) used the term “literary ecology” to refer to “the study of biological themes and relationships which appear in literary works. It is simultaneously an attempt to discover what roles have been played by literature in the ecology of the human species.” (5) William Rueckert is believed to have coined the term “ecocriticism” in 1978, which he defines as “the application of ecology and ecological concepts to the study of literature.”

Natural law.

The term “natural law” is ambiguous. It refers to a type of moral theory, as well as to a type of legal theory, but the core claims of the two kinds of theory are logically independent. It does not refer to the laws of nature , the laws that science aims to describe. According to natural law moral theory, the moral standards that govern human behavior are, in some sense, objectively derived from the nature of human beings and the nature of the world. While being logically independent of natural law legal theory, the two theories intersect. However, the majority of the article will focus on natural law legal theory.

According to natural law legal theory, the authority of legal standards necessarily derives, at least in part, from considerations having to do with the moral merit of those standards. There are a number of different kinds of natural law legal theories, differing from each other with respect to the role that morality plays in determining the authority of legal norms. The conceptual jurisprudence of John Austin provides a set of necessary and sufficient conditions for the existence of law that distinguishes law from non-law in every possible world. Classical natural law theory such as the theory of Thomas Aquinas focuses on the overlap between natural law moral and legal theories.  Similarly, the neo-naturalism of John Finnis is a development of classical natural law theory. In contrast, the procedural naturalism of Lon L. Fuller is a rejection of the conceptual naturalist idea that there are necessary substantive moral constraints on the content of law. Lastly, Ronald Dworkin’s theory is a response and critique of legal positivism . All of these theories subscribe to one or more basic tenets of natural law legal theory and are important to its development and influence.

1. Two Kinds of Natural Law Theory

At the outset, it is important to distinguish two kinds of theory that go by the name of natural law. The first is a theory of morality that is roughly characterized by the following theses. First, moral propositions have what is sometimes called objective standing in the sense that such propositions are the bearers of objective truth-value; that is, moral propositions can be objectively true or false. Though moral objectivism is sometimes equated with moral realism (see, e.g., Moore 1992, 190: “the truth of any moral proposition lies in its correspondence with a mind- and convention-independent moral reality”), the relationship between the two theories is controversial. Geoffrey Sayre-McCord (1988), for example, views moral objectivism as one species of moral realism, but not the only form; on Sayre-McCord’s view, moral subjectivism and moral intersubjectivism are also forms of moral realism. Strictly speaking, then, natural law moral theory is committed only to the objectivity of moral norms.

The second thesis constituting the core of natural law moral theory is the claim that standards of morality are in some sense derived from, or entailed by, the nature of the world and the nature of human beings. St. Thomas Aquinas, for example, identifies the rational nature of human beings as that which defines moral law: “the rule and measure of human acts is the reason, which is the first principle of human acts” (Aquinas, ST I-II, Q.90, A.I). On this common view, since human beings are by nature rational beings, it is morally appropriate that they should behave in a way that conforms to their rational nature. Thus, Aquinas derives the moral law from the nature of human beings (thus, “natural law”).

But there is another kind of natural law theory having to do with the relationship of morality to law. According to natural law theory of law, there is no clean division between the notion of law and the notion of morality. Though there are different versions of natural law theory, all subscribe to the thesis that there are at least some laws that depend for their “authority” not on some pre-existing human convention, but on the logical relationship in which they stand to moral standards. Otherwise put, some norms are authoritative in virtue of their moral content, even when there is no convention that makes moral merit a criterion of legal validity. The idea that the concepts of law and morality intersect in some way is called the Overlap Thesis.

As an empirical matter, many natural law moral theorists are also natural law legal theorists, but the two theories, strictly speaking, are logically independent. One can deny natural law theory of law but hold a natural law theory of morality. John Austin, the most influential of the early legal positivists, for example, denied the Overlap Thesis but held something that resembles a natural law ethical theory.

Indeed, Austin explicitly endorsed the view that it is not necessarily true that the legal validity of a norm depends on whether its content conforms to morality. But while Austin thus denied the Overlap Thesis, he accepted an objectivist moral theory; indeed, Austin inherited his utilitarianism almost wholesale from J.S. Mill and Jeremy Bentham. Here it is worth noting that utilitarians sometimes seem to suggest that they derive their utilitarianism from certain facts about human nature; as Bentham once wrote, “nature has placed mankind under the governance of two sovereign masters, pain and pleasure. It is for them alone to point out what we ought to do, as well as to determine what we shall do. On the one hand the standard of right and wrong, on the other the chain of causes and effects, are fastened to their throne” (Bentham 1948, 1). Thus, a commitment to natural law theory of morality is consistent with the denial of natural law theory of law.

Conversely, one could, though this would be unusual, accept a natural law theory of law without holding a natural law theory of morality. One could, for example, hold that the conceptual point of law is, in part, to reproduce the demands of morality, but also hold a form of ethical subjectivism (or relativism). On this peculiar view, the conceptual point of law would be to enforce those standards that are morally valid in virtue of cultural consensus. For this reason, natural law theory of law is logically independent of natural law theory of morality. The remainder of this essay will be exclusively concerned with natural law theories of law.

2. Conceptual Naturalism

A. the project of conceptual jurisprudence.

The principal objective of conceptual (or analytic) jurisprudence has traditionally been to provide an account of what distinguishes law as a system of norms from other systems of norms, such as ethical norms. As John Austin describes the project, conceptual jurisprudence seeks “the essence or nature which is common to all laws that are properly so called” (Austin 1995, 11). Accordingly, the task of conceptual jurisprudence is to provide a set of necessary and sufficient conditions for the existence of law that distinguishes law from non-law in every possible world.

While this task is usually interpreted as an attempt to analyze the concepts of law and legal system, there is some confusion as to both the value and character of conceptual analysis in philosophy of law. As Brian Leiter (1998) points out, philosophy of law is one of the few philosophical disciplines that takes conceptual analysis as its principal concern; most other areas in philosophy have taken a naturalistic turn, incorporating the tools and methods of the sciences. To clarify the role of conceptual analysis in law, Brian Bix (1995) distinguishes a number of different purposes that can be served by conceptual claims: (1) to track linguistic usage; (2) to stipulate meanings; (3) to explain what is important or essential about a class of objects; and (4) to establish an evaluative test for the concept-word. Bix takes conceptual analysis in law to be primarily concerned with (3) and (4).

In any event, conceptual analysis of law remains an important, if controversial, project in contemporary legal theory. Conceptual theories of law have traditionally been characterized in terms of their posture towards the Overlap Thesis. Thus, conceptual theories of law have traditionally been divided into two main categories: those like natural law legal theory that affirm there is a conceptual relation between law and morality and those like legal positivism that deny such a relation.

b. Classical Natural Law Theory

All forms of natural law theory subscribe to the Overlap Thesis, which asserts that there is some kind of non-conventional relation between law and morality. According to this view, then, the notion of law cannot be fully articulated without some reference to moral notions. Though the Overlap Thesis may seem unambiguous, there are a number of different ways in which it can be interpreted.

The strongest construction of the Overlap Thesis forms the foundation for the classical naturalism of Aquinas and Blackstone. Aquinas distinguishes four kinds of law: (1) eternal law; (2) natural law; (3) human law; and (4) divine law. Eternal law is comprised of those laws that govern the nature of an eternal universe; as Susan Dimock (1999, 22) puts it, one can “think of eternal law as comprising all those scientific (physical, chemical, biological, psychological, etc.) ‘laws’ by which the universe is ordered.” Divine law is concerned with those standards that must be satisfied by a human being to achieve eternal salvation. One cannot discover divine law by natural reason alone; the precepts of divine law are disclosed only through divine revelation.

The natural law is comprised of those precepts of the eternal law that govern the behavior of beings possessing reason and free will. The first precept of the natural law, according to Aquinas, is the somewhat vacuous imperative to do good and avoid evil. Here it is worth noting that Aquinas holds a natural law theory of morality: what is good and evil, according to Aquinas, is derived from the rational nature of human beings. Good and evil are thus both objective and universal.

But Aquinas is also a natural law legal theorist. On his view, a human law (that is, that which is promulgated by human beings) is valid only insofar as its content conforms to the content of the natural law; as Aquinas puts the point: “[E]very human law has just so much of the nature of law as is derived from the law of nature. But if in any point it deflects from the law of nature, it is no longer a law but a perversion of law” (ST I-II, Q.95, A.II). To paraphrase Augustine’s famous remark, an unjust law is really no law at all.

The idea that a norm that does not conform to the natural law cannot be legally valid is the defining thesis of conceptual naturalism. As William Blackstone describes the thesis, “This law of nature, being co-eval with mankind and dictated by God himself, is of course superior in obligation to any other. It is binding over all the globe, in all countries, and at all times: no human laws are of any validity, if contrary to this; and such of them as are valid derive all their force, and all their authority, mediately or immediately, from this original” (1979, 41). In this passage, Blackstone articulates the two claims that constitute the theoretical core of conceptual naturalism: 1) there can be no legally valid standards that conflict with the natural law; and 2) all valid laws derive what force and authority they have from the natural law.

It should be noted that classical naturalism is consistent with allowing a substantial role to human beings in the manufacture of law. While the classical naturalist seems committed to the claim that the law necessarily incorporates all moral principles, this claim does not imply that the law is exhausted by the set of moral principles. There will still be coordination problems (e.g., which side of the road to drive on) that can be resolved in any number of ways consistent with the set of moral principles. Thus, the classical naturalist does not deny that human beings have considerable discretion in creating natural law. Rather she claims only that such discretion is necessarily limited by moral norms: legal norms that are promulgated by human beings are valid only if they are consistent with morality.

Critics of conceptual naturalism have raised a number of objections to this view. First, it has often been pointed out that, contra Augustine, unjust laws are all-too- frequently enforced against persons. As Austin petulantly put the point:

Now, to say that human laws which conflict with the Divine law are not binding, that is to say, are not laws, is to talk stark nonsense. The most pernicious laws, and therefore those which are most opposed to the will of God, have been and are continually enforced as laws by judicial tribunals. Suppose an act innocuous, or positively beneficial, be prohibited by the sovereign under the penalty of death; if I commit this act, I shall be tried and condemned, and if I object to the sentence, that it is contrary to the law of God, who has commanded that human lawgivers shall not prohibit acts which have no evil consequences, the Court of Justice will demonstrate the inconclusiveness of my reasoning by hanging me up, in pursuance of the law of which I have impugned the validity (Austin 1995, 158).

Of course, as Brian Bix (1999) points out, the argument does little work for Austin because it is always possible for a court to enforce a law against a person that does not satisfy Austin’s own theory of legal validity.

Another frequently expressed worry is that conceptual naturalism undermines the possibility of moral criticism of the law; inasmuch as conformity with natural law is a necessary condition for legal validity, all valid law is, by definition, morally just. Thus, on this line of reasoning, the legal validity of a norm necessarily entails its moral justice. As Jules Coleman and Jeffrey Murphy (1990, 18) put the point:

The important things [conceptual naturalism] supposedly allows us to do (e.g., morally evaluate the law and determine our moral obligations with respect to the law) are actually rendered more difficult by its collapse of the distinction between morality and law. If we really want to think about the law from the moral point of view, it may obscure the task if we see law and morality as essentially linked in some way. Moral criticism and reform of law may be aided by an initial moral skepticism about the law.

There are a couple of problems with this line of objection. First, conceptual naturalism does not foreclose criticism of those norms that are being enforced by a society as law. Insofar as it can plausibly be claimed that the content of a norm being enforced by society as law does not conform to the natural law, this is a legitimate ground of moral criticism: given that the norm being enforced by law is unjust, it follows, according to conceptual naturalism, that it is not legally valid. Thus, the state commits wrong by enforcing that norm against private citizens.

Second, and more importantly, this line of objection seeks to criticize a conceptual theory of law by pointing to its practical implications ñ a strategy that seems to commit a category mistake. Conceptual jurisprudence assumes the existence of a core of social practices (constituting law) that requires a conceptual explanation. The project motivating conceptual jurisprudence, then, is to articulate the concept of law in a way that accounts for these pre-existing social practices. A conceptual theory of law can legitimately be criticized for its failure to adequately account for the pre-existing data, as it were; but it cannot legitimately be criticized for either its normative quality or its practical implications.

A more interesting line of argument has recently been taken up by Brian Bix (1996). Following John Finnis (1980), Bix rejects the interpretation of Aquinas and Blackstone as conceptual naturalists, arguing instead that the claim that an unjust law is not a law should not be taken literally:

A more reasonable interpretation of statements like “an unjust law is no law at all” is that unjust laws are not laws “in the fullest sense.” As we might say of some professional, who had the necessary degrees and credentials, but seemed nonetheless to lack the necessary ability or judgment: “she’s no lawyer” or “he’s no doctor.” This only indicates that we do not think that the title in this case carries with it all the implications it usually does. Similarly, to say that an unjust law is “not really law” may only be to point out that it does not carry the same moral force or offer the same reasons for action as laws consistent with “higher law” (Bix 1996, 226).

Thus, Bix construes Aquinas and Blackstone as having views more similar to the neo- naturalism of John Finnis discussed below in Section III. Nevertheless, while a plausible case can be made in favor of Bix’s view, the long history of construing Aquinas and Blackstone as conceptual naturalists, along with its pedagogical value in developing other theories of law, ensures that this practice is likely, for better or worse, to continue indefinitely.

3. The Substantive Neo-Naturalism of John Finnis

John Finnis takes himself to be explicating and developing the views of Aquinas and Blackstone. Like Bix, Finnis believes that the naturalism of Aquinas and Blackstone should not be construed as a conceptual account of the existence conditions for law. According to Finnis, the classical naturalists were not concerned with giving a conceptual account of legal validity; rather they were concerned with explaining the moral force of law: “the principles of natural law explain the obligatory force (in the fullest sense of ‘obligation’) of positive laws, even when those laws cannot be deduced from those principles” (Finnis 1980, 23-24). On Finnis’s view of the Overlap Thesis, the essential function of law is to provide a justification for state coercion (a view he shares with Ronald Dworkin). Accordingly, an unjust law can be legally valid, but it cannot provide an adequate justification for use of the state coercive power and is hence not obligatory in the fullest sense; thus, an unjust law fails to realize the moral ideals implicit in the concept of law. An unjust law, on this view, is legally binding, but is not fully law.

Like classical naturalism, Finnis’s naturalism is both an ethical theory and a theory of law. Finnis distinguishes a number of equally valuable basic goods: life, health, knowledge, play, friendship, religion, and aesthetic experience. Each of these goods, according to Finnis, has intrinsic value in the sense that it should, given human nature, be valued for its own sake and not merely for the sake of some other good it can assist in bringing about. Moreover, each of these goods is universal in the sense that it governs all human cultures at all times. The point of moral principles, on this view, is to give ethical structure to the pursuit of these basic goods; moral principles enable us to select among competing goods and to define what a human being can permissibly do in pursuit of a basic good.

On Finnis’s view, the conceptual point of law is to facilitate the common good by providing authoritative rules that solve coordination problems that arise in connection with the common pursuit of these basic goods. Thus, Finnis sums up his theory of law as follows:

[T]he term ‘law’ … refer[s] primarily to rules made, in accordance with regulative legal rules, by a determinate and effective authority (itself identified and, standardly, constituted as an institution by legal rules) for a ‘complete’ community, and buttressed by sanctions in accordance with the rule-guided stipulations of adjudicative institutions, this ensemble of rules and institutions being directed to reasonably resolving any of the community’s co-ordination problems (and to ratifying, tolerating, regulating, or overriding co-ordination solutions from any other institutions or sources of norms) for the common good of that community (Finnis 1980, 276).

Again, it bears emphasizing that Finnis takes care to deny that there is any necessary moral test for legal validity: “one would simply be misunderstanding my conception of the nature and purpose of explanatory definitions of theoretical concepts if one supposed that my definition ‘ruled out as non-laws’ laws which failed to meet, or meet fully, one or other of the elements of the definition” (Finnis 1980, 278).

Nevertheless, Finnis believes that to the extent that a norm fails to satisfy these conditions, it likewise fails to fully manifest the nature of law and thereby fails to fully obligate the citizen-subject of the law. Unjust laws may obligate in a technical legal sense, on Finnis’s view, but they may fail to provide moral reasons for action of the sort that it is the point of legal authority to provide. Thus, Finnis argues that “a ruler’s use of authority is radically defective if he exploits his opportunities by making stipulations intended by him not for the common good but for his own or his friends’ or party’s or faction’s advantage, or out of malice against some person or group” (Finnis 1980, 352). For the ultimate basis of a ruler’s moral authority, on this view, “is the fact that he has the opportunity, and thus the responsibility, of furthering the common good by stipulating solutions to a community’s co- ordination problems” (Finnis 1980, 351).

Finnis’s theory is certainly more plausible as a theory of law than the traditional interpretation of classical naturalism, but such plausibility comes, for better or worse, at the expense of naturalism’s identity as a distinct theory of law. Indeed, it appears that Finnis’s natural law theory is compatible with naturalism’s historical adversary, legal positivism, inasmuch as Finnis’s view is compatible with a source-based theory of legal validity; laws that are technically valid in virtue of source but unjust do not, according to Finnis, fully obligate the citizen. Indeed, Finnis (1996) believes that Aquinas’s classical naturalism fully affirms the notion that human laws are “posited.”

4. The Procedural Naturalism of Lon L. Fuller

Like Finnis, Lon Fuller (1964) rejects the conceptual naturalist idea that there are necessary substantive moral constraints on the content of law. But Fuller, unlike Finnis, believes that law is necessarily subject to a procedural morality. On Fuller’s view, human activity is necessarily goal-oriented or purposive in the sense that people engage in a particular activity because it helps them to achieve some end. Insofar as human activity is essentially purposive, according to Fuller, particular human activities can be understood only in terms that make reference to their purposes and ends. Thus, since lawmaking is essentially purposive activity, it can be understood only in terms that explicitly acknowledge its essential values and purposes:

The only formula that might be called a definition of law offered in these writings is by now thoroughly familiar: law is the enterprise of subjecting human conduct to the governance of rules. Unlike most modern theories of law, this view treats law as an activity and regards a legal system as the product of a sustained purposive effort (Fuller 1964, 106).

To the extent that a definition of law can be given, then, it must include the idea that law’s essential function is to “achiev[e] [social] order through subjecting people’s conduct to the guidance of general rules by which they may themselves orient their behavior” (Fuller 1965, 657).

Fuller’s functionalist conception of law implies that nothing can count as law unless it is capable of performing law’s essential function of guiding behavior. And to be capable of performing this function, a system of rules must satisfy the following principles:

  • (P1) the rules must be expressed in general terms;
  • (P2) the rules must be publicly promulgated;
  • (P3) the rules must be prospective in effect;
  • (P4) the rules must be expressed in understandable terms;
  • (P5) the rules must be consistent with one another;
  • (P6) the rules must not require conduct beyond the powers of the affected parties;
  • (P7) the rules must not be changed so frequently that the subject cannot rely on them; and
  • (P8) the rules must be administered in a manner consistent with their wording.

On Fuller’s view, no system of rules that fails minimally to satisfy these principles of legality can achieve law’s essential purpose of achieving social order through the use of rules that guide behavior. A system of rules that fails to satisfy (P2) or (P4), for example, cannot guide behavior because people will not be able to determine what the rules require. Accordingly, Fuller concludes that his eight principles are “internal” to law in the sense that they are built into the existence conditions for law.

These internal principles constitute a morality, according to Fuller, because law necessarily has positive moral value in two respects: (1) law conduces to a state of social order and (2) does so by respecting human autonomy because rules guide behavior. Since no system of rules can achieve these morally valuable objectives without minimally complying with the principles of legality, it follows, on Fuller’s view, that they constitute a morality. Since these moral principles are built into the existence conditions for law, they are internal and hence represent a conceptual connection between law and morality. Thus, like the classical naturalists and unlike Finnis, Fuller subscribes to the strongest form of the Overlap Thesis, which makes him a conceptual naturalist.

Nevertheless, Fuller’s conceptual naturalism is fundamentally different from that of classical naturalism. First, Fuller rejects the classical naturalist view that there are necessary moral constraints on the content of law, holding instead that there are necessary moral constraints on the procedural mechanisms by which law is made and administered: “What I have called the internal morality of law is … a procedural version of natural law … [in the sense that it is] concerned, not with the substantive aims of legal rules, but with the ways in which a system of rules for governing human conduct must be constructed and administered if it is to be efficacious and at the same time remain what it purports to be” (Fuller 1964, 96- 97).

Second, Fuller identifies the conceptual connection between law and morality at a higher level of abstraction than the classical naturalists. The classical naturalists view morality as providing substantive constraints on the content of individual laws; an unjust norm, on this view, is conceptually disqualified from being legally valid. In contrast, Fuller views morality as providing a constraint on the existence of a legal system: “A total failure in any one of these eight directions does not simply result in a bad system of law; it results in something that is not properly called a legal system at all” (Fuller 1964, 39).

Fuller’s procedural naturalism is vulnerable to a number of objections. H.L.A. Hart, for example, denies Fuller’s claim that the principles of legality constitute an internal morality; according to Hart, Fuller confuses the notions of morality and efficacy:

[T]he author’s insistence on classifying these principles of legality as a “morality” is a source of confusion both for him and his readers…. [T]he crucial objection to the designation of these principles of good legal craftsmanship as morality, in spite of the qualification “inner,” is that it perpetrates a confusion between two notions that it is vital to hold apart: the notions of purposive activity and morality. Poisoning is no doubt a purposive activity, and reflections on its purpose may show that it has its internal principles. (“Avoid poisons however lethal if they cause the victim to vomit”….) But to call these principles of the poisoner’s art “the morality of poisoning” would simply blur the distinction between the notion of efficiency for a purpose and those final judgments about activities and purposes with which morality in its various forms is concerned (Hart 1965, 1285-86).

On Hart’s view, all actions, including virtuous acts like lawmaking and impermissible acts like poisoning, have their own internal standards of efficacy. But insofar as such standards of efficacy conflict with morality, as they do in the case of poisoning, it follows that they are distinct from moral standards. Thus, while Hart concedes that something like Fuller’s eight principles are built into the existence conditions for law, he concludes they do not constitute a conceptual connection between law and morality.

Unfortunately, Hart overlooks the fact that most of Fuller’s eight principles double as moral ideals of fairness. For example, public promulgation in understandable terms may be a necessary condition for efficacy, but it is also a moral ideal; it is morally objectionable for a state to enforce rules that have not been publicly promulgated in terms reasonably calculated to give notice of what is required. Similarly, we take it for granted that it is wrong for a state to enact retroactive rules, inconsistent rules, and rules that require what is impossible. Poisoning may have its internal standards of efficacy, but such standards are distinguishable from the principles of legality in that they conflict with moral ideals.

Nevertheless, Fuller’s principles operate internally, not as moral ideals, but merely as principles of efficacy. As Fuller would likely acknowledge, the existence of a legal system is consistent with considerable divergence from the principles of legality. Legal standards, for example, are necessarily promulgated in general terms that inevitably give rise to problems of vagueness. And officials all too often fail to administer the laws in a fair and even-handed manner even in the best of legal systems. These divergences may always be prima facie objectionable, but they are inconsistent with a legal system only when they render a legal system incapable of performing its essential function of guiding behavior. Insofar as these principles are built into the existence conditions for law, it is because they operate as efficacy conditions and not because they function as moral ideals.

5. Ronald Dworkin’s “Third Theory”

Ronald Dworkin’s so-called third theory of law is best understood as a response to legal positivism, which is essentially constituted by three theoretical commitments: the Social Fact Thesis, the Conventionality Thesis, and the Separability Thesis. The Social Fact Thesis asserts it is a necessary truth that legal validity is ultimately a function of certain kinds of social facts; the idea here is that what ultimately explains the validity of a law is the presence of certain social facts, especially formal promulgation by a legislature.

The Conventionality Thesis emphasizes law’s conventional nature, claiming that the social facts giving rise to legal validity are authoritative in virtue of a social convention. On this view, the criteria that determine whether or not any given norm counts as a legal norm are binding because of an implicit or explicit agreement among officials. Thus, for example, the U.S. Constitution is authoritative in virtue of the conventional fact that it was formally ratified by all fifty states.

The Separability Thesis, at the most general level, simply denies naturalism’s Overlap Thesis; according to the Separability Thesis, there is no conceptual overlap between the notions of law and morality. As Hart more narrowly construes it, the Separability Thesis is “just the simple contention that it is in no sense a necessary truth that laws reproduce or satisfy certain demands of morality, though in fact they have often done so” (Hart 1994, 185-186).

Dworkin rejects positivism’s Social Fact Thesis on the ground that there are some legal standards the authority of which cannot be explained in terms of social facts. In deciding hard cases, for example, judges often invoke moral principles that Dworkin believes do not derive their legal authority from the social criteria of legality contained in a rule of recognition (Dworkin 1977, p. 40).

In Riggs v. Palmer , for example, the court considered the question of whether a murderer could take under the will of his victim. At the time the case was decided, neither the statutes nor the case law governing wills expressly prohibited a murderer from taking under his victim’s will. Despite this, the court declined to award the defendant his gift under the will on the ground that it would be wrong to allow him to profit from such a grievous wrong. On Dworkin’s view, the court decided the case by citing “the principle that no man may profit from his own wrong as a background standard against which to read the statute of wills and in this way justified a new interpretation of that statute” (Dworkin 1977, 29).

On Dworkin’s view, the Riggs court was not just reaching beyond the law to extralegal standards when it considered this principle. For the Riggs judges would “rightfully” have been criticized had they failed to consider this principle; if it were merely an extralegal standard, there would be no rightful grounds to criticize a failure to consider it (Dworkin 1977, 35). Accordingly, Dworkin concludes that the best explanation for the propriety of such criticism is that principles are part of the law.

Further, Dworkin maintains that the legal authority of standards like the Riggs principle cannot derive from promulgation in accordance with purely formal requirements: “[e]ven though principles draw support from the official acts of legal institutions, they do not have a simple or direct enough connection with these acts to frame that connection in terms of criteria specified by some ultimate master rule of recognition” (Dworkin 1977, 41).

On Dworkin’s view, the legal authority of the Riggs principle can be explained wholly in terms of its content. The Riggs principle was binding, in part, because it is a requirement of fundamental fairness that figures into the best moral justification for a society’s legal practices considered as a whole. A moral principle is legally authoritative, according to Dworkin, insofar as it maximally conduces to the best moral justification for a society’s legal practices considered as a whole.

Dworkin believes that a legal principle maximally contributes to such a justification if and only if it satisfies two conditions: (1) the principle coheres with existing legal materials; and (2) the principle is the most morally attractive standard that satisfies (1). The correct legal principle is the one that makes the law the moral best it can be. Accordingly, on Dworkin’s view, adjudication is and should be interpretive:

[J]udges should decide hard cases by interpreting the political structure of their community in the following, perhaps special way: by trying to find the best justification they can find, in principles of political morality, for the structure as a whole, from the most profound constitutional rules and arrangements to the details of, for example, the private law of tort or contract (Dworkin 1982, 165).

There are, thus, two elements of a successful interpretation. First, since an interpretation is successful insofar as it justifies the particular practices of a particular society, the interpretation must fit with those practices in the sense that it coheres with existing legal materials defining the practices. Second, since an interpretation provides a moral justification for those practices, it must present them in the best possible moral light.

For this reason, Dworkin argues that a judge should strive to interpret a case in roughly the following way:

A thoughtful judge might establish for himself, for example, a rough “threshold” of fit which any interpretation of data must meet in order to be “acceptable” on the dimension of fit, and then suppose that if more than one interpretation of some part of the law meets this threshold, the choice among these should be made, not through further and more precise comparisons between the two along that dimension, but by choosing the interpretation which is “substantively” better, that is, which better promotes the political ideals he thinks correct (Dworkin 1982, 171).

As Dworkin conceives it, then, the judge must approach judicial decision-making as something that resembles an exercise in moral philosophy. Thus, for example, the judge must decide cases on the basis of those moral principles that “figure[] in the soundest theory of law that can be provided as a justification for the explicit substantive and institutional rules of the jurisdiction in question” (Dworkin 1977, 66).

And this is a process, according to Dworkin, that “must carry the lawyer very deep into political and moral theory.” Indeed, in later writings, Dworkin goes so far as to claim, somewhat implausibly, that “any judge’s opinion is itself a piece of legal philosophy, even when the philosophy is hidden and the visible argument is dominated by citation and lists of facts” (Dworkin 1986, 90).

Dworkin believes his theory of judicial obligation is a consequence of what he calls the Rights Thesis, according to which judicial decisions always enforce pre-existing rights: “even when no settled rule disposes of the case, one party may nevertheless have a right to win. It remains the judge’s duty, even in hard cases, to discover what the rights of the parties are, not to invent new rights retrospectively” (Dworkin 1977, 81).

In “Hard Cases,” Dworkin distinguishes between two kinds of legal argument. Arguments of policy “justify a political decision by showing that the decision advances or protects some collective goal of the community as a whole” (Dworkin 1977, 82). In contrast, arguments of principle “justify a political decision by showing that the decision respects or secures some individual or group right” (Dworkin 1977, 82).

On Dworkin’s view, while the legislature may legitimately enact laws that are justified by arguments of policy, courts may not pursue such arguments in deciding cases. For a consequentialist argument of policy can never provide an adequate justification for deciding in favor of one party’s claim of right and against another party’s claim of right. An appeal to a pre-existing right, according to Dworkin, can ultimately be justified only by an argument of principle. Thus, insofar as judicial decisions necessarily adjudicate claims of right, they must ultimately be based on the moral principles that figure into the best justification of the legal practices considered as a whole.

Notice that Dworkin’s views on legal principles and judicial obligation are inconsistent with all three of legal positivism’s core commitments. Each contradicts the Conventionality Thesis insofar as judges are bound to interpret posited law in light of unposited moral principles. Each contradicts the Social Fact Thesis because these moral principles count as part of a community’s law regardless of whether they have been formally promulgated. Most importantly, Dworkin’s view contradicts the Separability Thesis in that it seems to imply that some norms are necessarily valid in virtue of their moral content. It is his denial of the Separability Thesis that places Dworkin in the naturalist camp.

What are your experiences with nature?

How often do you take a leisurely stroll through the grass, a garden or the woods? How often do you stop to look at, touch or smell a flower?

How do you feel when you are alone in nature? Do you find it relaxing, invigorating, healing?

In “ The Healing Power of Gardens ,” Oliver Sacks, a neurologist who died in 2015, wrote:

As a writer, I find gardens essential to the creative process; as a physician, I take my patients to gardens whenever possible. All of us have had the experience of wandering through a lush garden or a timeless desert, walking by a river or an ocean, or climbing a mountain and finding ourselves simultaneously calmed and reinvigorated, engaged in mind, refreshed in body and spirit. The importance of these physiological states on individual and community health is fundamental and wide-ranging. In 40 years of medical practice, I have found only two types of non-pharmaceutical “therapy” to be vitally important for patients with chronic neurological diseases: music and gardens.

I have lived in New York City for 50 years, and living here is sometimes made bearable for me only by its gardens. This has been true for my patients, too. When I worked at Beth Abraham, a hospital just across the road from the New York Botanical Garden, I found that there was nothing long-shut-in patients loved more than a visit to the garden — they spoke of the hospital and the garden as two different worlds. I cannot say exactly how nature exerts its calming and organizing effects on our brains, but I have seen in my patients the restorative and healing powers of nature and gardens, even for those who are deeply disabled neurologically. In many cases, gardens and nature are more powerful than any medication. My friend Lowell has moderately severe Tourette’s syndrome. In his usual busy, city environment, he has hundreds of tics and verbal ejaculations each day — grunting, jumping, touching things compulsively. I was therefore amazed one day when we were hiking in a desert to realize that his tics had completely disappeared. The remoteness and uncrowdedness of the scene, combined with some ineffable calming effect of nature, served to defuse his ticcing, to “normalize” his neurological state, at least for a time. An elderly lady with Parkinson’s disease, whom I met in Guam, often found herself frozen, unable to initiate movement — a common problem for those with parkinsonism. But once we led her out into the garden, where plants and a rock garden provided a varied landscape, she was galvanized by this, and could rapidly, unaided, climb up the rocks and down again. I have a number of patients with very advanced dementia or Alzheimer’s disease, who may have very little sense of orientation to their surroundings. They have forgotten, or cannot access, how to tie their shoes or handle cooking implements. But put them in front of a flower bed with some seedlings, and they will know exactly what to do — I have never seen such a patient plant something upside down.

Clearly, nature calls to something very deep in us. Biophilia, the love of nature and living things, is an essential part of the human condition. Hortophilia, the desire to interact with, manage and tend nature, is also deeply instilled in us. The role that nature plays in health and healing becomes even more critical for people working long days in windowless offices, for those living in city neighborhoods without access to green spaces, for children in city schools or for those in institutional settings such as nursing homes. The effects of nature’s qualities on health are not only spiritual and emotional but physical and neurological. I have no doubt that they reflect deep changes in the brain’s physiology, and perhaps even its structure.

I would define nature as the world around us without any type of human involvement. I believe that nature is anything natural to the earth. It is the plants, animals, rivers, forests, birds, weather, etc. It is a gift given to us from god. Most people believe that nature is just centered on the thought of the ocean and forest. Nature to me is the life source for all living creatures it provides us with the four essential things that we need to survive which are food, water, air, and shelter. However, we are so disconnected from nature we do not see the constant damage that is destroying our home. The urban environment that I live in is my nature. My nature is filled with birds, cats, grass, and flowers. It may not be as abundant with mother nature’s resources compared to most places, but it still provides me with an experience of nature. In nature, you must smell the wonderful odors from the flowers, you should use your sight and observe the natural beauty of the ever-changing sky, touch the rough and jagged bark of the trees, and hear the spectacular songs of the birds that fly above you. The connection between humans and nature is very weak. Due to future advancement we are basically losing our grip on reality, which brings up the point of destruction to nature that we are not aware of. At one point in time nature was the most beautiful thing you could ever witness. Now people exploit it for money. They are selling land, resources, even water for a profit. They don’t think twice or blink an eye at the damage they cause. The disconnect is so huge the debate of protecting the earth is treated as a forbidden topic. “Second, environmental injustices critics challenge the mainstream environmental idea of what environmental problems are in the first place. Without a well-managed mechanism for consuming these renewable resources, we will not be able to bring them back in the future for future generations to use.

2. Non-Renewable - Non-renewable natural resources are those that cannot be duplicated and are only available in finite amounts on the globe. Minerals, Metals, petroleum, and coal are located under the earth's surface. Both of these items are in short supply and are extremely useful and valuable in everyday life.

Other categories of natural resources, in addition to these two, are specified as:

1. Biotic - These are natural resources derived from the global environment and include life-like plants, trees, and animals.

2. Abiotic - These resources include non-living natural resources such as air, water, ground, soil, minerals, and metals.

Both Renewable and Non-Renewable resources are used for various purposes:

Wind energy is produced by the movement of air.

Water is used for drinking and hydroelectric energy production.

Plants and trees provide us with vegetables, fruits, cotton, and wood, which we can use to make paper, furniture, and houses.

Animals provide us with milk, and their skin is used to make soap, shoes, purses, belts, and other products.

Solar energy is generated by the sun, which is used to keep us warm.

Oil is used to power vehicles and generates electricity.

Coins, steel, and jewelry are all made from minerals and metals.

Electricity is generated using coal.

What Causes the Depletion of These Resources?

Over-Population: When the world's population grows at an exponential pace, so does the demand for natural resources.

Urbanization: More cities and towns are springing up to meet the ever-increasing demand for housing and other necessities. Some resources have been exhausted as a result of this.

Industrialization: Several new industries are springing up in both rural and urban areas to create jobs and manufacture consumer goods for everyday use. As a result, our natural resources have been over-exploited.

Deforestation: Deforestation is the degradation of trees on a wide scale. Forest degradation has resulted in a reduction in other natural resources such as soil, water, and wildlife.

Mining and Quarrying: Resources have also been exhausted as a result of unscientific mining and quarrying for the production of minerals and ores.

Overgrazing: Soil erosion is exacerbated by overgrazing by cattle in general, and sheep and goats in particular.

Intensive Agriculture: Excessive use of fertilizers and pesticides, as well as cultivating the same crop year after year, decreases soil fertility and leaves the soil sick.

Insecticides: Insecticides and industrial waste products have depleted biodiversity in the forest, rivers, wetlands, dams, and oceans.

Soil Erosion: Soil erosion is the process of water or wind transporting nutrient-rich topsoil away. This harms both the soil and the plants.

What does the word nature mean to you? Does it conjure visions of wild places away from the hustle and bustle of people, or does it include humans too? The meaning of nature has changed since the word was first used back as early as the 15th century .

Now a new campaign, We Are Nature , aims to persuade dictionaries to include humans in their definitions of nature. This campaign, a collaboration between a group of lawyers and a design company, involves a petition and open letter , as well as a collection of alternative definitions supplied by various thinkers and authors (including me). Here’s my definition of nature:

The living world comprised as the total set of organisms and relationships between them. These organisms include bacteria, fungi, plants and animals (including humans). Some definitions may also include non-living entities as part of nature – such as mountains, waterfalls and cloud formations – in recognition of their important role underpinning the web of life.

Derived from the Latin natura , literally meaning “birth”, nature used to only refer to the innate qualities or essential disposition of something. But over time, it also began to describe something “other” or separate to humans. For example, the Oxford English Dictionary (OED) defines nature as :

The phenomena of the physical world collectively; esp. plants, animals, and other features and products of the Earth itself, as opposed to humans and human creations.

But how did we arrive at such a definition, which hinges on us being apart from, rather than a part of, the natural world? Since the 17th century, a rationalist world view prompted by philosophers such as René Descartes increasingly saw things from a mechanical perspective, comparing the workings of the universe to a great machine. Rather than any kind of divine spirit inhabiting the natural world, this perspective emphasised the split between the human mind and physical matter.

Anything non-human fell into the latter category and was likened to clockwork machinery. But that view has since been found to lead to animal cruelty , and many environmental bodies including the European Environment Agency suggest this disconnect is accelerating the decline of nature.

Is it OK to change words in a dictionary through lobbying? There are two lines of thought here. One might argue yes, if the scientific evidence suggests the distinction between nature and humans is illusory – something I have argued based on findings in biology, ecology and neuroscience.

A dictionary definition represents society’s framing of the natural world. This in turn influences our perception of our place within it – and the actions we take to protect nature. So, the words we use have real-world impacts: they frame how we think and determine how we feel and act. Linguist George Lakoff has argued that they ultimately structure our society.

My children are growing up in a world where humans feel disconnected with nature – indeed, the UK ranks among the most disconnected countries. Research shows this leads people to make fewer positive environmental changes to their behaviour , such as reducing their carbon footprint, recycling, or doing voluntary conservation work.

Conversely, when people feel they are enmeshed with nature, they are not only greener in their behaviour but they tend to be happier . So I absolutely want my kids to grow up feeling they are part of nature.

There are some words that I certainly recommend we use less. I dislike the term “natural capital”, referring to nature as an asset that can be commodified and sold . These words have a place with professional environmentalists and policy, but they can also create psychological distancing and make us care less for natural world.

One sustainability-focused communications agency found the best way to motivate people about protecting nature is through messages based on awe and wonder , rather than the economic value of nature. Scientific studies back this up.

Dangers of controlling language

But I’m torn. Another line of thought suggests it’s not OK to change the meaning of words through lobbying, and that dictionaries should reflect how words are being used – the OED takes this position .

Dystopian fiction, including George Orwell’s Nineteen Eighty-Four , highlights the dangers of a world where controlling the language allows control of the population. Dictionaries bowing to pressure from lobbying seems to set a dangerous precedent.

With regards to the meaning of nature, if a word is too broad, it may lose its usefulness in communication, just like a blunt knife is a poor tool for carving food. People wanting to articulate the natural world may simply use other words, such as “environment”. This word is derived from the French environs , explicitly describing something surrounding us.

Environment has already been replacing nature in our modern lexicon. This may reflect a subtle cognitive shift towards increasingly seeing human beings as distinct entities, separate from the natural world.

Nature v environment: tracking the use of these words

But the We Are Nature campaign is not just lobbying the OED based on a preferred use of language. The organisers have collated many historical uses of the word nature from 1850 to the present day, some of which include humans in the meaning, and presented the dictionary with this evidence. In April 2024, as a result, the OED removed the label “obsolete” from a secondary, wider definition of nature comprising “the whole natural world, including human beings”.

But to change the primary definition of nature from “as opposed to humans” to “including humans” will require more people to use the word in a way that reflects how humans are intertwined with the whole web of life.

The great thing is, by doing this, we rekindle the bonds of care towards the living world around us. And by dispelling the illusion of our separation from nature, we can also expect to live happier lives . Words matter – there is restoration and joy from talking about how we are nature.

OpenAI's blockbuster chatbot ChatGPT is getting a new update. 

On Monday, OpenAI unveiled GPT-4o for ChatGPT, a new version of the bot that can hold conversations with users in a very human tone. The new version of the chatbot will also have vision abilities.

The futuristic reveal quickly prompted jokes about parallels to the movie "Her," with some calling the chatbot's new voice " cringe ."

The move is a big step for the future of AI-powered virtual assistants, which tech companies have been racing to develop.

Since its release in 2022, hundreds of millions of people have experimented with the tool, which is already changing how the internet looks and feels to users.

Users have flocked to ChatGPT to improve their personal lives and boost productivity . Some workers have used the AI chatbot to develop code , write real estate listings , and create lesson plans, while others have made teaching the best ways to use ChatGPT a career all to itself.

ChatGPT offers dozens of plug-ins to those who subscribe to ChatGPT Plus subscription. An Expedia one can help you book a trip, while an OpenTable one will get nab you a dinner reservation. And last month, OpenAI launched Code Interpreter, a version of ChatGPT that can code and analyze data .

While the personal tone of conversations with an AI bot like ChatGPT can evoke the experience of chatting with a human, the technology, which runs on " large language model tools, " doesn't speak with sentience and doesn't "think" the way people do. 

That means that even though ChatGPT can explain quantum physics or write a poem on command, a full AI takeover isn't exactly imminent , according to experts.

"There's a saying that an infinite number of monkeys will eventually give you Shakespeare," said Matthew Sag, a law professor at Emory University who studies copyright implications for training and using large language models like ChatGPT.

"There's a large number of monkeys here, giving you things that are impressive — but there is intrinsically a difference between the way that humans produce language, and the way that large language models do it," he said. 

Chatbots like ChatGPT are powered by large amounts of data and computing techniques to make predictions to string words together in a meaningful way. They not only tap into a vast amount of vocabulary and information, but also understand words in context. This helps them mimic speech patterns while dispatching an encyclopedic knowledge. 

Other tech companies like Google and Meta have developed their own large language model tools, which use programs that take in human prompts and devise sophisticated responses.

Despite the AI's impressive capabilities, some have called out OpenAI's chatbot for spewing misinformation , stealing personal data for training purposes , and even encouraging students to cheat and plagiarize on their assignments. 

Some recent efforts to use chatbots for real-world services have proved troubling. In 2023, the mental health company Koko came under fire after its founder wrote about how the company used GPT-3 in an experiment to reply to users. 

Koko cofounder Rob Morris hastened to clarify on Twitter that users weren't speaking directly to a chatbot, but that AI was used to "help craft" responses.

The introduction of AlphaFold 2 1 has spurred a revolution in modelling the structure of proteins and their interactions, enabling a huge range of applications in protein modelling and design 2–6 . In this paper, we describe our AlphaFold 3 model with a substantially updated diffusion-based architecture, which is capable of joint structure prediction of complexes including proteins, nucleic acids, small molecules, ions, and modified residues. The new AlphaFold model demonstrates significantly improved accuracy over many previous specialised tools: far greater accuracy on protein-ligand interactions than state of the art docking tools, much higher accuracy on protein-nucleic acid interactions than nucleic-acid-specific predictors, and significantly higher antibody-antigen prediction accuracy than AlphaFold-Multimer v2.3 7,8 . Together these results show that high accuracy modelling across biomolecular space is possible within a single unified deep learning framework.

Where we work, learn, play, eat and live has important implications for health. The built environment has been associated with the development of chronic disease, and with health behaviours often seen as critical pathways for this relationship. Footnote 1 Footnote 2 Built environments refer to components of the physical environment that are human-made or human-modified and include structures and buildings, recreation facilities, green spaces and parks, transportation systems and community design.

Natural experiments are interventions that occur without a researcher’s ability to manipulate the intervention or exposure to the intervention. Footnote 3 Footnote 4 Natural experiments offer the opportunity to evaluate the effects of “naturally occurring” interventions such as changes to the built environment (e.g. creation of a new bike path, park improvements, infrastructure changes to schools or workplaces, construction of a new recreation facility or grocery store) on health behaviours and chronic disease risk. Natural experiments are often more practical for investigating the health impacts of environmental interventions when compared to traditional experimental studies (e.g. randomized controlled trials). Compared to cross-sectional studies, natural experiments provide a means to generate rigorous evidence to better establish causality, as well as to understand the implementation of interventions in “real-world” scenarios.

This special issue answers the 2017 Canadian Public Health Officer annual report’s call to further evaluate the health impacts of community design features in Canada. Footnote 5 This special issue resonates with the expanding scholarly and policy-oriented interest in the utility of natural experiments as a critical tool in advancing the body of evidence and for informing interventions to improve public and population health. Footnote 6 Footnote 7 Specifically, the objective of this special issue on natural experiments is to provide timely evidence to further understand the effectiveness of built environment interventions on health behaviours and chronic disease prevention in a Canadian context.

Health Promotion and Chronic Disease Prevention in Canada: Research, Policy and Practice is seeking relevant topical research articles that present new findings or synthesize/review existing evidence on natural experiments of the built environment (or related policies) that influence health behaviours with implications for chronic disease prevention in Canada.

Relevant topic areas include, but are not limited to:

  • Built environments, including community or neighbourhoods, workplaces, schools, transportation infrastructure, home environments, recreation environments, parks, playgrounds, green spaces, public open spaces, natural environments and seniors’ residences.
  • All health-related behaviours, including physical activity, sedentary behaviour, sleep, food consumption, smoking and substance use.
  • Chronic diseases and health-related outcomes, including body mass index, fitness, blood pressure, blood lipids, blood sugar, injuries, falls, mental health, stress, depression, anxiety, Alzheimer's disease, dementia, obesity, metabolic syndrome, cardiovascular disease, cancer, diabetes and lung disease.

International submissions will be considered if they include Canadian data, results (e.g. as part of multi-country studies or global comparisons) and/or evidence-based discussion of implications for community or population health in Canada.
