In this chapter, we discuss Bell’s (1980) interest convergence, a key concept in critical race theory,1 as a useful analytic and strategic tool to analyze, critique, make sense of, and reform sites in teacher education that we argue should be studied and interrogated to improve policies and practices in the field. The tenet “interest convergence” originated with the work of Derrick Bell (1980), who argued that the Brown v. Board of Education (1954) decision, in which the Supreme Court outlawed de jure segregation of public schools, was not the result of a moral breakthrough of the high court but rather a decision that was necessary: (1) to advance American Cold War objectives in which the United States was competing with the Soviet Union for loyalties in the third world; (2) to quell the threat of domestic disruption that was a legitimate concern with Black veterans, who now saw continued discrimination as a direct affront to their service during WWII; and (3) to facilitate desegregation in the South, which was now viewed as a barrier to the economic development of the region. In other words, the interests of Black civil rights coincided for a brief time with the interests of White elites, thus enabling a decision that benefited the interests of Black people. In Bell’s (1980) words, “the interests of Blacks in achieving racial equality will be accommodated only when it converges with the interests of Whites”

Brown v. Board of Education and the Interest-Convergence Dilemma

In this article, Bell outlines the concept of interest convergence, an idea that has since become vital to Critical Race Theory, through an analysis of the Brown v. Board of Education decision. Interest convergence has proven to be a useful tool in understanding how historical racial reforms are achieved. Here, Bell argues that, though popular discourses of American history present the Brown decision as motivated by moral and political convictions, it can be better understood as a result of intersecting practical considerations. Bell compares the circumstances of the case to similar preceding cases challenging school segregation. In those previous instances, the courts ruled not to end segregation in schooling, but to improve the standards of segregated schooling, to meet the standards of the “separate but equal” doctrine. What, Bell asks, makes Brown different? Interest convergence answers this question.

The outcome of Brown v. Board of Education was the result of a convergence of racial interests with a number of interests for the dominant class, domestically and abroad. Agitation was growing within the Black American population, many of whom had contributed to the nation’s success in World War II, and many of whom were increasingly dissatisfied with a continued lack of progress in racial reform. The dominant class faced a threat of civil unrest; more importantly, they risked the growth of communist sympathies within the United States. Abroad, claims of political freedom from the US, contrasted with continued segregation, threatened America’s international reputation, a particularly valuable resource given the ongoing Cold War with the USSR. Finally, as the post-war economy was booming, segregation (like enslavement before it) stood in the way of urbanization and industrialization, in the South in particular. As a result of the intersection of these social, political, and economic interests, it became more costly for the dominant class to maintain segregation than it would be to gradually abolish it.

Applied to other historical instances of racial reform, interest convergence is similarly useful. What, for example, could an application of interest convergence explain about the Emancipation Proclamation, the Fourteenth Amendment, or even the success of Barrack Obama’s 2008 presidential campaign? Moreover, interest convergence is valuable as a tool through which to imagine how contemporary and future movements towards Black liberation may find success. While interest convergence theory emphasizes the agency of the dominant class in the movements of history, it also emphasizes the ways in which the agency of marginalized classes can bring about change. The threat of social unrest, or even insurrection, can impact the cost-benefit analysis employed by the dominant class; at times, this impact is enough to precipitate meaningful reform.

Paying attention to the changing interests and circumstances of the dominant class can be a legitimate strategy for Black liberation movements, as tracking these changes, like tracking the weather, might be informative concerning when particular political strategies may be the most effective. As Bell notes, “Further progress to fulfill the mandate of Brown is possible to the extent that the divergence of racial interests can be avoided or minimized” (Bell 528). If the actions of liberatory movements can take advantage of moments of convergence, as well as divergence, the political landscape of the United States could be strategically altered, reformed, or, even, radically reimagined.

(Point of clarification: when I note that interest convergence can be usefully applied in pursuit of liberation, I am not arguing for making appeals to white moderates, or for tactics of respectability and collaboration regarding dominant political classes. What I am trying to argue is that the actions of radical movements can change the cost-benefit analysis that the dominant class engages in, in pursuit of its interests. For example, the outcome of  Brown was meaningfully influenced by the threat of domestic unrest. Likewise, the Haitian Revolution succeeded in part because the acts of revolutionaries made it too costly for France or any other imperial power to try to directly reassert enslavement on the Haitian people.)

Gabriel, I liked your point about the importance of interest convergence and divergence. I was also wondering about this likelihood, especially with the tensions between political parties and the growing popularity of politicians like Donald Trump and Ron DeSantis. I was thinking about what they would say if you suggested that interest convergence is a tool they could use to help with Black liberation and allow marginalized classes to create change and have change happen to them. That’s super important about this class, but it’s also a little disheartening how Critical Race Theory is treated in the U.S. and how few people know what it means. A big takeaway from the article was that the primary goal is to create effective schools for black children. I was interested in learning this in ProfSi’s ‘Money Politics and Prison class last semester. It is how the school system’s discrimination and marginalization of students of color directly impact the Prison Industrial Complex, and I think the article does an excellent job of reinforcing the importance of good schooling and school systems like successful magnet schools, for example. I’m from Baltimore City, and I have seen the direct impacts of states/governments letting students and communities down when it comes to educating the young.

I really like how you not only summarized some of the key points in the reading but you also highlighted why they are important. I liked how you mention using the demands of the dominant class to help with black liberation. I also believe this tactic is crucial because we can get people to see that we are not so different from each other, not just in race but in class too. By utilizing this tactic, black people may find that their initiatives are followed by more support. The article mentions how because of Brown’s decision, a large majority of the white population thought they would lose their influence or power (pg 35 and 37). The “interest-convergence” comes into play when the white families leave their schools to attend these newly created private ones. Black students not only get a proper funded education but the white families can either keep attending school or attend a private one.

I will say that Brown v. Board is an interesting case for a couple of points. First, by targeting education as the point of interest, it allows black people to delve into multiple other areas. For example housing is closely related to schooling and they wanted this case to eventually start to leak into that area as well. But justice moves slowly and one step at a time. What the black population needed was to first end Plessy v. Ferguson. By overturning this case first, “separate but equal” was considered unconstitutional. Although Brown was very significant, there’s other cases that played a more important role such as Bradley v. Richmond or Green v. New Kent County (this threatened schools to cooperate or federal funding will stop from HEW). It goes back to what they first needed to accomplish and that was ending separate but equal. It forced schools to desegregate but there was barely any push for integration. The actual text from Brown v. Board was how schools should “desegregate with all deliberate speed”. This is problematic because it allows schools to move on their own account. As we know, this made schools follow through very late after the decision. What it comes down to is being a resource problem. It’s not about morality right or wrong, changes were made due to resources. This is where interest-convergence comes into play.

Derrick Bell’s analysis of the Brown v. Board of Education decision reveals how the interests of different groups, particularly Black Americans and the dominant class, intersected strategically. The fear of civil unrest, potential communist sympathies, and the international reputation of the U.S. during the Cold War made segregation costly for the dominant class.

This convergence of interests played a role in the decision to end school segregation. Bell suggests that grasping the interests of those in power can guide Black liberation movements. It’s not about trying to please those in charge but using their interests to advocate for what’s right.

However, while the idea of interests aligning can be useful, it raises a concern. Progress might seem real, but there’s a risk it could resemble the deceptive “separate but equal” era. This cautionary note questions whether advancements in racial equality are genuine or just symbolic, echoing worries from the Plessy v. Ferguson era. The reminder that interest convergence doesn’t always guarantee true equality serves as a critical lens to scrutinize societal changes. It prompts us to be wary of situations where progress might be more appearance than reality. In essence, Bell’s insights emphasize the need for a careful and critical approach to assessing the genuineness of advancements in the fight for racial equality.

Critical race theory (CRT) has played an increasingly important role in exploring the centrality of race and racism in multiple scholarly arenas. CRT scholarship emerged in response to frustrations with the liberal rhetoric of the law as a mechanism for social change through the work of scholars such as Derrick Bell, Richard Delgado, Kimberlé Crenshaw, Mari Matsuda, Neil Gotanda, and others. As an outgrowth of the critical legal studies movement—an area of legal scholarship popularized in the 1970s that privileges economic and neo-Marxist understandings of structural barriers to equality—these early CRT scholars recognized that social, legal, and juridical apparatuses work in the interest of the dominant class and, therefore, serve to maintain existing social relations along racial and class lines. As CRT evolved and matured into a host of spin-off movements, for example, LatCrit, TribalCrit, QueerCrit, and Asian American Legal Jurisprudence, it eventually crossed over into education in the mid-1990s. Education scholars who write from a CRT perspective pay homage to its legal underpinnings, but they have also added new ideas and thinking from sociology, anthropology, and qualitative research methodology. Like their predecessors in the legal arena, education scholars who employ CRT view racism as a permanent fixture of American society. In addition, CRT scholars in education fundamentally critique the liberal discourse that underpins contemporary thinking in education: that society is neutral, the law is colorblind, and that “formal” apparatuses (social, legal, political, economic, and educational) exist to protect and ensure the inalienable rights and liberties of all citizens. CRT scholars also employ the concept of “interest convergence” (see also Bell 1980 , cited under Key Law Review Articles and Related Legal Scholarship ), which is the belief that white people will tolerate and advance the interests of people of color only when those advancements promote the self-interests of whites. Moreover, CRT scholars understand the importance of naming one’s own reality and telling one’s own story, a concept popularly referred to as counterstorytelling. CRT scholars also recognize the importance of intersecting identities, which posits that the range of racialized experiences of people of color are varied, multiple and factorally complex. In short, education scholars who employ a CRT lens utilize these and other foundational principles as points of departure, and they apply them to their analysis of educational structures, policies, and processes, including, but not limited to, instruction, curriculum, leadership, teaching, school finance, school law, student voice, school-community relations, student assessment, evaluation, and educational policy. Helping to promote research and scholarship in CRT are a host of academic research centers, such as the Centre for Research in Race and Education (University of Birmingham), Center for Critical Race Studies (UCLA School of Law), Center for the Study of Race and Equity in Education (University of Pennsylvania), and the Centre for Critical Education Policy Studies (University of London).

Journal Articles

The forty-three journal articles in this section represent the breadth of scholarship in critical race theory in education. This section includes scholarship by some of the most recognized names that have published in this area (e.g., Gloria Ladson-Billings, Danny Solórzano, and William Tate), as well as a newer crop of CRT scholars (e.g., Enrique Aleman, Muhammad Khalifa, and Theodora Berry) who have picked up the proverbial mantle and have applied CRT in new and exciting ways in their own work. This section is divided into the following six subsections: Foundational Articles , Exploring Methodological and Epistemological Issues , Interrogating Educational Policies and Practices , Exploring Whiteness , Critically Analyzing Teaching and Learning Processes , and Examining Racism Along the P-20 Pipeline . The Man Behind Critical Race Theory

The town of Harmony, Mississippi, which owes its origins to a small number of formerly enslaved Black people who bought land from former slaveholders after the Civil War, is nestled in Leake County, a perfectly square allotment in the center of the state. According to local lore, Harmony, which was previously called Galilee, was renamed in the early nineteen-twenties, after a Black resident who had contributed money to help build the town’s school said, upon its completion, “Now let us live and work in harmony.” This story perhaps explains why, nearly four decades later, when a white school board closed the school, it was interpreted as an attack on the heart of the Black community. The school was one of five thousand public schools for Black children in the South that the philanthropist Julius Rosenwald funded, beginning in 1912. Rosenwald’s foundation provided the seed money, and community members constructed the building themselves by hand. By the sixties, many of the structures were decrepit, a reflection of the South’s ongoing disregard for Black education. Nonetheless, the Harmony school provided its students a good education and was a point of pride in the community, which wanted it to remain open. In 1961, the battle sparked the founding of the local chapter of the N.A.A.C.P.

That year, Winson Hudson, the chapter’s vice-president, working with local Black families, contacted various people in the civil-rights movement, and eventually spoke to Derrick Bell, a young attorney with the N.A.A.C.P. Legal Defense and Educational Fund, in New York City. Bell later wrote, in the foreword to Hudson’s memoir, “Mississippi Harmony,” that his colleagues had been astonished to learn that her purpose was to reopen the Rosenwald school. He said he told her, “Our crusade was not to save segregated schools, but to eliminate them.” He added that, if people in Harmony were interested in enforcing integration, the L.D.F., as it is known, could help.

Hudson eventually accepted Bell’s offer, and in 1964 the L.D.F. won Hudson v. Leake County School Board (Winson Hudson’s school-age niece Diane was the plaintiff), which mandated that the board comply with desegregation. Harmony’s students were enrolled in a white school in the county. Afterward, though, Bell began to question the efficacy of both the case and the drive for integration. Throughout the South, such rulings sparked white flight from the public schools and the creation of private “segregation academies,” which meant that Black students still attended institutions that were effectively separate. Years later, after Hudson’s victory had become part of civil-rights history, she and Bell met at a conference and he told her, “I wonder whether I gave you the right advice.” Hudson replied that she did, too.

Bell spent the second half of his career as an academic and, over time, he came to recognize that other decisions in landmark civil-rights cases were of limited practical impact. He drew an unsettling conclusion: racism is so deeply rooted in the makeup of American society that it has been able to reassert itself after each successive wave of reform aimed at eliminating it. Racism, he began to argue, is permanent. His ideas proved foundational to a body of thought that, in the nineteen-eighties, came to be known as critical race theory. After more than a quarter of a century, there is an extensive academic field of literature cataloguing C.R.T.’s insights into the contradictions of antidiscrimination law and the complexities of legal advocacy for social justice.

For the past several months, however, conservatives have been waging war on a wide-ranging set of claims that they wrongly ascribe to critical race theory, while barely mentioning the body of scholarship behind it or even Bell’s name. As Christopher F. Rufo, an activist who launched the recent crusade, said on Twitter, the goal from the start was to distort the idea into an absurdist touchstone. “We have successfully frozen their brand—‘critical race theory’—into the public conversation and are steadily driving up negative perceptions. We will eventually turn it toxic, as we put all of the various cultural insanities under that brand category,” he wrote. Accordingly, C.R.T. has been defined as Black-supremacist racism, false history, and the terrible apotheosis of wokeness. Patricia Williams, one of the key scholars of the C.R.T. canon, refers to the ongoing mischaracterization as “definitional theft.”

Vinay Harpalani, a law professor at the University of New Mexico, who took a constitutional-law class that Bell taught at New York University in 2008, remembers his creating a climate of intellectual tolerance. “There were conservative white male students who got along very well with Professor Bell, because he respected their opinion,” Harpalani told me. “The irony of the conservative attack is that he was more respectful of conservative students and giving conservatives a voice than anyone.” Sarah Lustbader, a public defender based in New York City who was a teaching assistant for Bell’s constitutional-law class in 2010, has a similar recollection. “When people fear critical race theory, it stems from this idea that their children will be indoctrinated somehow. But Bell’s class was the least indoctrinated class I took in law school,” she said. “We got the most freedom in that class to reach our own conclusions without judgment, as long as they were good-faith arguments and well argued and reasonable.”

Republican lawmakers, however, have been swift to take advantage of the controversy. In June, Governor Greg Abbott, of Texas, signed a bill that restricts teaching about race in the state’s public schools. Oklahoma, Tennessee, Idaho, Iowa, New Hampshire, South Carolina, and Arizona have introduced similar legislation. But in all the outrage and reaction is an unwitting validation of the very arguments that Bell made. Last year, after the murder of George Floyd , Americans started confronting the genealogy of racism in this country in such large numbers that the moment was referred to as a reckoning. Bell, who died in 2011, at the age of eighty, would have been less focussed on the fact that white politicians responded to that reckoning by curtailing discussions of race in public schools than that they did so in conjunction with a larger effort to shore up the political structures that disadvantage African Americans. Another irony is that C.R.T. has become a fixation of conservatives despite the fact that some of its sharpest critiques were directed at the ultimate failings of liberalism, beginning with Bell’s own early involvement with one of its most heralded achievements.

In May, 1954, when the Supreme Court struck down legally mandated racial segregation in public schools, in Brown v. Board of Education of Topeka, the decision was instantly recognized as a watershed in the nation’s history. A legal team from the N.A.A.C.P. Legal Defense and Educational Fund, led by Thurgood Marshall, argued that segregation violated the equal-protection clause of the Fourteenth Amendment, by inflicting psychological harm on Black children. Chief Justice Earl Warren took the unusual step of persuading the other Justices to reach a consensus, so that their ruling would carry the weight of unanimity. In time, many came to see the decision as an opening salvo of the modern civil-rights movement, and it made Marshall one of the most recognizable lawyers in the country. His stewardship of the case was particularly inspiring to Derrick Bell, who was then a twenty-four-year-old Air Force officer and who had developed a keen interest in matters of equality.

Bell was born in 1930 in Pittsburgh’s Hill District, the community immortalized in August Wilson’s plays, and he attended Duquesne University before enlisting. After serving two years, he entered the University of Pittsburgh’s law school and, in 1957, was the only Black graduate in his class. He landed a job in the newly formed civil-rights division of the Department of Justice, but when his superiors became aware that he was a member of the N.A.A.C.P. they told him that the membership constituted a conflict of interest, and that he had to resign from the organization. In a move that would become a theme in his career, Bell quit his job rather than compromise a principle. He began working, instead, at the Pittsburgh N.A.A.C.P., where he met Marshall, who hired him in 1960 as a staff attorney at the Legal Defense Fund. The L.D.F. was the legal arm of the N.A.A.C.P. until 1957, when it spun off as a separate organization.

Bell arrived at a crucial moment in the L.D.F.’s history. In 1956, two years after Brown, it successfully litigated Browder v. Gayle, the case that struck down segregation on city buses in Alabama—and handed Martin Luther King, Jr., and the Montgomery Improvement Association a victory in the yearlong boycott they had organized. The L.D.F. launched desegregation lawsuits across the South, and Bell supervised or handled many of them. But, when Winson Hudson contacted him, she opened a window onto the distance between the agenda of the national civil-rights organizations and the priorities of the local communities they were charged with serving. In her memoir, she recalled a contentious exchange she had, before she contacted Bell, with a white representative of the school board. She told him, “If you don’t bring the school back to Harmony, we will be going to your school.” Where the L.D.F. saw integration as the objective, Hudson saw it as leverage to be used in the fight to maintain a quality Black school in her community.

The Harmony school had already become a flashpoint. Medgar Evers, the Mississippi field secretary for the N.A.A.C.P., visited the town and assisted in organizing the local chapter. He told members that the work they were embarking on could get them killed. Bell, during his trips to the state, made a point of not driving himself; he knew that a wrong turn on unfamiliar roads could have fatal consequences. He was arrested for using a whites-only phone booth in Jackson, and, upon his safe return to New York, Marshall mordantly joked that, if he got himself killed in Mississippi, the L.D.F. would use his funeral as a fund-raiser. The dangers, however, were very real. In June of 1963, a white supremacist shot and killed Evers in his driveway, in Jackson; he was thirty-seven years old. In subsequent years, there was an attempted firebombing of Hudson’s home and two bombings at the home of her sister, Dovie, who was Diane Hudson’s mother and was involved in the movement. That suffering and loss could not have eased Bell’s growing sense that his efforts had only helped create a more durable system of segregation.

Bell left the L.D.F. in 1966 for an academic career that took him first to the University of Southern California’s law school, where he directed the public-interest legal center, and then, in 1969, in the aftermath of King’s assassination, to Harvard Law School, as a lecturer. Derek Bok, the dean of the school, promised Bell that he would be “the first but not the last” of his Black hires. In 1971, Bok was made the president of the university, and Bell became Harvard Law’s first Black tenured professor. He began creating courses that explored the nexus of civil rights and the law—a departure from traditional pedagogy.

In 1970, he had published a casebook titled “ Race, Racism and American Law ,” a pioneering examination of the unifying themes in civil-rights litigation throughout American history. The book also contained the seeds of an idea that became a prominent element in his work: that racial progress had occurred mainly when it aligned with white interests—beginning with emancipation, which, he noted, came about as a prerequisite for saving the Union. Between 1954 and 1968, the civil-rights movement brought about changes that were thought of as a second Reconstruction. King’s death was a devastating loss, but hope persisted that a broader vista of possibilities for Black people and for the nation lay ahead. Yet, within a few years, as volatile conflicts over affirmative action and school busing arose, those victories began to look less like an antidote than like a treatment for an ailment whose worst symptoms can be temporarily alleviated but which cannot be cured. Bell was ahead of many others in reaching this conclusion. If the civil-rights movement had been a second Reconstruction, it was worth remembering that the first one had ended in the fiery purges of the so-called Redemption era, in which slavery, though abolished by the Thirteenth Amendment, was resurrected in new forms, such as sharecropping and convict leasing. Bell seemed to have found himself in a position akin to Thomas Paine’s: he’d been both a participant in a revolution and a witness to the events that revealed the limitations of its achievements.

Bell’s skepticism was deepened by the Supreme Court’s 1978 decision in Bakke v. University of California, which challenged affirmative action in higher education. Allan Bakke, a white prospective medical student, was twice rejected by U.C. Davis. He sued the regents of the University of California, arguing that he had been denied admission because of the school’s minority set-aside admissions, or quotas—and that affirmative action amounted to “reverse discrimination.” The Supreme Court ruled that race could be considered, among other factors, for admission, and that diversifying admissions was both a compelling interest and permissible under the Constitution, but that the University of California’s explicit quota system was not. Bakke was admitted to the school.

Bell saw in the decision the beginning of a new phase of challenges. Diversity is not the same as redress, he argued; it could provide the appearance of equality while leaving the underlying machinery of inequality untouched. He criticized the decision as evidence that the Court valorized a kind of default color blindness, as opposed to an intentional awareness of race and of the need to address historical wrongs. He likely would have seen the same principle at work in the 2013 Supreme Court ruling in Shelby County v. Holder, which gutted the Voting Rights Act.

In the years surrounding the Bakke case, Bell published two articles that were considered both brilliant and heretical. The first, “Serving Two Masters,” which appeared in March, 1976, in the Yale Law Journal , cited his own role in the Harmony case. He wrote that the mission of groups engaged in civil-rights litigation, such as the N.A.A.C.P., represented an inherent conflict of interest. The two masters of the title were the groups’ interests and those of their clients; what the groups wanted to achieve may not have aligned with what their clients wanted—or even needed. The concept of an inherent conflict was crucial to Bell’s understanding of how and why the movement had played out as it did: the heights it had attained had paradoxically shown how far there still was to go and how difficult it would be to get there. Imani Perry, a legal scholar and a professor of African American studies at Princeton, who knew Bell, told me how audacious it was at the time for Bell to “raise questions about his own role as an advocate and, perhaps, the way in which we structured civil-rights advocacy.”

Jack Greenberg, who served as the director-counsel of the L.D.F. from 1961 to 1984, depicted Bell in his memoir, “ Crusaders in the Courts ,” as a complex, frustrating figure, whose stringent criticism of the organization’s history and philosophy led to tensions in their own relationship. Yet Sherrilyn Ifill, the current president and director-counsel, told me that, despite some initial consternation in civil-rights circles, Bell’s perspective eventually found purchase even among those he had criticized. “I think most of us—especially those who long admired and were mentored by Bell—read his work as a cautionary tale for us as lawyers,” Ifill told me. Today, she said, L.D.F. attorneys teach Bell’s work to students in New York University’s Racial Equity Strategies Clinic.

Bell eventually formulated a broader criticism of the objectives of both the movement and its lawyers. The issue of busing was particularly complicated. Brown v. Board of Education centered on the circumstances of Linda Brown, an eight-year-old girl who lived in a mixed neighborhood in Topeka, Kansas, but was forced to travel nearly an hour to a Black school rather than attend one closer to her home, which, under the law, was reserved for white children. During the seventies, in an attempt to put integration into practice, school districts sent Black students to better-financed white schools. The presumption was that white parents and administrators would not underfund schools that Black children attended if white children were also students there. In effect, it was hoped that the valuation of whiteness would be turned against itself. But, in a reversal of Linda Brown’s situation, the white schools were generally farther away than the local schools the students would otherwise have gone to. So the remedy effectively imposed the same burden as had been imposed on Brown, albeit with the opposite intentions. Bell “was pessimistic about the effectiveness of busing, and at a time when a lot of people weren’t,” the scholar Patricia Williams told me.

More significant, Bell was growing doubtful about the prospect of ever achieving racial equality in the United States. The civil-rights movement had been based on the idea that the American system could be made to live up to the democratic creed prescribed in its founding documents. But Bell had begun to think that the system was working exactly as it was intended to—that that was why progress was invariably met with reversal. Indeed, by the eighties, it was increasingly clear that the momentum to desegregate schools had stalled; a 2006 study by the Civil Rights Project, at U.C.L.A., found that many of the advances made in the first years had been erased during the nineties, and that seventy-three per cent of Black students around that time attended schools in which most students were minorities.

In Bell’s second major article of this period, “Brown v. Board of Education and the Interest-Convergence Dilemma,” published in January of 1980 in the Harvard Law Review , he lanced the perception that the societal changes of the mid-twentieth century were the result of a moral awakening among whites. Instead, he wrote, they were a product of “interest convergence” and Cold War pragmatism. Armed with images of American racial hypocrisy, the Soviet Union had a damning counter to American criticism of its behavior in Eastern Europe. (As early as the 1931 Scottsboro trial, in which nine African American teen-agers were wrongfully convicted of raping two white women, the Soviets publicized examples of American racism internationally; the tactic became more common after the start of the Cold War.)

The historians Mary L. Dudziak, Carol Anderson, and Penny Von Eschen, among others, later substantiated Bell’s point, arguing that America’s racial problems were particularly disruptive to diplomatic relations with India and the African states emerging from colonialism, which were subject to pitched competition for their allegiance from the superpowers. The civil-rights movement’s victories, Bell argued, were not a sign of moral maturation in white America but a reflection of its geopolitical pragmatism. For people who’d been inspired by the idea of the movement as a triumph of conscience, these arguments were deeply unsettling.

In 1980, Bell left Harvard to become the dean of the University of Oregon law school, but he resigned five years later, after a search committee declined to extend the offer of a faculty position to an Asian woman when its first two choices, who were both white men, turned it down. Harvard Law rehired Bell as a professor. His influence had grown measurably since he began teaching; “Race, Racism and American Law,” which was largely overlooked at the time of its publication, had come to be viewed as a foundational text. Yet during his absence from Harvard no one was assigned to teach his key class, which was based on the book. Some students interpreted this omission as disregard for issues of race, and it gave rise to the first of two events that, in particular, led to the creation of C.R.T. The legal scholar Kimberlé Crenshaw, who was a student at the law school at the time, told me, “We initially coalesced as students and young law professors around this course that the law school refused to teach.” In 1982, the group organized a series of guest speakers and conducted a version of the class themselves.

At the same time, the legal academy was roiled by debates generated by a movement called critical legal studies; a group of progressive scholars, most of them white, had, beginning in the seventies, advanced the contentious idea that the law, rather than being a neutral system based on objective principles, operated to reinforce established social hierarchies. Another group of scholars found C.L.S. both intriguing and unsatisfying: here was a tool that allowed them to articulate the methods by which the legal system shored up inequality, but in a way that was more insightful about class than it was about race. (The “crits,” as the C.L.S. adherents were known, had not “come to terms with the particularity of race,” Crenshaw and her co-editors Neil Gotanda, Gary Peller, and Kendall Thomas later noted, in the introduction to the 1995 anthology “ Critical Race Theory: The Key Writings That Formed the Movement .”)

The next defining moment in C.R.T.’s creation came in 1989, when a group that developed out of the Harvard seminars decided to hold a retreat at the University of Wisconsin, where David Trubek, a central figure in the C.L.S. movement, taught. Casting about for a way to describe what the retreat would address, Crenshaw referred to “new developments in critical race theory.” The name was meant to situate the group at the intersection of C.L.S. and the intractable questions of race. Legal scholars such as Richard Delgado, Patricia Williams, Mari Matsuda, and Alan Freeman (attacks on C.R.T. have conveniently overlooked the fact that not all its founding scholars were Black) began publishing work in legal journals that furthered the discourse around race, power, and law.

Crenshaw contributed what became one of the best-known elements of C.R.T. in 1989, when she published an article in the University of Chicago Legal Forum titled “Demarginalizing the Intersection of Race and Sex: A Black Feminist Critique of Antidiscrimination Doctrine, Feminist Theory and Antiracist Politics.” Her central argument, about “intersectionality”—the way in which people who belong to more than one marginalized community can be overlooked by antidiscrimination law—was a distillation of the kinds of problems that C.R.T. addressed. These were problems that could not have been seen clearly unless there had been a civil-rights movement, but for which liberalism had no ready answer because, in large part, it had never really considered them. Her ideas about intersectionality as a legal blind spot now regularly feature in analyses not only of public policy but of literature, sociology, and history.

As C.R.T. began to take shape, Bell became more deeply involved in an ongoing push to diversify the Harvard law-school faculty. In 1990, he announced that he would take an unpaid leave to protest the fact that Harvard Law had never granted tenure to a Black woman. Since Bell’s hiring, almost twenty years earlier, a few other Black men had joined the faculty, including Randall Kennedy and Charles Ogletree, in 1984 and 1989. But Bell, cajoled by younger feminist legal scholars, Crenshaw among them, came to recognize the unique burdens that went with being both Black and female.

That April, Bell spoke at a rally on campus, where he was introduced by the twenty-eight-year-old president of the Harvard Law Review , Barack Obama . In his comments, Obama said that Bell’s “scholarship has opened up new vistas and new horizons and changed the standards of what legal writing is about.” Bell told the crowd, “To be candid, I cannot afford a year or more without my law-school salary. But I cannot continue to urge students to take risks for what they believe if I do not practice my own precepts.”

In 1991, Bell accepted a visiting professorship at the N.Y.U. law school, extended by John Sexton, the dean and a former student of Bell’s. Harvard did not hire a Black woman and, in the third year of his protest, Bell refused to return, ending his tenure at the university. In 1998, Lani Guinier became the first woman of color to be given tenure at the law school.

Bell remained a visiting professor at N.Y.U. for the rest of his life, declining offers to become a tenured member of the faculty. He continued to speak and write on subjects relating to law and race, and some of his most important work during this period came in an unorthodox form. In the eighties, he had begun to write fiction and, in 1992, he published a collection of short stories, called “ Faces at the Bottom of the Well .” A Black female lawyer named Geneva Crenshaw, the protagonist of many of the stories, serves as Bell’s alter ego. (Bell later told Kimberlé Crenshaw that he had “borrowed” her surname for the character, who was a composite of Black women lawyers who had influenced his thinking.) Kirkus Reviews noted that, despite some “lackluster writing,” the stories offered “insight into the rage, frustration, and yearning of being black in America.” The Times described the collection as “Jonathan Swift come to law school.” But the book’s subtitle, “The Permanence of Racism,” garnered nearly as much attention as its literary merits.

The collection includes “The Space Traders,” Bell’s best-known piece of fiction. In the story, extraterrestrials land in the United States and make an offer: they will reverse the severe damage the nation has done to the environment, provide it with a clean energy source, and give it enough gold to resurrect the economy, which has been ruined by policies favoring the rich. In exchange, the aliens want the government to turn every Black person in the country over to them. A consensus emerges that the Administration should take the deal, on the ground that mandating that Black people leave is not all that different from drafting them to go to war. Whites largely support the measure. Jewish groups oppose it, as an echo of Nazism, but they are silenced when a tide of anti-Semitism sweeps the nation. A corporate coalition opposes the trade, because Black people make up so much of the consumer market. Businesses that supply law enforcement and the prison industry oppose it, too, recognizing the impact that the disappearance would have on their bottom line.

A Black member of the Administration decides that the only way to get white people to veto the proposal is to convince them that leaving with the aliens would be an entitlement that undeserving Blacks would achieve at their expense; his plan fails. The story ends with twenty million African Americans, arms linked by chains, preparing to leave “the New World as their forebears had arrived.” The narrative is bleak, but it offers a trenchant commentary on the frailty of Black citizenship and the tentative nature of inclusion, and it echoes a theme of Bell’s earlier work—that Black rights have been held hostage to white self-interest.

The late critic and essayist Stanley Crouch told me in 1997 about a panel he appeared on with Bell, in which he’d criticized Bell’s dire forecasts. “He was clean . I’m looking at this beautiful chalk-gray suit he had on that cost about twelve hundred dollars, ” Crouch told me. “I said to myself, ‘There’s something wrong with this.’ For me having been involved with Friends of sncc and core thirty-five years ago, we’d be talking with guys from Mississippi back then who weren’t as pessimistic.” He added, “To hear that from him was the height of irresponsibility.” In an essay titled “Dumb Bell Blues,” Crouch wrote that Bell’s theory of interest convergence undermined the importance of Black achievements in transforming American society. Whereas he regarded Bell’s view as pessimism, to Bell it was hard-won realism. Imani Perry told me, “Even as he had a kind of skepticism about the prospect that racism would end, or that you’d get a just judicial order, he was still thinking about how you move the society, what will move, and what will be much harder to move.”

Part of Bell’s intent was simply to establish expectations. Crenshaw mentioned to me “ Silent Covenants ,” a book on the legacy of Brown, which Bell published in 2004. In it, he describes a 2002 ceremony at Yale, at which Robert L. Carter was awarded an honorary degree. When the university’s president noted that Carter had been one of the attorneys who argued Brown, the crowd leaped to its feet in an ovation, which prompted Bell to wonder, “How could a decision that promised so much and, by its terms, accomplished so little have gained so hallowed a place among some of the nation’s better-educated and most-successful individuals?”

“Silent Covenants” also features an alternative ruling in Brown. In this version, which was clearly informed by Bell’s reconsideration of Hudson v. Leake County, the Court holds that enforcing integration would spark such discord that it would likely fail, so the Justices issue a mandate to make Black and white schools equal, and create a board of oversight to insure that school districts comply. Bell says in the book that he wrote the ruling when a friend asked him whether the Court could have framed its decision “differently from, and better than” the one it chose to hand down. His response is a rebuke to the Warren Court’s ruling and also, implicitly, to the position taken by the man who gave Bell his job as an L.D.F. attorney—Thurgood Marshall, who had overseen the plaintiff’s suit and sought integration as a remedy. Yet, Crenshaw said, “at the end of the day, if Bell had been on the Court, would he have written that opinion? Well, I highly doubt it.” As she told me, “A lot of what Derrick would do would be intentionally provocative.”

The 2008 election of Barack Obama to the Presidency, which inherently represented a validation of the civil-rights movement, seemed like a refutation of Bell’s arguments. I knew Bell casually by that point—in 2001, I had interviewed him for an article on the L.D.F.’s legacy, and we had kept in touch. In August of 2008, during an e-mail exchange about James Baldwin ’s birthday, our discussion turned to Obama’s campaign. He suggested that Baldwin might have found the Senator too reticent and too moderate on matters of race. Bell himself was not much more encouraged. He wrote, “We can recognize this campaign as a significant moment like the civil rights protests, the 1963 March for Jobs and Justice in D.C., the Brown decision, so many more great moments that in retrospect promised much and, in the end, signified nothing except that the hostility and alienation toward black people continues in forms that frustrate thoughtful blacks and place the country ever closer to its premature demise.”

I was struck by his ominous outlook, especially since someone Bell knew personally, and who had taught his work at the University of Chicago, stood to become the first Black President. I thought that his skepticism had turned into fatalism. But, a decade later, during the most reactionary moments of the Trump era, Bell’s words seemed clarifying. On January 6th of this year, as a mob stormed the Capitol in an attempt to overturn a Presidential election, the words seemed nearly prophetic. It would not have surprised Bell that Obama’s election and the strength of the Black electorate that helped him win are central factors in the current tide of white nationalism and voter suppression.

Bell did not live to see the election of Donald Trump , but, as his mention of the nation’s “premature demise” suggests, he clearly understood that someone like him could come to power. Still, the current attacks on critical race theory have arrived decades too late to prevent its core tenets from entering the legal canon. The cohort of young legal scholars that Bell influenced went on to important positions in the academy, and many of them, including Crenshaw, Williams, Matsuda, and Cheryl Harris, have influenced subsequent generations of thinkers themselves. People who looked at the deaths of George Floyd and Breonna Taylor and others and concluded that they were not anomalies but evidence that the system was functioning as it was designed to, were articulating the conclusion that Bell had drawn decades earlier. “The gap between words and reality in the American project—that is what critical race theory is, where it lies,” Perry told me. The gap persists and, consequently, Bell’s perspective retains its relevance. Even after his death, it has been far easier to disagree with him than to prove him wrong.

Vinay Harpalani told me, “Someone asked him once, ‘What do you say about critical race theory?’ ” Bell first replied, “I don’t know what that is,” but then offered, “To me, it means telling the truth, even in the face of criticism.” Harpalani added, “He was just telling his story. He was telling his truth, and that’s what he wanted everyone to do. So, as far as Derrick Bell goes, that’s probably what I think is important.” ♦

Democracy in the digital networked age of “fake news” and “alternative facts” requires new literacy skills and critical awareness to read, write, and use media and technology to empower civic participation and social transformation. Unfortunately, not many educators have been prepared to teach students how to think critically with and about the media and technology that engulf us. Across the globe there is a growing movement to develop media and information literacy curriculum (UNESCO) and train teachers in media education (e-Media Education Lab), but these attempts are limited and in danger of co-optation by the faster growing, better financed, and less critical education and information technology corporations. It is essential to develop a critical response to the new information communication technologies, artificial intelligence, and algorithms that are embedded in all aspects of society. The possibilities and limitations are vast for teaching educators to enter K-12 classrooms and teach their students to use various media, critically question all types of texts, challenge problematic representations, and create alternative messages. Through applying a critical media literacy framework that has evolved from cultural studies and critical pedagogy, students at all grade levels can learn to critically analyze the messages and create their own alternative media. The voices of teachers engaging in this work can provide pragmatic insight into the potential and challenges of putting the theory into practice in K-12 public schools.

Introduction

It is a formidable challenge to prepare critical educators to work inside a system in which every brick in the wall has been laid to transmit the information, skills, and ideas necessary to reproduce the social norms, inequities, ideologies, and alienation that are undermining the quality and sustainability of life on this planet. However, education can be a powerful tool to challenge these problems and create opportunities for students to work in solidarity with others to create a more socially and environmentally just world. To support these changes, we need teachers ready to engage students in critical inquiry by posing questions about systemic and structural issues of power, hierarchies of oppression, and social injustice. In the current media and information age, information communication technologies (ICTs) are available to either continue the control and degradation or to deconstruct the systems of oppression and reconstruct a more just and sustainable society.

Digital technology is opening opportunities for individual participation and alternative points of view, while at the same time a handful of enormous media and technology corporations have become the dominant storytellers, often repeating the same story at the expense of countless different perspectives and creative ways of thinking. Many of these storytellers are actually story-sellers, more interested in peddling ideas and products than informing, enlightening, inspiring, or challenging. While young people are using more media, they are also being used more by media companies. Giant transnational corporations are targeting youth as one of the most valuable markets for building brand loyalty and selling to advertisers. Researchers found 8- to 18-year-olds in the United States spend well over 10 hours a day interacting with various forms of media, such as music, computers, video games, television, film, and print ( Rideout et al., 2011 ). Another investigation discovered that 95% of American 13- to 17-year-olds have access to a smartphone and 97% say they are online daily and 46% use it constantly ( Vogels et al., 2022 ).

Not only is the amount of time with media increasing but the quality of that engagement is also changing by becoming more commercial and rarely critical. Researchers at Stanford University administered six tasks to 3,466 high schools across 14 states in the US to judge their ability to assess online information. In one task, students were asked to evaluate the credibility of a website that claimed to “disseminate factual reports” and 96% failed to learn about the site’s ties to the fossil fuel industry. In a different task, over half of students believed an anonymously posted video purporting to show voter fraud in the US was real, even though it was filmed in Russia ( Breakstone et al., 2021 ). In another study, Vosoughi et al. (2018) examined approximately 126,000 stories tweeted over 4.5 million times between 2006 and 2017 . The researchers were interested in understanding what accounted for the differential diffusion of verified true and false news stories. They found that false news stories spread “farther, faster, deeper, and more broadly than the truth because humans, not robots, are more likely to spread it” (p. 5). In analyzing the tweets, the authors concluded, false stories were 70% more likely to be retweeted because people found them not only more novel but the stories also inspired emotional responses of fear, disgust, or surprise.

The concern about “fake news” has encouraged many people to recognize the need for critical readers and writers of media. Some have suggested that we simply need better cognitive skills to determine truth from lies. However, making sense of the media and our information society is far more complicated than a reductionist idea of simply finding the truth. Rather than judging information as either true or false, students need to learn to search for multiple sources, different perspectives, and various types of evidence to triangulate and evaluate findings. In order to best evaluate and understand the information, they also need to question the influence of media in shaping the message and positioning the audience. Since all knowledge is an interpretation ( Kincheloe, 2007 ), interpreting the meaning of a message is a complex process that requires skills to probe empirical evidence, evaluate subjective biases, analyze the medium and construction of the text, and explore the social contexts.

This is an opportunity for educators to guide their students to think critically with and about the ICTs and media that surround them. Morrell et al. (2013) argue that the technology itself will not bring about transformative educational change. “That change will only come through teachers who draw on critical frameworks to create learning communities where the use of these tools becomes an empowering enterprise” (p. 14). Therefore, the changes in media, technology, and society require critical media literacy (CML) that can support teachers and students to question and create with and about the very tools that can empower or oppress, entertain or distract, inform or mislead, and buy or sell everything from lifestyles to politicians. Now more than ever, teachers should encourage students to be reading, viewing, listening to, interacting with, and creating a multitude of texts, from digital podcasts to multimedia productions.

Teacher Education

Even though youth are immersed in a world in which media and technology have entered all aspects of their lives and society, few teacher education programs are preparing teachers to help their students to critically understand the potential and limitations of these changes. It is crucial that new teachers learn how to teach their K-12 students to critically read and write everything, from academic texts to social media.

This means that schools of education responsible for training the new wave of teachers must be up to date, not just with the latest technology, but more importantly, with critical media literacy (CML) theory and pedagogy in order to prepare teachers and students to think and act critically with and about media and technology. In Canada, where media literacy is mandatory in every grade from 1 to 12, most new teachers are not receiving media literacy training in their preservice programs ( Wilson & Duncan, 2009 ). Researchers investigating media education in the United Kingdom and the US have found that many teachers are unprepared to teach media education and that professional learning opportunities are limited ( Butler, 2020 ; Kirwan et al., 2003 ). The progress has been slow, especially considering that inclusion of media literacy in formal public education has a history dating back to the 1980s in Australia, Britain, and Canada. However, nonformal media education has been occurring in many parts of the world for decades ( Hart, 1998 ; Kaplún, 1998 ; Kubey, 1997 ; Pegurer Caprino & Martínez-Cerdá, 2016 ; Prinsloo & Criticos, 1991 ).

While it is difficult to know for sure who is and who is not teaching critically about media and technology ( Mihailidis, 2008 ), there seems to be an increased interest in media literacy in the United States. In 2022 , the National Council of Teachers of English published a position statement recommending implementation of media education in English Language Arts along with two special issue journal publications ( Lynch, 2021 ; Kist & Christel, 2022 ) devoted to critical media literacy, arguing that “media education must be an essential component of the professional identity of teachers” ( National Council of Teachers of English, 2022 ).

As technology and media continue to evolve and increasingly enter public and private spaces, more educators are recognizing the need for training new teachers about media literacy ( Domine, 2011 ; Goetze et al., 2005 ; Hobbs, 2007a ) and some are even addressing the need to teach about CML ( Flores-Koulish et al., 2011 ; Funk et al., 2016 ; Robertson & Hughes, 2011 ; Trust et al., 2022 ). Researchers Tiede et al. (2015) studied 64 universities or colleges of teacher education in Germany and 316 U.S. public educational institutions that provide teacher training and graduate studies, concluding that very few offer more than media didactics (basic educational technology that teaches with media, not about media). From their data in the United States, they report, “media education, with emphasis on the instructional practices associated with the critical evaluation of media, culture, and society, were scarce, representing only 2% of all study programs in teacher training programs” (pp. 540−541). In Germany, the percentage increases to 25%, but “media didactics tends to be emphasized to the disadvantage of media education in both countries” (p. 542).

In 2011 , the United Nations Educational, Scientific, and Cultural Organization (UNESCO) published a curriculum guide online in 11 languages for training teachers in media education ( Grizzle & Wilson, 2011 ), declaring that “teacher training in media and information literacy will be a major challenge for the global education system at least for the next decade” ( Pérez-Tornero & Tayie, 2012 , p. 11). 1 In Europe, Ranieri and Bruni (2018) analyzed the successes and challenges of training preservice and in-service teachers about media and digital literacy. An initiative called e-Media Educational Lab, funded by the European Commission, provided blended training to 279 preservice teachers and 81 in-service teachers in six countries. Based on surveys and fieldnotes, Ranieri and Bruni (2018) reported that the preservice and in-service teachers found critical media analysis and media production to be very important; they described their intent to transfer their media competency to their classrooms and expressed a desire to learn more practical ways to help their students develop media competencies.

UNESCO’s approach to media education combines media and information literacy (MIL) to include many competencies, from learning about and using information communication technologies to thinking critically about ethics and democracy. Carolyn Wilson (2012) explains, “MIL is both a content area and way of teaching and learning; it is not only about the acquisition of technical skills, but the development of a critical framework and approaches” (p. 16).

Combining information technology with media-cultural studies is essential, but still infrequent. Within the current wave of educational reform that prioritizes the newest technology and career readiness over civic engagement and critical inquiry, schools are more likely to adopt only information technology or information literacy and not critical media education. In the United States, few universities offer more than a single course in media literacy and most do not even offer that ( Goetze et al., 2005 ; Meehan et al., 2015 ).

Schwarz (2001) asserts that because of the power of emerging literacies, “teacher education needs media literacy as an essential tool and an essential topic in the new millennium” (pp. 111−112). She calls for integrating media literacy across all subject areas of teacher education, “from methods courses and educational psychology to foundational courses and student teaching” (p. 118). This interdisciplinary approach for media education could be easier now for K-12 teachers in the United States since the Common Core State Standards require literacy to be taught and technology to be used across the curriculum ( California Common Core State Standards, 2013 ; Moore & Bonilla, 2014 ; Trust et al., 2022 ).

Two studies with a total of 31 preservice teachers found a discrepancy between their positive attitudes for teaching media literacy and the lack of attention and support in their teacher education programs to prepare them to teach MIL ( Gretter & Yadav, 2018 ). Based on interviews with these preservice teachers, Gretter and Yadav (2018) report that they associated MIL with critical thinking skills and expressed concerns about not knowing how to teach MIL because their teacher preparation program encouraged “teaching with technology and not necessarily about technology” (p. 115). These preservice teachers complained about “a lack of preparation to help them transfer their knowledge of digital media to MIL pedagogies that would benefit students” (p. 111). This highlights the importance of preparing educators with the theory and conceptual understandings as well as the pedagogy and practical applications for how to teach their students to critically analyze and create media.

Teaching Teachers Critical Media Literacy

Transforming education to critically use media, technology, and popular culture for social and environmental justice is the overarching goal of a critical media literacy (CML) course in the teacher education program at the University of California, Los Angeles (UCLA). The authors of this article have been involved in designing and teaching this course to in-service and preservice teachers. Through combining theory from cultural studies and critical pedagogy with practical classroom applications of digital media and technology, this course prepares K-12 educators to teach their students how to critically analyze and create all types of media. In 2011 , this four-unit course on CML was officially approved and became a required class for all students working on their teaching credential at UCLA.

The teacher education program at UCLA is primarily a two-year master’s and credential program that accepts about 130 candidates annually. The program is committed to developing social justice educators to work with and improve the schooling conditions of California’s ethnically, culturally, and linguistically diverse children. While most of the students go through the two-year program, additional pathways for earning a teaching credential and master’s degree have been offered, such as a master’s-only program for in-service teachers with two years or more of full-time teaching experience.

The CML class is taught in separate sections, usually divided by subjects, with 25−50 students per section. Most of the candidates taking the class are student teaching at the same time, except for the master’s-only candidates, who were teaching full-time while attending the class once a week in the evening. The class includes lectures, discussions, and activities interwoven into each session during the 10-week quarter.

Beginning with a theoretical overview, the course explores the development of media education that is defined less as a specific body of knowledge or set of skills and more as a framework of conceptual understandings ( Buckingham, 2003 ). Much of the theory behind CML has evolved from cultural studies, a field of critical inquiry that began in the 20th century in Europe and continues to grow with new critiques of media and society. From the 1930s through the 1960s, researchers at the Frankfurt Institute for Social Research used critical social theory to analyze how media culture and the new tools of communication technology induce ideology and social control. In the 1960s, researchers at the Centre for Contemporary Cultural Studies at the University of Birmingham added to the earlier concerns of ideology with a more sophisticated understanding of the audience as active constructors of reality, not simply mirrors of an external reality. Kellner (1995) explains that cultural studies has continued to grow and incorporate concepts of semiotics, feminism, multiculturalism, and postmodernism. Incorporating a dialectical understanding of political economy, textual analysis, and audience theory, cultural studies critiques media culture as dynamic discourses that reproduce dominant ideologies as well as entertain, educate, and offer the possibilities for counter-hegemonic alternatives ( Hammer & Kellner, 2009 ).

Critical media literacy includes three dimensions ( Share & Gambino, 2022 ). The first involves the content students learn about systems, structures, and ideologies that reproduce hierarchies of power and knowledge concerning race, gender, class, sexuality and other forms of identity and environmental justice, as well as general understandings about how media and communication function. The second dimension engages the skills to critically think and question media representations and biases, to deconstruct and reconstruct media texts, and use a variety of media to access, analyze, evaluate, and create. The third involves developing a disposition for empathy, critical consciousness, and empowerment to take action to challenge and transform society to be more socially and environmentally just. This third dimension is based on Freire’s (2010) notion of conscientização , a revolutionary critical consciousness that involves perception as well as action against oppression. These three dimensions of critical media literacy pedagogy are supported through an inquiry-based democratic approach that follows ideas of transformative educators like John Dewey and Paulo Freire. We incorporate feminist theory and critical pedagogy to analyze relationships between media and audiences, information and power ( Carlson et al., 2013 ; Garcia et al., 2013 ). When we first began teaching the course, we used a simple framework with five core concepts and key questions from the Center for Media Literacy. 2 To emphasize the critical potential of these ideas, while providing an accessible tool for teachers to use in the classroom, the following critical media literacy framework was developed, with six conceptual understandings and questions, as shown in Table 1 ( Kellner & Share, 2019 ).

These six conceptual understandings and questions are referred to regularly and are addressed in all lesson plans. It is important for teachers to understand the concepts and questions because theory should inform practice for all three dimensions. However, it is better for K-12 students to learn to ask the questions rather than memorize the concepts, since the questions, with appropriate guidance, can lead students on a path of inquiry where they are more likely to make meaning themselves, related to the conceptual understandings.

The CML framework is designed to help teachers and their students question the role of power and ideology that socialize and control society through making some people and ideas seem “normal” and “natural” while the rest are “othered” and “marginalized” ( Hall, 2003 ). This critical framing supports teachers and students to deepen their explorations of racism, sexism, classism, homophobia, overconsumption, environmental exploitation, and other problematic representations in media. Candidates analyze and discuss current media examples, while also learning how to use various ICTs to create their own media with alternative counter-hegemonic representations. Using an inquiry process and democratic pedagogy, problems are posed to the students to collaboratively wrestle with, unpack, and respond to through media production.

Critical media literacy promotes an expansion of our understanding of literacy to include many types of texts, such as images, sounds, music, video games, social media, advertising, popular culture, and print, as well as a deepening of critical analysis to explore the connections between information and power. In our digital networked media age, it is not enough to teach students how to read and write just with print while their world has moved far beyond letters on a page. Literacy education in the 21st century requires breaking from traditional practices to include all the varied ways people communicate with media, technology, and any tool that facilitates the transfer of information or connects people. This calls for new skills and understandings to decode and analyze as well as to create and produce all types of texts. The California Teaching Performance Expectations also require teacher education programs to expand this view of literacy and integrate media and technology into coursework in order to “deepen teaching and learning to provide students with opportunities to participate in a digital society and economy” ( California Commission on Teacher Credentialing, 2016 , p. 9).

Each class starts by reviewing and applying the conceptual understandings and questions. Since one goal of the course is for candidates to understand that literacy includes reading and writing all types of texts, we encourage students to analyze as well as produce media. A series of assignments requires candidates to work together to create various types of media projects such as visual posters, photographs, podcasts, memes, digital stories, and social media. The candidates are also expected to work collaboratively on a CML lesson plan and learning segment that they write up, present a summary of to the whole class, and when possible, also teach it. From a desire to explore if and how former students are applying the skills and knowledge gained from the critical media literacy (CML) course into their teaching practice, we created an online survey for students who had taken the course. Through purposeful sampling, we sent out the survey to the 738 students who had taken the CML course and ended up with 185 usable responses (25% response rate), 153 preservice and 32 in-service teachers. Of the 185 respondents, 53 taught elementary school and 132 were secondary-level teachers. The breakdown of the middle school and high school teachers was: 38 science, 34 math, 33 social sciences, 28 English, and several reported teaching a combination of subjects as well as some who taught other areas such as music, visual arts, Spanish, English language development, or adult education. The span of experience was wide; some just started teaching and some had been teaching over seven years, yet most of the teachers (52%) had been teaching between two and three years.

The mixed method survey included 20 questions. The first eight sought to identify participants’ teaching background. The remaining 12 questions inquired about their experiences teaching CML skills and concepts to their K-12 students. Ten quantitative questions used a Likert scale with a choice of responses, including very frequently, frequently, occasionally, rarely, and never, as well as an option to choose not applicable. The final two qualitative questions were open-ended in which respondents could type their thoughts about any “memorable moment(s) teaching critical media literacy” and “any additional comments.” During the analysis phase, we found it helpful to combine the categories very frequently and frequently and refer to them as VF/F.

Voices From the Field

Using mixed methods of quantitative and qualitative data, we analyzed the survey responses to explore teachers’ ideas about what they had been doing with their students. The overall feedback suggested that the majority of the respondents had brought aspects of media literacy education into their K-12 classrooms, and sometimes even incorporated CML. One of the most recurring patterns we noticed was that these teachers had been expanding the traditional concept of literacy by engaging their students with various types of media.

Teaching With Media

In reply to the first question, most of the respondents reported having integrated media into their class activities: 64% VF/F, 30% occasionally, 6% rarely, and no one responded never ( N = 185). The responses to Question 1 were very similar for elementary and secondary teachers, with only a 1% to 5% difference. Where we saw greater variation was when comparing the subject matter of secondary teachers. The English and science teachers had the highest percentages (75% and 76%) of VF/F responses to Question 1 about integrating media into class activities. Math teachers, by contrast, reported the lowest percentage, with 44% reporting VF/F and 15% rarely integrating media into the curriculum (see Figure 1 ).

While these responses demonstrated an overall high amount of media integration, it was not clear how the teachers integrated media and what students were doing with the media. The responses from Question 5 (“my students have created the following media”) provided more information about the students’ interactions with media, showing that the vast majority of respondents (92%) had their students create some type of media (see Figure 2 for a list of the various media students created).

Since the question only asked teachers to check the box for the type of media their students created, we did not know how often this occurred or with what degree of analysis. Questions 1 and 5 indicated that teaching with media occurred with over 90% of the respondents.

Teaching About Media

The second question tried to find out more about those interactions with media by asking respondents to rate how often they had given their “students opportunities to engage in media analysis.” For Question 2, about one-third of all 185 respondents, 32%, reported VF/F, 43% occasionally, 21% rarely, and 4% never. When comparing responses from Questions 1 and 2, the respondents seemed to have been doing more teaching with media (Question 1) than teaching about media (Question 2) (see Figure 3 ). A similar finding was mentioned in the research conducted in Germany and the United States by Tiede et al. (2015) .

A more nuanced perspective of Question 2 is possible when comparing the responses about media analysis from different content area secondary teachers. In response to Question 2, the teachers who reported VF/F were the following: 63% of English teachers reported giving the most opportunities for their students to engage in media analysis, as compared to almost half as often by 32% of science teachers and about five times less often by 12% of math teachers (see Figure 4 ). Since literacy is a primary goal of English instruction, it is not surprising that English teachers reported the highest levels of media analysis ( Hobbs, 2007b ).

It is important to recognize that teaching about media can be a highly complex and multifaceted undertaking, especially when done through a CML lens. For example, the second conceptual understanding encourages students to analyze the codes and conventions of the media text and the medium through which they travel by asking how the text was constructed and delivered or accessed. This, in itself, can have many layers and yet is just one of six questions intended to help students think critically about media. Livingstone (2018) asserts, “media literacy is needed not only to engage with the media but to engage with society through the media .” As Luke and Freebody (1997) argue, it is not enough to only have a psychological approach to literacy, as if reading and writing is just an individual cognitive process. We need to also bring a sociological lens into the process of questioning the contexts, the dominant ideologies, and the systems that make some things seem “natural” or “normal.” The CML framework is a holistic tool for thinking about and questioning the dynamic role media play in our relationships with ourselves, each other, and society. Responses and comments to other questions in the survey provide more insight into how some teachers have engaged their students in various types of media analysis.

Evaluating Information and Advertising

In the qualitative responses to Questions 11 and 12, teachers mentioned embracing basic media literacy principles in the ways students were evaluating the credibility of information and advertising as well as creating different types of media. The popularity of the term “fake news” and the growing amount of disinformation have increased the challenge to distinguish misinformation and propaganda from journalism and scientifically researched facts ( Rogow, 2018 ). An elementary teacher who reported “frequently” integrating media into the classroom, asserted:

Though my students are younger and some of these concepts are more difficult to teach than others, I find it important to bring up especially in terms of making sure they don’t believe every YouYube video they watch. We’ve had many meaningful discussions about what can be created for a video shouldn’t just be accepted as the truth. For example, the ‘mermaid’ documentary that came out a few years ago had all of my students convinced that they had found a mermaid. It led to an interesting discussion on hoaxes and further reading about Bigfoo[t] and other such stories.

Since all media contain bias because they are created by subjective humans, it is important for teachers to help their students to recognize the bias and also be able to judge the credibility of information. A high school math teacher wrote:

It has not happened until this school year, when I began teaching Statistics. I introduced some pictographs for students to analyze and an article for students to read about how a website stated that if polls were unskewed, Trump would be leading the polls for election. I had students read and discuss about the validity and why/why not it is trustable.

Several respondents mentioned having their students study political advertising, and since all U.S. elections are now multimillion-dollar advertising campaigns (e.g., Barack Obama’s 2008 presidential campaign won the top prizes at the Cannes Lions International Advertising Awards), there is little distinction between selling products, ideas, and political candidates.

Analyzing advertising is an important aspect of media education because advertising is the motor that drives commercial media and has become so common in our lives that there are few spaces that are completely ad-free ( Jhally, 2003 ). Several respondents reported about their students investigating advertisements for false health messages, misleading packaging, political campaigns, tobacco, alcohol, and different perspectives. One secondary English teacher wrote, “My students took pictures of advertisements that surrounded their neighborhood and we analyzed them for patterns, themes, and purposes.” A high school science teacher reported, “I had many times this past year where students were able to reflect on marketing strategies and how they affect the viewer’s perspective of their life and themselves. Students made great connections.”

During the critical media literacy (CML) class, students scrutinize consumer culture and the role advertising plays in creating anxieties, shaping desires, and normalizing representations about all things, from consumption to gender, race, and class. Candidates in the CML class learn about these ideas through readings, by analyzing advertisements, and also by creating ads for different target audiences. When asked about the media their students had created, one third reported their students created advertisements.

Creating Different Types of Media

When students are taught print literacy, they are instructed how to decode letters on a page and how to write with those letters to construct words, sentences, and paragraphs. The same process of teaching reading and writing should be applied to visual images, movies, songs, video games, social media, and all the various multimedia texts that students are encountering daily. In responses from the survey, teachers reported about having their students write and create many different types of texts beyond print (see Figure 2 ).

One English teacher wrote that having students create media was “very successful. They loved being able to create memes, posters, Prezis, etc. to present their work.” An elementary teacher shared about students “creating podcasts/npr style news stories regarding UN sustainability goals.” Several respondents commented on their students designing commercials or challenging ads by producing spoofs that parody the ads. One middle school teacher shared, “students analyzed ads for nicotine and alcohol products, then used the practice with critical media skills to create ‘anti-ads’ with Google drawings.”

During the first year of teaching, a high school science teacher reported about a memorable moment when “creating a multi-lingual, easy-to-understand and scientifically supported pamphlet on the hazards in LA’s environment.” A high school Spanish teacher wrote about his students creating critical memes in Spanish, like the ones they created in the critical media literacy (CML) class. During the session exploring racism and media, candidates challenge racist representations through creating racial myth-busting memes. As a strategy to demonstrate the value of media production, the CML class has students create various media in almost every session, and these activities are often the favorite lessons mentioned in the end of course evaluations.

Increasing Engagement

While engagement is not a learning objective, all teaching benefits from students being engaged in their learning. One of the patterns that emerged from the responses was teachers’ observations that student engagement increased. An eighth-grade English teacher wrote that after incorporating media literacy, the students’ “entire attitude toward learning shifted. Especially the hard to reach students.” An elementary teacher reported, “Media literacy has made great contributions in my class with science research in the past. The simple act of using google images, google maps and finding credible sources has sparked learning and interest in my class.” Another elementary teacher shared about using critical media literacy (CML) to analyze food justice issues: “They were instantly engaged and students who had a difficult time writing and with critical thinking then did not.”

A secondary science teacher reported, “Students spent the entire class engaged in discussion when I intended for it to only be an introduction to the unit.” Another high school science teacher wrote, “When I did teach a class specifically geared towards media literacy, it was great because students were engaged. They were quick at analyzing images and creating their own.” A third science teacher wrote, “using critical media literacy made engaging my students in abstract chemistry concepts more meaningful and engaging.” Engagement tends to increase when students are genuinely interested and intrinsically motivated, something that often comes out of personal connection, a sense of meaningfulness, and an authentic belief in the value of the learning ( Dewey, 1963 ). These are all elements of good CML pedagogy. A high school science teacher described the feelings of students and their parents as they responded to their CML work: “My favorite moments are students exuding pride and passion over the work they are creating that speaks to their perspectives and experiences; parents proud of their students’ media creations.” Feelings of pride and passion are important for all students to experience; they help lower students’ affective filters for learning ( Krashen, 1995 ) and increase intrinsic motivation to want to learn.

Critical Media Literacy

As we analyzed teachers’ written responses, we saw a number of comments in which they were taking basic media literacy concepts to deeper levels of criticality. Several mentioned how useful the class was to understanding critical theory and be able to see how it can be enacted in their K-12 classroom. Similar findings were mentioned after Joanou (2017) analyzed data about a critical media literacy (CML) class taught to master’s-level practicing K-12 educators. Joanou (2017) reported, “critical media literacy helps bridge the gap between theory and practice” (p. 40). The use of media texts and popular culture can provide relevant examples for entry into abstract concepts that are often politically and emotionally charged, and sometimes too sensitive or too distant to begin discussing on a personal level.

Teaching about the connections between information and power reflects a key goal of CML ( Kellner & Share, 2007 ) and our respondents demonstrated this through their qualitative comments about recreating counter-narratives, analyzing the politics of representation, making critical connections between history and current events with media texts, and engaging in political, social, and environmental media activism. Questions 3 and 4 attempted to assess the frequency in which teachers were bringing critical aspects of media education to their students.

Question 3 asks teachers to rate how often: “My students have engaged in media analysis by exploring media representations of ideology, race, class, gender, sexuality, environmentalism, and/or other social justice issues.” Elementary and secondary teachers reported almost identical frequencies in response to Question 3: 22% in both groups reported VF/F while 42% (elementary) and 45% (secondary) stated occasionally. When asked Question 4 about making connections between information and power, the differences increased: 39% of the secondary teachers responded doing this VF/F while just 23% of the elementary teachers reported doing this VF/F.

In-service teachers reported higher frequencies for Question 3: 54% of in-service teachers reported VF/F while preservice teachers reported 14% VF/F. For Question 4: 56% of in-service teachers reported VF/F compared with 30% of preservice teachers who reported VF/F.

When comparing responses separated by subject matter with secondary teachers, 33% of English teachers and 30% of social science teachers reported VF/F for engaging in critical media analysis, as seen in Question 3 about exploring media representations. This is considerably higher than the 16% of science teachers and 9% of math teachers reporting VF/F. The math and science teachers reported the highest percentages for rarely or never having their students explore media representations of social justice issues (see Figure 5 ). The literature supports similar findings. Garii and Rule (2009) reported that student teachers had a difficult time integrating social justice into math and science content due to several factors. In their research with novice elementary teachers, Garii and Rule discovered that the candidates were not confident in their ability to teach math and science and had limited and unsophisticated knowledge of the content. They also viewed math and science “to be a set of routinized, algorithmic practices that lead to a single, correct answer and neither science nor mathematics are assumed to be closely connected to real-world issues and concerns” (p. 491). Given that they are struggling to learn and understand the content, math and science candidates turned to classroom textbooks to guide instructional practices. Incorporating nontraditional practices or making connections to students’ lives becomes a challenge because they disconnect social justice from their teaching and focus on teaching to the content ( Garii & Rule, 2009 ).

One of the more significant findings of the study is the number of respondents reporting they “noticed that using critical media literacy encourages critical thinking among students” (Question 9). Of the preservice respondents, 61% reported VF/F, and for the in-service teachers, the percentages jump to 81% who reported VF/F. In both cases, the majority of respondents expressed their feelings that CML promotes critical thinking most of the time (see Figure 6 ). A middle school social science teacher wrote that after teaching CML, “students were deeper thinkers and our discussions were so much richer. Students were highly engaged and more invested in the classroom.” When comparing grade levels for Question 9, we see 78% of elementary teachers reported that using CML VF/F encourages critical thinking, and 61% of secondary teachers reported VF/F. This large percentage of elementary teachers reporting about CML encouraging critical thinking shows great promise for the potential of CML in the early grades.

Creating Counter Narratives and Supporting Students’ Voices

Many of the responses regarding transformative education centered on guiding students to create counternarratives and supporting student ideas and voices. Respondents mentioned activities that enabled their students to recreate media texts with a critical lens. These counternarratives included recreating superhero comic books, news, advertisements, digital storytelling, national holiday observances, and poems. A high school English teacher noted, “after analyzing recent and popular superhero comic books, my students used the comic medium to tell an autobiographical story wherein they exhibited power in the face of oppression.” A middle school English teacher reported:

The most memorable lesson I’ve taught involving critical media literacy was a unit based on perseverance and the power of the human spirit in regards to power structures and oppression. After analyzing multiple types of media, students created their own VoiceThread using spoken word in order to share their own messages of perseverance. It was incredibly powerful to hear their messages.

For most respondents, the notion of enabling their students to share personal stories using multimedia tools meant that they were integrating critical media pedagogy into their teaching practice. Traditionally, personal and experiential knowledge as a form of literacy is not often valued; thus, it is a critical pedagogical orientation to encourage students to recreate media texts that reflect their intersecting realities and challenge the pervasive dominant ideologies. Students’ personal histories become scholarly pursuits when digital storytelling encompasses media production skills taught through a critical media literacy (CML) framework. Vasquez (2017) asserts, “students learn best when what they are learning has importance in their lives, using the topics, issues, and questions that they raise should therefore be an important part of creating the classroom curriculum” (p. 8). A middle school math and technology teacher commented about incorporating CML into her master’s inquiry project:

The project we ultimately created was a digital storytelling project, in which students interviewed their parents or someone they admire and created some sort of media project around that story to tell counter-narratives to the dominant story told in media about people of color.

Guiding students to create counternarratives can be an empowering instructional strategy that nurtures their personal realities and supports their voice. Considering the context of urban education, it becomes particularly important for low-income students and students of color, who have been historically denied the power to be heard, to engage in their learning as empowered subjects through creating digital counter-narratives.

Politics of Representation

A major difference between critical media literacy (CML) and the more common media literacy practiced in the United States is the rigorous examination of the politics of representation; an analysis of how historically disenfranchised social groups are represented in media ( Funk et al., 2016 ). Many of the respondents discussed analyzing issues related to representations of different identities with their students. A high school visual arts teacher reported that through “using current events in the media, students created headline news with people of color perspective.” The majority of the responses highlighted engaging in discussions related to gender and a few responses about race. One elementary teacher noted:

My grade level did a Critical Media Literacy unit and after it was over, a week later, a student showed me a box of Chips Ahoy cookies and said that it was made to be sold to boys and girls. She compared it to a rainbow pop tarts box made for girls and a basketball cereal box made for boys that we had discussed during the CML unit.

A high school social science teacher reported:

My 11th and 12th grade Sociology class created representation boards. Each group was assigned an identity (‘white male,’ ‘Asian male,’ ‘black female,’ etc.). When each group was done, we compared the images and discussed the similarities between representations of race and gender. It really opened their eyes.

The politics of representation explores the complexities and intersections of identity markers, such as ethnicity, culture, gender, class, sexual orientation, religion, and ableism. Several candidates alluded to the intersectionality between race and gender in their responses, mostly engaging their students in discussions related to the unequal representation and socialization of gender roles. They also noted that discussing stereotypical gender roles challenged their students’ internalized notions of gender. Responses such as the following highlight the shift in their students’ perspectives about gender: An elementary teacher wrote, “We’ve had some successful discussions around gender stereotypes and I’ve heard the language change in the classroom and students be more thoughtful about others’ choices.” Another elementary teacher reported, “My students showed greater acceptance. After teaching a lesson invoking gender all my male students felt accepted to choose any color paper—the favorite was pink for the rest of the year.”

Making Critical Connections

In response to the open-ended questions, an array of items was mentioned that demonstrate critical engagement, from teaching about racism and whitewashing, to numerous examples of analyzing gender and sexism, as well as projects on environmental justice and climate change at all grade levels. Some respondents discussed their transformative practice through the way their students analyzed and created media to make critical connections between historical and current events.

A high school social science teacher stated, “I had students create videos explaining the situation in Ukraine and relating it to the Cold War. In United States history, I often had students look at political cartoons and think about current examples of imperialism and how they’re represented in media.” Similarly, another social science teacher described a memorable moment of teaching critical media literacy (CML) as: “When students could make the connection between yellow journalism in Spanish-American War and media sensationalism during the War on Terror.” An elementary school teacher wrote:

My students began to think critically about history after showing them the spoken word poem ‘History Textbooks,’ which talked about world history being American Propaganda. Through this poem, they began questioning: who gets to write history and whose stories are told? It was a really powerful lesson we returned to over and over again throughout my course.

Analyzing media texts by acknowledging their historical continuity is vital because marginalization and exploitation are historically bound. Discovering these historical connections helps teachers and students learn how dominance and ideology are perpetuated, transcending time and space. Bridging the gap between the past and the present enables students to identify the common thread of hegemony across various spheres of social life. This instructional approach of CML promotes critical thinking with a social justice emphasis.

Another topic on which respondents commented was using CML to teach about environmental issues, especially the climate crisis. This is an important area for CML, since so many media messages about climate change distort the scientific evidence and mislead the public ( Beach et al., 2017 ; Share & Beach, 2022 ). A high school science teacher reported, “My class analyzed the politics behind climate change denial and how climate change is represented in the media. It was very easy for my students to see the connection between the message and its creators.” Exploring the connection between media ownership and media messages, another high school science teacher commented that a memorable moment was having a “discussion with students about where they were getting their information about environmental issues, and talking about who owns and controls Univision.”

In addition to becoming more aware, being engaged in critical analysis and creating counternarratives, some respondents noted that their students had engaged in political, environmental, and social media activism. A high school science teacher mentioned:

My class was looking at environmental justice and one student took that information and used it for an English project she was working on and that project transformed into a petition to the city council to plant more trees as her contribution to offsetting pollution in the inner city.

Another science teacher reported about how his “students created social media campaigns to raise awareness about animals affected by climate change. Different groups created the ‘Puffin Dance’ and #peekatmypika to help their campaigns get going.” A kindergarten teacher wrote about her students creating a video with opinion posters for change they shared with their school community.

Activism can be enacted in multiple ways; some efforts are more explicit, like petitions and protests, while others are more subtle, such as creating alternative media. Teacher responses reflect their students’ activism related to social, environmental, and political issues materialized through local and issue-specific efforts.

In analyzing the responses, we found many encouraging and hopeful comments about how critical media literacy (CML) has helped teachers rethink their pedagogy and increase student engagement. However, the responses also highlight challenges for implementing CML, such as limited resources, support, and clarity about how to integrate it into the curriculum. An elementary teacher wrote about the scarcity of technology at the school and how that “makes it difficult to do anything around critical media.” From the answers to Question 7 (incorporating CML into my teaching is difficult), secondary teachers reported more difficulty teaching CML (35% VF/F) than elementary teachers (26% VF/F). This is another place where the potential for CML in the lower grades surfaced, since they seem to have less difficulty incorporating it than secondary teachers. The design of most elementary classrooms, which requires the same teacher to cover all subject matter to the same group of students throughout the day, opens the potential for integrating CML pedagogy through thematic teaching, project-based learning, or problem-posing pedagogy.

A first-year middle school social science teacher shared wanting to use more CML, but had little departmental and administrative support. An elementary teacher shared about an administrator who “is reluctant to have me teach how to be critical of all media.” Three responses focused on wanting more resources, instructional strategies, and school-appropriate material in order to be able to implement CML in their classrooms. These qualitative statements of lack of support can be seen in the quantitative responses to Question 10 in which respondents rated the statement: “I feel supported by people at my school when teaching critical media literacy”: 36% VF/F, 24% occasionally, 18% rarely, 6% never felt supported, and 17% not applicable.

The group that shared the most challenges for implementing CML consisted of five teachers who taught secondary math and science. Their qualitative responses broadly discussed the difficulty of integrating CML into their content and finding only limited application. One of these responses from a high school math teacher mentioned:

I remember how when I was in the [CML] class, it seemed all over the place. I was unable to fully find the purpose of the class and how we can use it in a math class. In a traditional math class, such as Pre-Calculus or Calculus, it was rather difficult to find ways to incorporate the idea of CML.

This same person also commented that once he began teaching statistics, he was able to find ways to integrate CML. Of the 34 math teachers who answered Question 7, 59% of them reported that incorporating CML into their teaching was difficult VF/F. This is about double the VF/F responses from the other subjects.

A high school math teacher saw the value in teaching students CML but limited its application to challenging students’ misinformation about math and who is or is not a mathematician:

Critical Media Literacy is pretty important for students, especially in an age where they’re exposed to various forms of media, a lot of which is very skewed in one way or the other, and usually takes a reductionist viewpoint of the issues it addresses. I try to use CML to help students understand the misinformation about mathematics, the nature of mathematics, and challenge stereotypes of who is or isn’t a mathematician (examples: Not all mathematicians are white or Asian, there are Latino and African/African American mathematicians, there are mathematicians from faith backgrounds, mathematics isn’t just about calculations, etc.).

Two additional respondents also acknowledged the benefits of CML but felt challenged by the additional work needed to integrate it into the curriculum. A high school science teacher shared:

When I took the Critical Media Literacy class, it felt like it was more geared towards the humanities and not necessarily for the sciences. While it would be great to come up with lessons that connect chemistry and critical media literacy, it is immensely time-consuming when I can’t find other people to brainstorm with.

Another secondary science teacher also felt CML was important but struggled to find ways to integrate it into the classroom:

It was a great shared learning space and I got a ton of inspiration from taking the class; however, it has been difficult to use CML when direct instruction does focus on the explanation of scientific concepts. That’s not to say it is impossible, it just does take one more step of planning and student buy in.

Researchers in Canada found that after teaching CML concepts and skills in a Language Arts methods course, their preservice teachers felt enthusiastic about teaching media literacy, but challenged when designing CML lessons ( Robertson & Hughes, 2011 , p. 51). Robertson and Hughes (2011) list five reasons why teaching CML was so challenging for their students: (1) when these preservice teachers were K-12 students, most did not experience CML lessons; (2) the majority of their mentor teachers did not teach CML or know much about it; (3) critical analysis practices are not easy; (4) few resources are available; and (5) some schools have little technology and technical support. These are many of the same challenges that our teachers reported.

Intent and Importance of Incorporating Critical Media Literacy

Numerous teachers wrote about how meaningful, vital, transformative, and important this class was for them. A high school science teacher shared that the critical media literacy (CML) class, “was transformative! I’m still working on ways to fully integrate what I learned, but I have had my students creating media ever since.” A middle school English teacher commented about how the CML class “gave us techniques, projects, lessons that we can incorporate in our classrooms. Teaching students how to be critical of information related through the media is highly important because student[s] gain that critical awareness necessary for a technology-based society!”

A desire to bring more CML into the classroom surfaced throughout many of the qualitative responses. When asked to indicate any additional comments, 16 out of 64 respondents (25%) expressed their intention to integrate concepts related to media literacy or CML. A high school math teacher who wrote about having students create ads to represent data in graphs stated, “I wish I could incorporate more. I’ll keep trying.” A kindergarten teacher commented, “I wish I had more time to engage my students in this topic. As I grow in experience and expertise, I incorporate it more and more. Teaching in urban areas is a challenge but I do find the ideas of the course to be valuable in the classroom.”

The data and voices of these teachers raise practical, theoretical, and policy implications for future work in supporting teachers in adopting a pedagogical approach that can ignite engagement, make learning relevant, and deepen critical thinking with media, technology, and all information. In order for this to happen, teacher education programs need to address some of the challenges and limitations highlighted in the study.

The teachers surveyed reported challenges for implementing critical media literacy (CML) such as limited access to resources, lack of support, and a struggle to understand how to integrate it into the curriculum. This was especially evident for the math and science teachers. CML courses need to help teachers in all content areas rethink the silo approach to separate subject matter instruction and recognize the ways literacy is used in all areas and how information is connected to students’ lives through issues of power, privilege, and pleasure. To help teachers integrate CML into the curriculum, it is important for them to see content and grade-level examples while also receiving ongoing support and resources.

One way to support teachers in various subject matter is to create groups or projects modeled after the Stanford History Education Group (SHEG) or the Center X professional development projects. 4 The SHEG is a research and development group that provides free online resources and lesson plans for history teachers to support students in developing historical thinking skills. In a similar way, the Center X projects provide resources, lesson ideas, and professional development to support working teachers and administrators, while also creating curriculum, providing trainings, and engaging in research. The creation of a CML project or research and development group could provide ongoing professional development for new and experienced teachers in order to sustain CML implementation and support the growth of CML as an important field of investigation.

In-service teachers in our survey reported higher rates of integration of CML, perhaps because experienced teachers have figured out issues of classroom management, lesson planning, and how to balance work and life expectations. As a result, they are better situated to build and expand their curricula and teaching practices to bring CML into their classrooms. While creating a site modeled after the SHEG or Center X projects will require a significant investment of time and money, a more immediate and economical way to provide support for preservice teachers could be through integrating CML across various teacher preparation courses, especially in methods classes. This integration would require working with teacher educators to explore the CML theoretical framework and co-construct new practices and curricula for integrating these ideas throughout different content areas.

Despite the challenges reported by our teachers, the data also suggest promising possibilities for CML. While we do not claim causality between their teaching and the CML course, the data provide a window into how our preservice and in-service teachers have supported critical engagement with the information, entertainment, and social media embedded in the lives of students.

The similarities between elementary and secondary teachers suggest that CML can be just as appropriate for lower grades as it is commonly assumed to be for older students. The work in critical literacy by Comber (2013) and Vasquez (2014) offers support for the notion that young children can engage deeply in critical thinking and social justice education. The elementary teachers in our study demonstrate these ideas through the work they have done to engage their young students with media analysis and critical media production from kindergarten on up. While some teachers reported deep levels of critical analysis more often than others, many expressed their belief in the importance of CML and their desire to teach about social justice. Vasquez (2017) reminds us that critical literacy should not be a topic to teach: “Instead it should be looked on as a lens, frame, or perspective for teaching throughout the day, across the curriculum, and perhaps beyond. What this means is that critical literacy involves having a critical perspective or way of being” (p. 8). Developing social justice educators who internalize a critical way of looking at the world and questioning systems of power is the project for which CML provides a pragmatic framework and pedagogy.

It is impressive to see the majority of teachers reporting that using CML encourages critical thinking, something more important than ever in the age of fake news and alternative facts. There is hope in the teachers’ voices as they describe the activities they have been doing with their students, the successes they have encountered, and the challenges they have struggled to overcome. The comments about their intentions to teach CML and the importance they attribute to teaching these concepts provide encouragement for teacher educators to embrace CML. More than anything, the data demonstrate the potential for teaching CML in elementary and secondary settings with preservice and in-service teachers and in all content areas, even though some are more challenging than others. The use of media and technology offers opportunities for teachers to build on students’ prior knowledge, create a bridge to connect the outside world with school learning, and provide the raw material to examine everyday experiences of power, marginalization, and resistance.

Simply integrating media into the curriculum is not enough to develop critical literacies given the changing and multiple literacies associated with new digital information and communication technologies and practices. In the contemporary moment, there is a pressing pedagogical need to navigate the increasingly consequential artificial intelligence (AI) systems that collect, collate, process, predict and disseminate information determined by algorithms. Data from the survey suggest that our teachers are teaching more with media than critically analyzing it. Further studies are needed in order to better understand how to develop teachers’ CML frameworks and support more implementation.

Preparing educators to teach CML is not easy, and unfortunately, few institutes of higher education are attempting the challenge. However, it is possible, and in fact, it can be highly rewarding. By listening to the voices of teachers who have taken a CML course, we see the potential. As one high school science teacher commented, “CML changed me, changed my teaching, continues to change my students.”

While information communication technologies are integrating into all aspects of our lives, we are also witnessing increasing divisions between the haves and have nots, out-of-control climate change, and the weaponization of information and media. In order to create a socially just democratic society and sustainable planet, we must have people who can critically read and write the word and the world ( Freire & Macedo, 1987 ). The need for CML has never been greater. A high school English teacher wrote, “there is no literacy without media literacy. There is not critical pedagogy without critical media literacy.” It is our hope that this article serves as a resource to continue exploring the potential that CML offers to transform students, schools, and society.

LITTLE ROCK, Ark. (AP) — A federal judge has ruled Arkansas cannot prevent two high school teachers from discussing critical race theory in the classroom, but he stopped short of more broadly blocking the state from enforcing its ban on “indoctrination” in public schools.

U.S. District Judge Lee Rudofsky issued a narrow preliminary injunction Tuesday evening against the ban, one of several changes adopted under an education overhaul that Republican Gov. Sarah Huckabee Sanders signed into law last year.

The prohibition is being challenged by two teachers and two students at Little Rock Central High School, site of the 1957 desegregation crisis.

In his 50-page ruling, Rudofsky said the state’s arguments make it clear the law doesn’t outright “prevent classroom instruction that teaches, uses, or refers to any theory, idea, or ideology.”

His ruling prohibited the state from disciplining the teachers for teaching, mentioning or discussing critical race theory — an academic framework dating to the 1970s that centers on the idea that racism is embedded in the nation’s institution. The theory is not a fixture of K-12 education, and Arkansas’ ban does not define what constitutes critical race theory.

Rudofsky said although his ruling was narrow, it “should give comfort to teachers across the state (and to their students) that Section 16 does not prohibit teachers from teaching about, using, or referring to critical race theory or any other theory, ideology, or idea so long as the teachers do not compel their students to accept as valid such theory, ideology, or idea.”

Rudofsky said his decision still would bar the teachers from taking steps such as grading on the basis on whether a student accepts or rejects a theory or giving preferential treatment to students on whether they accept a theory.

Both the state and attorneys for the teachers claimed the ruling as an initial victory in ongoing litigation over the law.

“We are very happy that the court has acknowledged that the plaintiffs have brought colorable constitutional claims forward,” said Mike Laux, an attorney for the teachers and students who filed suit. “With this notch in our belt, we look forward to prosecuting this incredibly important case going forward.”

David Hinojosa, director of the Educational Opportunities Project at the Lawyers’ Committee for Civil Rights Under Law — also representing the plaintiffs in the case — said the ruling “has essentially gutted Arkansas’ classroom censorship law to render the law virtually meaningless.”

Republican Attorney General Tim Griffin said the ruling “merely prohibits doing what Arkansas was never doing in the first place.”

“Today’s decision confirms what I’ve said all along. Arkansas law doesn’t prohibit teaching the history of segregation, the civil rights movement, or slavery,” Griffin said in a statement.

The lawsuit stems from the state’s decision that an Advanced Placement course on African American Studies would not count toward state credit during the 2023-2024 school year. The teachers’ lawsuit argues the state’s ban is so vague that it forces them to self-censor what they teach to avoid running afoul of it.

Arkansas is among several Republican-led states that have placed restrictions on how race is taught in the classroom, including prohibitions on critical race theory. Tennessee educators filed a similar lawsuit last year challenging that state’s sweeping bans on teaching certain concepts of race, gender and bias in classroom.

This resource also includes information on the laws banning critical race theory and racial justice discourse being enacted across the country and how they fit into a larger effort to suppress the voice, history, and political participation of Black Americans. 

Critical Race Theory, or CRT , is an academic and legal framework that denotes that systemic racism is part of American society — from education and housing to employment and healthcare. Critical Race Theory recognizes that racism is more than the result of individual bias and prejudice. It is essentially an academic response to the erroneous notion that American society and institutions are “colorblind.”

Critical Race Theory recognizes that racism is embedded in laws, policies and institutions that uphold and reproduce racial inequalities. According to CRT, societal issues like Black Americans’ higher mortality rate, outsized exposure to police violence, the school-to-prison pipeline, denial of affordable housing, and the death rates of Black women in childbirth are not unrelated anomalies.

The scholarly framework holds that racism goes far beyond just individually held prejudices, and that it is in fact a systemic phenomenon woven into the laws and institutions of this nation. A cursory review of U.S. history — or even just news headlines from 2020, where far too many examples of police brutality and violence against Black people propelled a historic racial justice movement — proves the truth of this theory. The classroom itself, currently the focal point of the ongoing fight to suppress uncomfortable truths about America, has traditionally been the site of some of this nation’s most egregious acts of state sponsored racism. This includes segregation, which theLDF has been at the forefront of challenging since our founder and the first Black Supreme Court Justice Thurgood Marshall successfully litigated Brown v. Board of Education   in the 1950s.

Critical Race Theory was first developed by legal scholars in the 1970s and ‘80s following the Civil Rights Movement. It was, in part, a response to the notion that society and institutions were “colorblind.” CRT holds that racism was not and has never been eradicated from our laws, policies, or institutions, and is still woven into the fabric of their existence.

Critical Race Theory should be embraced as a framework to develop laws and policies that can dismantle structural inequities and systemic racism. Building a more equitable future requires an examination of how the shameful history of slavery, caste, and systemic racism were foundational to laws and institutions that exist today.

  • Bans on any discussion or teaching that the United States is inherently or fundamentally racist. 
  • Bans on what legislatures have deemed “divisive concepts,” including white supremacy, male privilege, white privilege, equity, unconscious or implicit bias systemic racism. However, the bans lack context, definitions, or examples of the ways they are being taught.
  • Requirements to teach “without giving deference to any one perspective” and provide a counter narrative or opposing view of anything being taught.
  • Ban discussions of systemic racism and sexism that would “discriminate,” “hurt feelings” or make someone feel “guilty” about their skin color.
  • Drastic limits and funding cuts for anti-bias trainings and diversity and inclusion initiatives for students and teachers.
  • Provisions allowing the state to withhold funding for schools that violate the bans.

Former President Trump’s “ Executive Order on Combating Race and Sex Stereotyping” issued in September 2020 became the blueprint for states to craft their own bans on truth. Many of the same vague “divisive concepts” banned in the Executive Order reappear in current state legislation. Many state laws also include provisions that establish financial penalties for noncompliance and threaten to cut state funding of schools that disobey the bans.

In the Executive Order, former President Trump directed federal agencies to end trainings related to the discussion of inequality, critical race theory or other forms of what he labeled “propaganda.” It went so far as to establish a McCarthy-esque hotline for people to report on the behavior of others. A few months later, a federal judge later blocked the directive and the Biden Administration has since rescinded the Order.

Critical Race Theory is primarily taught at the secondary and post-secondary levels. However, many states have enacted laws banning CRT in elementary or high schools and laws that could restrict what students can learn and silence conversations about our history. These laws have already had a chilling effect .

Classrooms are again being used as a cudgel to silence the voices and deny the experiences of Black people and other historically marginalized groups in America. Many of these laws and measures effectively put severe restrictions on how American history and issues such as school segregation can be taught or even discussed in classrooms. Many of these measures broadly censor conversations about racism by framing the subject itself as “divisive” and “harmful,” and at least a dozen of these laws have already gone into effect. Even more worryingly, several state legislatures have a staggering and ever-growing   number of anti-truth bills. Several states and districts have begun banning books.

The term “critical race theory” has been co-opted by opponents as a catch-all and rallying cry to silence any discussions about systemic racism, ban the truthful teaching of American history, and reverse progress toward racial justice. The term has been unjustifiably used to include all diversity and inclusion efforts, race-conscious policies, and education about racism, whether or not they draw from CRT. Attempts to ban CRT are really attacks on free speech, on discussions about the truthful history of race and racism in the U.S., and the lived experiences of Black people and other people of color. 

Lawmakers and proponents of the bans insist they are advocating for a balanced and “patriotic” education. However, these bans do the exact opposite: deny the truth about our nation’s history, silence dissent, and punish those who speak the truth to counter whitewashed falsehoods.

After the historic 2020 election, which included record turnout among Black voters, states passed the strictest voting laws in decades. When millions of people took to the streets to protest police violence, states responded by passing laws criminalizing protest. Now, as individuals across the country, of all races and backgrounds, are coming to recognize the history of systemic racism and its ongoing impact, states are responding by attempting to silence discussions of these issues. The bans are part of a coordinated backlash to the realization of a true multi-racial democracy in America.

Bans on “critical race theory” are bans on truth and history. Critical Race Theory is not taught in K-12 schools. These laws seek to ban the teaching of a true American history and all of its racist elements. These laws ban virtually any discussions about how racism has shaped our nation’s policies and history- from education and housing to employment and healthcare. Ultimately, these laws are blanket bans on racial discourse and attempt to deny our nation’s shameful legacy of racial oppression. These bans are attacks on free speech that silence those who speak the truth about our nation’s history. 

The vast majority of school board members are elected officials who have power over school policy decisions, budgets, programming, resource allocation, curriculum, and faculty tenure. They have the power to vote down or institute school district policies, programs, and budgets. Currently, unprecedented numbers of mostly white parents are attending meetings to demand that school boards use their power to ban the teaching of so-called “critical race theory” in schools. 

Recent efforts to ban racial justice discourse are part of a long American history of backlash in response to demands for educational equity. Laws banning racial justice discourse are attacks on all students’ right to a fair, full, and truthful education about their country and their communities. Members of school boards must use their influence to resist bans on truth and defend the rights of teachers and students to discuss race in a classroom setting. Former President Trump’s Executive Order, and the attacks on racial discourse that followed, emerged after the publication of The 1619 Project by the New York Times. The landmark journalism series published in 2019 aimed to tell a more complete story of slavery’s role in shaping America and the lasting effects of enslavement. Many states specifically banned The 1619 Project as an example of “teaching or discussing that the U.S. is inherently racist.”

The 1619 Project was conceived by Pulitzer Prize-winning journalist Nikole Hannah-Jones. In April 2021, Ms. Hannah-Jones accepted the appointment as Knight Chair in Race and Investigative Journalism at University of North Carolina. In an unprecedented decision, the university’s Board of Trustees voted to deny her tenure. The decision was a clear retaliation against Ms. Hannah-Jones for her leadership on The 1619 Project and the result of a campaign by conservative activists to discredit her work. More broadly, it was an attempt to silence those who speak the truth about our nation’s history of race and racism.

LDF represents Ms. Hannah-Jones in connection with the Board’s failure to consider and approve the faculty recommendation of tenure.
