World Day for International Justice – July 17, 2024

The day of many names — World Day for International Justice, Day of International Criminal Justice, or International Justice Day — is held each year on July 17 as part of an effort to recognize the system of international justice. These celebrations highlight how international justice tribunals and courts have brought and continue to bring justice for the victims of war crimes and crimes against humanity. It also commemorates the day the Rome Statute was adopted globally and ensures member nations of the International Criminal Court live up to their expectations.  

History of World Day for International Justice

Over the centuries, the world has seen new boundaries, new frontiers, and new challenges. Alliances were made and broken. Wars broke out. People committed unspeakable acts against fellow men, women, and children. The world felt the need for international justice.  

Out of this need arose the Nuremberg trials, which many regard as a milestone in establishing a permanent international court. A series of 13 trials were carried out in Nuremberg, Germany, after the Second World War to bring Nazi war criminals to justice. The defendants — among them Nazi Party officials and high-ranking military officers, German industrialists, lawyers, and doctors — were indicted on charges of crimes against peace and crimes against humanity. One of the first times anyone had been prosecuted for crimes against humanity, the Nuremberg trials were controversial at the time. Another landmark trial around the same time — known as the Tokyo Trial or the Tokyo War Crimes Tribunal and, formally, as the International Military Tribunal for the Far East — tried and convicted leaders of the Empire of Japan for joint conspiracy to start and wage war, conventional war crimes, and crimes against humanity. 

A treaty to prosecute those accused of serious crimes internationally was proposed before a diplomatic conference in Rome, Italy, on July 17, 1998, in front of the United Nations. Adopted as the Rome Statute by 120 states, this treaty led to the establishment of the International Criminal Court (ICC) in 2002. The ICC is a permanent court that that can investigate and prosecute people suspected of committing genocide, crimes against humanity, war crimes and (since 2018) the crime of aggression in situations where national authorities are unable or unwilling to act genuinely. The ICC cannot, however, replace national courts. At a review Conference of the Rome Statute held in Kampala (Uganda) in 2010, the Assembly of State Parties decided to celebrate the day they adopted the treaty — June 17 — as the World Day for International Justice.

Parliamentarians Worldwide to Advance Global Criminal Justice and Support for the ICC

New York/The Hague

The International Justice Day on 17 July 2022 - commemorating the 24th anniversary of the adoption of the Rome Statute of the International Criminal Court (ICC) - is an important reminder to celebrate the creation of the first permanent international court delivering justice for victims of genocide, crimes against humanity, war crimes, and the crime of aggression. While over the course of the last decades we have seen challenges to the international order and the Rule of Law in unprecedented ways, it is of the utmost importance, today more than ever, to emphasize the ICC’s pivotal role in the prevention of atrocities, the fight against impunity, the support for victims’ rights, and the guarantee of long-lasting justice.

On International Justice Day, we mark not only the 8th year since the tragic downing of the Malaysia Airlines flight MH17 over the territory of Ukraine, but we are also being reminded that atrocities of such, and even worse, magnitude are happening every day. The heart-breaking personal tragedies occur not only in the context of the aggressive war launched by Russia in Ukraine this February but also in at least 27 countries worldwide that are experiencing conflicts or severe man-made crises, with over 2 billion people currently living in conflict-affected areas . Leaders or architects of the gravest crimes must be held accountable for their acts, and justice must be delivered. PGA will therefore continue to fight against impunity with parliamentarians, civil society organizations, experts, state representatives, and other stakeholders to remind States that human dignity, justice, accountability, and the fight against impunity is a global imperative for all. Despite numerous obstacles, parliamentarians worldwide have contributed - and continue to do so - to the global support given to the ICC by promoting and facilitating the ratification of the Rome Statute and implementing it in countries’ national systems.

Over the past months, progress has been made to advance the fight against impunity globally. Yet, the war of aggression initiated by the Russian Federation against Ukraine on the 24th of February - the impact of which has had grave ramifications all over the world - and the ongoing, egregious crimes being committed in other regions worldwide continue to remind us of the fragility of the international system. The international community must unite against threats to peace, inequality, human rights violations, and democratic backsliding. In such a complex context, it is critical to stress that Parliamentarians at the local, national, regional, and international levels have the power to reinforce international cooperation and to participate in this fight for global accountability.

This year’s International Justice Day, my biggest wish is for justice to be rendered for all the victims of the genocidal Russian war against Ukraine that continues since Russia’s invasion into Crimea and Donbas in 2014. Just this past week, Russian missile attacks on civilian infrastructure have resulted in hundreds of casualties, including children: residential building in Chasiv Yar, office space and hospital in Vinnytsia, and two universities in Mykolayiv were the targets. Ukrainian law enforcement agencies are tirelessly dealing with Russian atrocities in cooperation with the ICC. We are grateful to those uniting to support us, and to ICC States Parties who want to prosecute the alleged perpetrators of international crimes committed against Ukrainians. Together, we should stop Russia from deliberately destroying Ukraine, and punish those who gave and executed orders to torture, rape, and kill our people. At a time in which the international legal order is under threat, and collective initiatives are emerging in the name of justice and accountability, PGA will continue to stand ready, together with its members, to champion a universal culture of upholding the Rule of Law, human rights and fundamental freedoms by promoting accountability and justice. Today, we call on the leadership of Members of Parliaments to join this global effort . As demonstrated by the achievements of PGA members up to date - contributing to 78 ratifications and 37 implementing legislation packages - legislators can make a difference by ensuring that their governments not only promote the universality and effectiveness of the Rome Statute of the ICC but also implement its provisions through strong and comprehensive national laws that will enhance the complementarity system.

The path towards justice has been long in the Central African Republic. But with the opening of the first trials of the Special Criminal Court last April, some relief can finally be brought to survivors and victims of atrocities. On the International Justice Day, it is important to remember that justice is made to ensure equality, fairness, and sustainable peace. In fighting against impunity, it is essential that governmental institutions, in cooperation with Members of Parliaments, do everything in their power to ensure the effectiveness of the Rome Statute system. Combating impunity, securing victim’s rights to truth, justice, reparations, and guarantees of non-recurrence, and achieving peace, stability, and the well-being of our world cannot wait. Hon. PGA’s upcoming 12th Session of the Consultative Assembly of Parliamentarians on the International Criminal Court and the Rule of Law (CAP-ICC) , to be held in Buenos Aires, Argentina, on 4-5 November 2022, will serve as yet another opportunity to reaffirm our unanimous commitment to the “never again” principle, to commemorate the strides that have been made toward closing the impunity gap worldwide, and make new pledges to bolster global criminal justice.

Proposal to Amend Article 15bis of the Rome Statute on the Crime of Aggression

Since March 2022, after consulting a group of prominent academic experts, PGA elaborated a non-paper containing specific amendments to Article 15bis of the Rome Statute that would partially align the ICC jurisdictional regime on the crime of aggression to the one that already exists for the other three core crimes.

Such proposed amendments, if adopted by the 43 States Parties to the Rome Statute that ratified the Kampala amendments, would be applicable from 17 July 2018 and would be binding for these 43 States, which have the right to exceptionally invoke Art. 58 of the Vienna Convention on the Law of Treaties to ensure their immediate entry into force in order to realign the ICC jurisdictional regime on the crime of aggression to the object and purpose of the Statute itself, namely, to put an end to impunity for all the four core crimes under International Law. The PGA non-paper has been shared with the EU Member States and other concerned States that referred the situation in Ukraine to the ICC Prosecutor under Article 13(a) of the Rome Statute.

To ensure that the proposal would be considered and, as appropriate, adopted by the Assembly of States Parties to be held in The Hague on 5-10 December 2022, the proposal for amendments must be presented by one or more State(s) Parties to the Rome Statute and circulated by the UN Secretary-General as a depository of the treaty as soon as possible, not later than the end of August 2022.

Impunity for the crime of aggression was effectively fought after World War II when the International Community created an International Military Tribunal at Nuremberg in 1945 to adjudicate the main perpetrators of the Axis Powers that carried out the war of aggression. The time has come for the International Community to do the same in the face of the war of aggression against Ukraine, being executed by a Permanent Member of the UN Security Council that has so far been able to secure an “impunity-zone” for its leaders, as it has already done in respect of mass atrocities committed in Syria. 1

PGA strongly believes that the Assembly of States Parties, consisting of 123 Member States and the International Community, must ensure an appropriate level of political support, cooperation and financing for the ICC, which is competent for the investigation, prosecution, and adjudication of the most serious crimes of concern to the International Community as a whole. When the States Parties fulfill their responsibility as the Executive and Legislative branches within the Rome Statute system’s institutional design, the ICC judicial and prosecutorial organs will be able to maximize their impact and effectively serve as catalysts for domestic justice systems to counter and reduce impunity.

By enforcing the ICC’s mandate as a court of last resort capable of initiating and leading proceedings against those bearing the greatest responsibility over the four international crimes 2 , States can strive to achieve a better, more just, and more peaceful world.

1 The Russian Federation used its veto at least 15 times to block any meaningful decision within the UN Security Council to restore international peace and security in Syria. In May 2014, the Russian Federation and the People’s Republic of China vetoed a specific resolution referring the Syrian situation to the jurisdiction of the ICC that 13 States, including the USA, had supported. In June 2014, ISIS/ISIL/IS invaded Iraq and occupied the city of Mosul without finding any resistance or opposition from the Syrian army and its military allies, the Russian Federation, and the Islamic Republic of Iran. Since then, no international tribunal has territorial jurisdiction over Syria, the leader of ISIS has been executed, and the leaders of Syria, the Russian Federation, and Iran have continued to operate in an “impunity zone.”

The failure to fight impunity sets a precedent that can incentivize the perpetration of atrocities in other situations and the repetition of other heinous crimes in the same situation. Therefore, the fight against impunity is an absolute imperative for deterrence in all situations (general prevention) and for prevention in a specific case to halt the repetition of international crimes, which contributes to maintaining and restoring international peace and security.

2 When the UN Security Council established the two ad hoc Tribunals for the former Yugoslavia and Rwanda in 1993 and 1994, respectively, it took note of the fact that relevant atrocities were taking place within the framework of internal conflicts and the disintegration or collapse of centralized States, hence not requiring the activation of jurisdiction on crimes against the peace/crime of aggression. Thus, the two ad hoc Tribunals’ Statutes were limited to three core crimes under International Law, namely genocide, crimes against humanity, and war crimes. However, all the preparatory documents relating to the establishment of a permanent International Criminal Court since the 1950s have always reflected the list of the four core crimes under International Law, including the crime of aggression, which is essentially reproducing the notion of crimes against the peace contained in the London Agreement for the Nuremberg Tribunal, which the UN General Assembly affirmed as reflecting principles and norms of customary international law in 1946.

What is the International Criminal Court?

The International Criminal Court, or ICC, investigates and, where warranted, tries individuals charged with the gravest crimes of concern to the international community: genocide, war crimes, crimes against humanity and the crime of aggression. As a court of last resort, it seeks to complement, not replace, national courts.

Statement on the World Day for International Justice, 2021

Tomorrow, 17 July, marks the World Day for International Justice. In celebration of this day, the Global Centre for the Responsibility to Protect commends the enduring commitment of various states, multilateral institutions and civil society to upholding their responsibility to protect by pursuing justice for genocide, war crimes and crimes against humanity. This annual commemoration is an important moment to acknowledge achievements made in fighting impunity and to raise awareness about the challenges that remain.

The past year saw two landmark legal cases. On 4 February the Trial Chamber of the International Criminal Court (ICC) found former Lord’s Resistance Army commander Dominic Ongwen guilty of 61 counts of crimes against humanity and war crimes committed in northern Uganda between 1 July 2002 and 31 December 2005. This case marked the first time the ICC considered the offences of forced pregnancy and forced marriage as war crimes, contributing to the development of international jurisprudence.

On 8 June the Appeals Chamber of the International Residual Mechanism for Criminal Tribunals confirmed the November 2017 conviction of Ratko Mladić , the former Commander of the Bosnian Serb Army, who was found guilty of genocide, war crimes and crimes against humanity. Mladić was one of the most notorious atrocity perpetrators of the wars in the former Yugoslavia during the 1990s and was a fugitive from justice for more than a decade.

We have also seen significant advances in applying the principle of universal jurisdiction, whereby perpetrators of grave international crimes can be prosecuted domestically irrespective of the citizenship of the perpetrators or victims, or where the crimes were committed. For example, on 22 February the Koblenz Higher Regional Court in Germany sentenced Eyad al-Gharib for aiding and abetting 30 cases of crimes against humanity in Syria . This historic case was the world’s first criminal trial addressing torture perpetrated by Syrian state officials since the conflict began in 2011.

Over the past year, both the Netherlands and Canada have also initiated proceedings under the UN Convention against Torture in an attempt to hold the Syrian government accountable for its widespread and systematic use of torture. Such cases demonstrate that even in situations where the UN Security Council is divided and incapable of responding appropriately to ongoing atrocities, individual states can still uphold international law and their responsibility to protect.

The Global Centre for the Responsibility to Protect would also like to acknowledge the retirement of ICC Chief Prosecutor Fatou Bensouda, whose exemplary leadership over the past nine years put victims and survivors at the center of the Court’s work. We warmly welcome Karim Khan as the new Chief Prosecutor and look forward to working with him in his new role.

Despite progress over the past year, civilians who continue to face atrocities in Myanmar , South Sudan , Tigray ( Ethiopia ), Yemen and elsewhere are still waiting for their day in court. On this day we reiterate our commitment to ensuring that all victims and survivors of genocide, war crimes and crimes against humanity receive the recognition and justice they deserve.

Advancing social justice

Social justice at the centre of international, national and regional policy agendas.

Momentum is growing for the concept that advancing social justice should be the central aim guiding all national and international policies. This idea has gained traction among proponents who argue it enables societies and economies to function more cohesively when social justice is prioritized.

Supporters contend that promoting decent work and a fair globalization agenda focused on fundamental rights , employment opportunities, social protections, and constructive social dialogue between governments, employers, and workers is key to putting social justice at the core.

However, advocates point out the persisting grave injustices, widespread labor insecurity, high inequality, and unraveling social contracts exacerbated by global crises. These harsh realities threaten progress made on social issues. Reinforcing institutions and policies that truly advance social justice is seen as an urgent priority.

Proposals to advance social justice include improving inclusive and effective governance of work, ensuring employment opportunities and lifelong learning, reforming institutions for fairer labor market outcomes, and extending social protections across peoples' lifetimes. An integrated approach across all these areas is touted.

Support is growing for creating a wide-reaching Global Coalition for Social Justice. The proposed coalition would aim to bolster multilateral cooperation and aligned policies focused on furthering social justice aims. It could highlight impactful initiatives that have successfully advanced social justice worldwide. The coalition would also empower constructive national social dialogues to identify and address social justice gaps. Overall, there are calls urging coordinated efforts to make advancing social justice a top policy priority across all levels.

The International Labour Organization ( ILO ) unanimously adopted the ILO Declaration on Social Justice for a Fair Globalization on 10 June 2008. This is the third major statement of principles and policies adopted by the International Labour Conference since the ILO’s Constitution of 1919. It builds on the Philadelphia Declaration of 1944 and the Declaration on Fundamental Principles and Rights at Work of 1998 . The 2008 Declaration expresses the contemporary vision of the ILO’s mandate in the era of globalization.

This landmark Declaration is a powerful reaffirmation of ILO values. It is the outcome of tripartite consultations that started in the wake of the Report of the World Commission on the Social Dimension of Globalization . By adopting this text, the representatives of governments, employers’ and workers’ organizations from 182 member States emphasize the key role of our tripartite Organization in helping to achieve progress and social justice in the context of globalization. Together, they commit to enhance the ILO’s capacity to advance these goals, through the Decent Work Agenda . The Declaration institutionalizes the Decent Work concept developed by the ILO since 1999, placing it at the core of the Organization’s policies to reach its constitutional objectives.

The Declaration comes at a crucial political moment, reflecting the wide consensus on the need for a strong social dimension to globalization in achieving improved and fair outcomes for all. It constitutes a compass for the promotion of a fair globalization based on decent work, as well as a practical tool to accelerate progress in the implementation of the Decent Work Agenda at the country level. It also reflects a productive outlook by highlighting the importance of sustainable enterprises in creating greater employment and income opportunities for all.

The General Assembly recognizes that social development and social justice are indispensable for the achievement and maintenance of peace and security within and among nations and that, in turn, social development and social justice cannot be attained in the absence of peace and security, or in the absence of respect for all human rights and fundamental freedoms.

It further recognizes that globalization and interdependence are opening new opportunities through trade, investment and capital flows and advances in technology, including information technology, for the growth of the world economy and the development and improvement of living standards around the world, while at the same time there remain serious challenges, including serious financial crises, insecurity , poverty , exclusion and inequality within and among societies, and considerable obstacles to further integration and full participation in the global economy for developing countries, as well as some countries with economies in transition.

On 26 November 2007, the General Assembly declared that, starting from the sixty-third session of the General Assembly , 20 February will be celebrated annually as the World Day of Social Justice.

हर साल World Day for International Justice in Hindi एक निर्धारित थीम के तहत मनाया जाता है। साल 2023 की विश्व अंतरराष्ट्रीय न्याय दिवस की थीम “ सामाजिक न्याय के लिए बाधाओं पर काबू पाना और अवसरों को उजागर करना ” है। 

world day for international justice in hindi रोम संविधि के ऐतिहासिक अधिग्रहण और 1998 में अंतरराष्ट्रीय आपराधिक न्याय प्रणाली की शुरुआत को चिह्नित करने के लिए मनाया जाता है। इस दिन का उद्देश्य पीड़ितों के अधिकारों को बढ़ावा देने और उनके न्याय का समर्थन करने के लिए सभी को एकजुट करना है। यह दिन मौलिक मानवाधिकारों की वकालत और अंतरराष्ट्रीय आपराधिक न्याय को बढ़ावा देने पर केंद्रित है।

17 जुलाई 1998 को, 120 देश अंतरराष्ट्रीय आपराधिक न्यायालय के रोम संविधि नामक एक संधि पर हस्ताक्षर करने के लिए एक साथ आए। इस स्थापना को अंतरराष्ट्रीय आपराधिक न्यायालय (आईसीसी) के रूप में जाना जाने लगा , जो 1 जुलाई 2002 को अस्तित्व में आया। रोम संविधि पर हस्ताक्षर करने का जश्न मनाने के लिए, तब से हर साल अंतरराष्ट्रीय न्याय के लिए विश्व दिवस मनाया जाता है।

अंतरराष्ट्रीय न्याय के लिए विश्व दिवस का उद्देश्य आईसीसी के प्रयासों की सराहना करना और अंतरराष्ट्रीय अपराधों के पीड़ितों के लिए न्याय को बढ़ावा देने में सभी को एकजुट करना है। आईसीसी ने मुख्य रूप से मानवता के खिलाफ अपराध (नष्ट करना, हत्या, आदि), नरसंहार (जानबूझकर एक समुदाय को नुकसान पहुंचाना), युद्ध अपराध (जानबूझकर पीड़ा, यातना देना, आदि), और आक्रामकता के अपराध (सैन्य कब्ज़ा, कब्ज़ा, आदि) पर ध्यान केंद्रित किया। ) 

इस मौके पर दुनिया भर में जागरुकता अभियान चलाए जाते हैं। इसमें विभिन्न मीडिया जैसे समाचार चैनल, अखबार रेडियो, और इंटरनेट के माध्यमों का उपयोग किया जाता है। बहुत से संगठन समूह किसी खास तरह के मुद्दे जैसे युद्ध पीड़ितों को न्याय, अंतरराष्ट्रीय सीमा विवाद आदि पर जागरुकता अभियान चलाते हैं। इसके अलावा लोग ब्लॉग लेखों के जरिए अपने क्षेत्र की अंतरराष्ट्रीय न्याय संबंधी समस्या पर लेख लिख कर जागरुकता फैलाने का काम भी करते हैं। 

दरअसल 17 जुलाई 1988 को दुनिया के कई देशों ने अंतरराष्ट्रीय अपराध न्यायालय की व्यवस्था के लिए एकजुट होकर समझौता किया था। इसे रोम स्टेट्यूट कहा जाता है। वर्तमान में दुनिया के 139 देश इस समझौते का हिस्सा बन चुके हैं। इसलिए यह दिवस 17 जुलाई के दिन ही मनाया जाता है। 

अंतरराष्ट्रीय आपराधिक न्यायालय यानि ICJ (International Court of Justice) की स्थापना तब हुई जब 120 राज्यों ने रोम में एक क़ानून अपनाया। इसे अंतरराष्ट्रीय आपराधिक न्यायालय के रोम क़ानून (“रोम कद”) के रूप में जाना जाता था। वे सभी देश जो क़ानून को अपनाने के लिए सहमत हुए थे, वे बहुत गंभीर अपराधों के अभियोजन के संबंध में आईसीसी के अधिकार क्षेत्र को स्वीकार कर रहे थे। आईसीसी का विचार राष्ट्रीय अदालतों को बदलने का नहीं था। यह केवल तभी हस्तक्षेप करने में सक्षम है जब कोई देश जांच नहीं कर सकता है या अपराधियों पर मुकदमा नहीं चला सकता है।

ICC एक स्थाई और स्वतंत्र अंतरराष्ट्रीय न्यायिक ऑर्गेनाइजेशन है, जो अंतरराष्ट्रीय मानवीय और मानव अधिकारों के सबसे गंभीर उल्लंघन के आरोपियों की कोशिश करने में सक्षम है। जिसमें नरसंहार का अपराध, अपराधों का युद्ध और मानवता के खिलाफ अपराध शामिल हैं। 

अंतरराष्ट्रीय आपराधिक न्यायलय का गठन शांति और कानून के शासन की स्थापना के उद्देश्य से किया गया था। हांलांकि यह राष्ट्रीय न्याय प्रणाली का स्थान नहीं लेता। इस न्यायलय की संधि पर 139 देशों द्वारा हस्ताक्षर किए गए। 

अंतरराष्ट्रीय न्यायालय संयुक्त राष्ट्र का एक महत्वपूर्ण न्यायिक अंग है। अंतरराष्ट्रीय न्यायालय की स्थापना 1945 में हॉलैंड के शहर हेग में हुई थी। इसके बाद 1946 में इसने अपने काम शुरू कर दिए था। अंतरराष्ट्रीय न्यायालय के अनुसार इसका काम कानूनी विवादों का निपटारा करना है। साथ ही संयुक्त राष्ट्र अंगों और विशेष एजेंसियों द्वारा उठाए कानूनी प्रश्नों पर राय देना है। आपको बता दें कि अंतरराष्ट्रीय न्यायालय की आधिकारिक भाषा अंग्रेजी और फ्रेंच है। 

यह नीदरलैंड के हेग में स्थित है।

इसकी स्थापना 1 जुलाई 2002 में हुई थी।
