The Truth About Life Insurance and Funeral Expenses

It’s not uncommon for families to expect to pay for a funeral with life insurance benefits.

Sounds like a simple plan, doesn’t it?

The truth is, there can be many unexpected complications with life insurance policies . Some are no longer valid because no one has paid on them in years, and they have now lapsed. Some have beneficiaries named who are no longer living , which means delays and complications with getting your claim paid. The policy may have a lien on it. Or, the date of death or cause of death could limit the death benefit. Listing an ex-spouse or a minor as beneficiary is also a very common issue. In some states, an ex-spouse listed as a beneficiary will receive nothing unless the divorce decree specifically states that they should. More delays and complications. Any of these “red flags” could prevent you from using your policy for funeral expenses. Even if your policy is problem free, it may take 6 to 8 weeks to receive payment.

Additionally, have you carefully considered the amount of your life insurance policy? Aside from funeral expenses, what else do you want your loved ones to be able to pay for? Is your life insurance beneficiary a co-signer on your credit card bills, and therefore, liable to pay them? Would you want to pay off the mortgage on your home so your surviving spouse can stay there? Or, pay off vehicles or other large items? If your family members rely on your income, will they have enough to cover basic expenses until your income can be replaced? If you incur high medical bills before you pass away, they will be paid for by your estate (assets). Is your insurance policy amount enough to fill the potential loss in your estate’s worth? If you have not considered these secondary expenses, your family may have a hard time covering all the potential costs.

So, a simple plan isn’t so simple anymore.

Here are a few solutions that may help avoid complications with life insurance at the time of death:

Review Your Policies.

If you plan to use life insurance benefits to cover your funeral, check the policy and make sure it is still valid. If you have any questions, contact an elder law attorney. They will help identify any “red flags” in your policies and assist you in correcting them. Or, if you are in the midst of planning a funeral for a lost loved one, you can direct your questions to the funeral home. Please contact your life insurance company for specific questions about your policy.

Make Sure the Policy is Assignable.

When you review your policy, make sure it is “assignable.” You must be able to assign the benefits to go to a third party who will file the claim for you (the funeral home, or an assignment company). The type of policy you signed up for and the life insurance company determine whether a policy is assignable. Funeral homes generally accept a life insurance policy in lieu of payment for a funeral, though it’s best not to assume that they will. Remember, if they do accept a policy as payment, it must be assignable. Retirement benefits and 401(k) benefits are not assignable. If the policy is not assignable, families will be unable to use life insurance to cover funeral costs. This is in large part because insurance companies can take at least 6 to 8 weeks to process a claim. Typically, this is long after the funeral has taken place.

Use an Advance Funding Company.

Some funeral homes partner with advance funding companies (also called an assignment company). Similar to a tax return advance you might get from your tax preparer, advance funding is an advance on your life insurance policy benefits. In short, an assignment company contacts the insurance company and verifies that the policy has not lapsed and has no other issues. Funds are advanced within 24-48 hours once the verification process is complete. The best part is, your claim is filed for you, and any funds in excess of funeral expenses can be advanced right to you. The assignment company will deduct a small fee to cover administrative costs.

Take Care of Any Issues Before Death Occurs.

It’s hard to deal with the financial assets of a lost loved one. If there is no clear heir, the courts will likely probate the estate. When an estate is probated, it means that the court system must approve the validity of a last will and testament and confirm the appointment of the executor. This process can sometimes be lengthy and incur additional costs. You will make it much easier for your heirs to inherit your assets according to your wishes if you create a will and update the beneficiary information on your policies regularly.

How to pay for a funeral with life insurance.

Paying for a funeral can be incredibly expensive, even if it's a funeral that's expected and has been planned for in advance. Knowing what your options are when it comes time to fund the funeral can help ease your financial burden, especially if there's life insurance involved. If you're the beneficiary of a life insurance policy, here's what you need to know about how to use it (or not use it) when paying for a funeral.

How to pay a funeral home with life insurance proceeds

If you're the beneficiary of a life insurance policy, you are able to fill out what's known as "an assignment form". This form will essentially make it so that proceeds from the life insurance policy go directly to the funeral home, which they will use to settle the cost of the funeral.

Once the cost of the funeral is covered, all remaining proceeds are then returned to you (the beneficiary). Most often, the funeral home will have the documents needed in order to facilitate this but it's always important to double check with your funeral home first. If you're at all concerned, you can also check with the company who is in charge of the policy.

Here's a step by step guide:

  • Contact your funeral home of choice and ask what their policies are and ask if they allow assignment of life insurance to the funeral home. If they say yes and you're working with them to handle the services of the deceased, make an appointment to go in and visit them.
  • If you’re unsure about anything, check with the life insurance policy company to answer any questions you may have about your policy.
  • Visit the funeral home and complete the assignment forms -- these forms will be used to allow the funeral home to cover funeral expenses straight from the life insurance policy.
  • Once the funeral expenses are paid out by the policy, the rest of the funds are returned to you, the beneficiary.

Does the beneficiary of a life insurance policy have to pay for the deceased funeral cost?

First, let's envision a scenario in which you're the beneficiary of a life insurance policy but you don't want to be responsible for the funeral expenses. Perhaps the funeral expenses are already being covered by another party or you simply do not want to cover the funeral expenses for personal reasons. Do you have to cover the funeral costs as the beneficiary of the life insurance policy?

The answer is no, you are not required to cover or pay for funeral expenses as the beneficiary of a life insurance policy. The proceeds you receive from the life insurance policy are not considered to be part of the deceased's estate and instead go directly to the stated beneficiary.

If there isn't a named beneficiary on the policy, the estate will then receive all proceeds from the life insurance policy. In this scenario, these funds could then be used to pay for funeral expenses.

Does life insurance have to pay debt?

Life insurance does not have to be used to pay debt unless it belongs to the estate (as in, no beneficiary was listed on the policy). If you're the beneficiary of a life insurance policy, you do not need to use the funds to cover the deceased's debt unless two of the following scenarios are present:

  • You and the deceased have shared debt.
  • You have your own debt to pay.

Technically, you're able to use life insurance proceeds as you wish, but if you have outstanding debt and creditors are trying to collect, your life insurance proceeds are considered fair game. Some states do have exemptions regarding this, so you'll want to make sure to check with a financial expert if you fall into either of these two categories.

How to reduce funeral costs

While you may be the beneficiary of a life insurance policy, that doesn't necessarily mean that you want to (or have to) spend all of your proceeds on covering funeral expenses. There are plenty of ways to reduce costs when it comes to funerals, especially if you know where to look. Here are some ways you can save on funeral expenses and lessen any financial burden:

  • Buy online. Buying funeral products online can easily save you thousands of dollars. The best part is, the funeral home is required (by law!) to use whatever product you purchase, even if it's not from them.
  • Only buy what you need. If you've never planned a funeral before or had to deal with funeral homes, you may feel pressured when speaking with them to purchase packages or services you're not in need of. Go in there knowing what you want and if you aren't sure, ask them to explain all of the services that will be billed separately. When you're ready, get an itemized list and pick only the services you know you need.
  • Hold the services yourself. Organizing the services yourself (such as a memorial service at a church, for example), can help you avoid the fees charged by funeral homes to host the service. Read this guide on how to plan a memorial service if this is your first time.
  • Opt for direct cremation or direct burial. Direct cremation and direct burial are the cheapest methods of disposition as they don't have viewings included.   • Check with local charities or religious organizations. You may be able to find a local religious organization or non-profit that can help cover funeral costs.

The overwhelming feelings of despair, disbelief, shock, and numbness caused by the passing of a loved one cannot be conveyed by mere words. Even when the death is expected, the pain that loss brings can still be devastating.  In truth, no one is completely prepared for the death of someone close to their heart.

During this difficult time, there are decisions to be made immediately, arrangements to be coordinated, and a lot of things to be considered for your loved one’s final farewell. We understand how this may feel overwhelming, especially with the grief you’re feeling over the loss. Please know that we are here to help and support you. 

On this page, we’ve put together helpful information to guide you through this process.

NOTIFY PROPER AUTHORITIES

If your loved one passes away while under the care of a facility — such as a nursing home or a hospital — staff from the facility will contact you and notify appropriate authorities themselves.

If the death occurred in the workplace or at home, you will need to get in touch with his/her physician or emergency medical personnel, as the cause of death must be identified and indicated in legal documents.

In the event that no one was present at the time of death, you will need to contact the police before moving the deceased to another location.

CALL THE FUNERAL HOME

Our caring funeral director can assist you with your funeral arrangements. We will collect information from you in order to facilitate the transfer of your loved one’s remains to our facility. You would also be asked if the deceased has made pre-arrangements and whether or not you’d like for him/her to be embalmed. While of course you can ask any questions you have in your mind during this call, note that once you visit the funeral home, we can discuss the arrangements in greater detail.

During this call, you’ll also be informed about the things that you need to bring with you like the clothes your deceased loved one will use for the burial. Feel free to call us whenever you feel the need to. Remember that we are here to listen to you, help you, and guide you during this difficult and trying time.

MEET THE FUNERAL DIRECTOR/STAFF

On your first meeting with us, we will discuss the arrangements for your loved one’s burial. You will be shown a list of our packages/services so you can decide what suits your family’s preferences and budget. You will be asked whether you’d prefer burial or cremation arrangements and optionally you would select a casket, schedule a time and date for the services, decide on the location of the burial, draft an obituary notice, arrange for vehicle services, and select pallbearers.

Colleagues mourn CT Police Trooper Pelletier: We have ‘senselessly lost a great hero’

A s law enforcement leaders and officials from across Connecticut posted tributes Friday to Trooper First Class Aaron Pelletier , a small band of police in Hartford recalled memories of when he served on a regional task force targeting narcotics gangs and violent criminals.

“He stood out. He was young, he had a really good work ethic, he was charismatic — he had the personality where everybody got along with him,” said Hartford Detective Abhilash Pillai, who worked with Pelletier for more than a year on the FBI’s Safe Streets Task Force.

Pelletier, a 34-year-old husband and father of two young boys, was killed Thursday afternoon while doing a routine traffic stop along I-84 in Southington. An allegedly intoxicated driver veered partly onto the highway’s shoulder and hit Pelletier, who had gotten out of his patrol car to talk with a motorist he’d pulled over for a seatbelt violation, according to police.

Pelletier was hit at 2:36 p.m., and leaders in Southington — where he lived — are asking for a moment of silence in his memory on Monday at 2:36 p.m.

Gov. Ned Lamont ordered state flags to half-staff until Pelletier’s funeral, saying “This is a tragic reminder about the dangers law enforcement face every day when they leave their homes and go to work. Trooper Pelletier served Connecticut with honor, integrity, and commitment, and he embodies the definition of public service. His courage and bravery will never be forgotten.”

State police closed part of I-84 Thursday evening for a procession to bring Pelletier’s body to the state medical examiner’s office in Farmington.

At mid-day Friday, a long procession of troopers in silver Ford SUVs took part in a procession accompanying the body from the medical examiner’s office to a Southington funeral home. Local roads were lined by police from multiple towns around the state.

U.S. Sens. Chris Murphy and Richard Blumenthal along with state agency commissioners, police chiefs, prosecutors and police unions posted social media messages of condolence for Pelletier’s wife, Dominique, two sons and other relatives.

At a press conference Thursday night, Lt. Gov. Susan Bysiewicz described Pelletier as thoroughly committed to duty.

In an agency of more than 1,100, Pelletier had already gotten the attention of the state’s second-in-command: She told of how he had once checked her official car — a state vehicle driven by another trooper — to be sure seatbelts were being worn.

“Others on our detail who knew him were laughing about it later, but laughing because they knew he was very dedicated and he’s stopped the lieutenant governor just to make sure she was wearing a seatbelt,” Bysiewicz said.

A state trooper since 2015, Pelletier was building a notable career. He was trained as one of the agency’s canine handlers, and had been chosen in 2018 to conduct a ride-along with WTNH to publicize automated license plate readers in patrol cars.

Most recently Pelletier was assigned to Troop H in Hartford, and on Thursday morning was working overtime in a highway safety initiative that involved making traffic stops along I-84.

Just a few years before that, Pelletier had been picked for a high-impact, high-risk assignment: The FBI’s regional Safe Streets task force in Hartford. In that role, he earned the respect of supervisors and senior investigators.

“We chase violent offenders, suspects in homicides and shootings, violent offenders,” Pillai said. “We have a variety of cops from different towns and the FBI, so personality is important on the task force. And a second thing is work ethic. He wasn’t afraid to write a report or search warrant, he wanted to learn, he respected seniority and he asked questions.”

Colleagues said anyone who worked with Pelletier went away with a good impression.

“Trust was never an issue with him, he was a really eager young trooper and ready to go,” recalled Hartford Detective Jeff Moody, another task force veteran. “He always had our backs.”

Moody and Pillai described Pelletier as reliable and versatile, thoroughly competent at the wide range of skills needed for short- and long-term investigations of violent gangs and narcotics dealers.

Pelletier had just three years on the job when he was selected for the competitive assignment in October 2018, and he stayed for 2 1/2 years. At that point, his youngest son was just a baby and Pelletier wanted to return to the state police as a canine officer, colleagues said.

FBI Supervisory Special Agent Joseph Altimari, who heads three Safe Streets task forces in Connecticut, said Pelletier had a top-level reputation with the FBI agents, state troopers and local police who were with the task force at the time.

“For our criteria, you have to be a proven officer in good standing to even be considered for a role like this,” Altimari said. “You have to have the high moral character, you have to pass a background investigation be able to make the cut. It’s competitive.

“In talking with all my folks, they say he was among the best. You have to be dedicated to the mission of the task force. He was also extremely family oriented. We considered him a member of our family, and this was a huge loss to us. He was one of the finest.”

Police across the state have attached black mourning bands across their badges.

“Aaron was a great trooper and a dedicated family man, and quickly became a part of our Hartford family,” Hartford Police Chief Jason Thody said Friday. “Our law enforcement community has, once again, senselessly lost a great hero.”

The man accused of killing Pelletier, 44-year-old Alex Oyola-Sanchez of Zion Street in Hartford, was held overnight in lieu of $5 million bond. A judge on Friday reduced that to $1.5 million and directed he be jailed until his next court appearance June 6.

Pelletier was killed soon after pulling over a motorist for failing to wear a seatbelt along eastbound I-84 in Southington. Police said Oyola-Sanchez was in the right lane driving under the influence when his pickup truck drifted toward the highway shoulder and hit Pelletier.

Oyala-Sanchez then tried to keep driving but was stopped near Exit 39 in Farmington, police said.

In court Friday, a bail commissioner reported that Oyola-Sanchez has no criminal record in Connecticut, but was convicted in Puerto Rico of third-degree murder in 2007 and convicted of three counts of attempted homicide there the next year, CT Insider reported .

Troopers charged Oyola-Sanchez with driving under the influence of alcohol or drugs, second-degree manslaughter with a motor vehicle, failing to drive in the proper lane, evading responsibility in a case involving death, failing to renew registration, driving without minimum insurance and failing to move over for an emergency vehicle.

Connecticut State Police said just one fundraiser for the family will be organized, one “created by TFC Pelletier’s brothers and sisters at Troop H, and has been approved by the Pelletier Family.” All proceeds go directly to Pelletier’s family. Ukraine-Russia war latest: Moscow warns it could go to war with NATO over US move - as Germany follows Washington in approving strikes inside Russia with its weapons

Germany has followed the US in approving strikes inside Russia using its weapons - as Moscow warns the moves could cause a war with NATO. Meanwhile, Ukraine reportedly launched a large missile and drone attack overnight.

Volodymyr Zelenskyy has wrapped up a flurry of negotiations in Sweden and signed long-term security deals with Norway and Iceland.

Earlier, we reported that the Ukrainian president had struck an agreement while in Stockholm (see 13.26 post).

Now, Mr Zelenskyy has signed a 10-year deal with Norway, through which Oslo will focus on supporting Ukraine's maritime and air defence needs.

Norway would be "open" to the Norwegian defence industry localising production in Ukraine under the deal. Iceland has also committed to a 10-year pact.

The new agreements mean Mr Zelenskyy now has 15 written pacts with Western nations, including all five Nordic countries - which are all NATO countries.

He previously agreed security pacts with Denmark and Finland in February and April respectively.

Sweden's agreement means Stockholm will transfer two ASC 890 surveillance aircraft as well as its entire stock of armoured tracked personnel carriers.

Swedish Prime Minister Ulf Kristersson said earlier: "You are literally fighting not only for your own freedom but also for our freedom and our security."

A Russian-American journalist will be detained until at least 5 August ahead of an investigation and trial.

Alsu Kurmasheva, an editor for the US government-funded Radio Free Europe and Radio Liberty’s Tatar-Bashkir service, was taken into custody on 18 October.

She's been charged with failing to register as a foreign agent while collecting information about the Russian military.

Later, she was also charged with spreading "false information" about the Russian military.

Ms Kurmasheva told reporters she suffered from various health conditions which could not be properly treated in detention. 

She also said she had last heard her children's voices in October, and held up two children's drawings for reporters which she said had been sent to her and had lifted her spirits.

She was the second American journalist detained in Russia last year, after Wall Street Journal reporter Evan Gershkovich.

He was arrested on espionage charges in March. A year later, President Joe Biden said  the US was "working every day"  to secure his release.

Volodymyr Zelenskyy has said Russia is trying to disrupt Ukraine's peace summit in June by blackmailing world leaders.

Speaking in Stockholm after signing a security pact with Sweden, the Ukrainian president said: "The most important thing right now is the peace summit. It should become a truly global summit.

"At this moment, we already have about 100 states and international organisations that will participate in the summit, but Russia is blackmailing some leaders and trying to block the participation of some countries."

Earlier, China's foreign ministry spokesperson defended Beijing's refusal to attend the summit - held 15-16 June in Switzerland - which Russia is not invited to.

Mao Ning insisted its demands for an international peace conference that is recognised by both Russia and Ukraine are "fair" and "impartial" (see 10.53 post).

Kremlin spokesman Dmitry Peskov later said China's decision shows Beijing understands that holding a peace summit without Russia would be futile.

Mr Zelenskyy also said it's "a question of time" before Ukraine uses Western weapons to strike targets inside Russia (see 13.26 post).

The Kremlin has dismissed France's refusal to invite Russian officials to events commemorating the 80th anniversary of the D-Day landings in the Second World War.

Yesterday, the French presidency said Russia would not be invited next week over what Paris called "Moscow's war of aggression" against Ukraine.

Despite Vladimir Putin and officials accusing the West of trying to "erase" Russia's contributions to the war effort, Kremlin spokesman Dmitry Peskov said Moscow was planning for next year's Victory Day.

He said "next year, you know, is an extremely important year for us", as it marks 80 years since the Soviet Union defeated Nazi Germany.

"This is our main priority in terms of memorial actions."

Earlier this week, Russia's foreign ministry spokeswoman Maria Zakharova accused Western countries of presenting D-Day as "the main event that decided the outcome of World War Two".

She said: "Of course, nothing is said in the West about the fact that no landing in Normandy would have been possible without the successes of the Red Army. 

"They are trying not only not to remember, but to erase it."

Kremlin officials have today been issuing various statements - including dire threats of war with NATO - in response to Western powers' decisions to let Ukraine use weapons they have supplied to attack inside Russia.

But Jens Stoltenberg, the military alliance's secretary-general, has dismissed the threats and insisted NATO was simply helping Kyiv defend itself.

"This is nothing new. It has… been the case for a long time that every time NATO allies are providing support to Ukraine, President Putin is trying to threaten us to not do that," he said in Prague.

"And an escalation – well, Russia has escalated by invading another country."

Citing Russia's northern offensive against the Kharkiv region in Ukraine, Mr Stoltenberg added: "Ukraine has the right for self-defence, we have the right to help Ukraine uphold the right for self-defence, and that does not make NATO allies a party to the conflict.

"That was the case back in February 2022, that was the case last year, that remains the case."

Ten foreign ministers, including Lord Cameron, are demanding North Korea stop supplying weapons to Russia.

Earlier this month, Russia dismissed claims it was working with Pyongyang on military matters and said the relationship between the countries was not a threat to others.

But the ministers say Russia is using North Korean arms transfers "to strike Ukraine's critical infrastructure, prolonging the suffering of the Ukrainian people".

They also called for North Korea to end its nuclear weapons programme.

Yesterday, North Korea fired a barrage of ballistic missile to show it is willing to strike South Korea's "gangsters' regime" pre-emptively.

Meanwhile, some of the officials are in Prague for a two-day NATO summit, where they've discussed allowing Ukraine to use weapons they have supplied to strike inside of Russia.

Germany announced it will allow Kyiv to do so, to the anger of Russian officials (see 10.30am post).

Earlier, we reported that Ukraine and Russia had carried out their first prisoner swap since February (see 13.05 post).

Now, Ukraine's defence ministry has shared a video of freed prisoners singing Ukraine, originally by Taras Petrynenko, as they're brought back home.

Leading the sing-along is Kostyantyn Myrhorodskyi, who was in Russian captivity for more than two years.

Some of the men with him on the coach can be seen weeping as they are overcome with emotion by the moment. 

US Secretary of State Antony Blinken has confirmed Joe Biden approved for US weapons to be used inside Russia. 

Speaking to reporters in the Czech Republic following a meeting of NATO foreign ministers, Mr Blinken said Ukraine asked for authorisation to allow its forces to defend itself against Russian attacks, particularly in the city of Kharkiv.

The meeting of NATO foreign ministers comes before a summit in Washington from 9 -11 July. 

Mr Blinken said during the summit, "concrete steps" will be taken to bring Ukraine closer to NATO and the US will "ensure there's a bridge for Ukraine to NATO membership".

He said the summit is happening at a "pivotal time" when Russia is intensifying its attacks against frontline regions in Ukraine.

After last night's missile strike on a block of flats, Russia's defence ministry says it has carried out 25 attacks in Kharkiv.

According to the Interfax news agency, the strikes were carried out between 25 May and 31 May with precision-guided weapons, and targeted Ukrainian military facilities.

The ministry adds Russian troops are advancing in several directions - and have captured two villages - Berestove and Ivanivka - in the Kharkiv region.
