Introduction

According to Kuehn (4), “divorce is a legal process that ends a marriage.” Divorce can also be described as a period when families fail to overcome the major changes they experience. It is often associated with a disagreement between couples. Many people consider it an inappropriate way of solving problems. However, I completely disagree with the statement “if I were to get married, I would never consider divorce to be a viable option for any reason.” I think it is right for a couple to divorce if they think they are not compatible with each other.

Role of love in a relationship

I believe that love is the fundamental element of any serious relationship, that is why no one on earth can withstand a loveless relationship. Love makes marriages grow strong. It enables couples to share views and ideas, hence enhancing individual prosperity. On the other hand, the absence of love contributes to the deterioration of many relationships. The absence of love leads to a misunderstanding that results in a lack of communication between partners (Seiden and Billett, Chapter 2).

Evidence also points to the fact that people without affection portray uncouth behavior. For instance, people who do not love each other indulge in occasional quarrels and wars. The absence of love also makes many people avoid discussions of relationships, which affects the ability of partners to solve disagreements. Relationship discussions aid couples in learning the differences between them (Seiden and Billett Chapter 2). Thus, it is crucial for parties that do not love each other to divorce to avoid turmoil in marriage.

Antisocial behavior

It is challenging and unbearable to withstand any antisocial behavior from anyone, including the partners. I also agree with Emery Robert’s (42) argument that parental antisocial behavior contributes immensely to divorce. Occasionally, most people marry to have companions with whom they can share personal issues. However, some people tend to avoid socializing with their partners after some periods of marriage. Lack of socialization in a marriage is often associated with the discomfort that makes many married people involved in activities that may result in betrayal and exposure to some diseases.

Some marriage partners are also very secretive of their lives, aspirations, and medical conditions that may affect their union. On most occasions, lovers end up in marriages without informing their partners of their sensitive issues. Confiding in a person reluctant to share anything with his partner is dangerous since, on most occasions, it may make another party get into trouble. Thus, it is crucial for a couple that does not socialize freely to divorce.

Marriage cheating

I doubt if there is any person on this earth that can withstand cheating in marriage (Clarke-Stewart and Brentano 5). Bearing cheating of a partner in a marriage is not accepted worldwide. Cheating in marriage can result in the transmission of deadly diseases such as AIDS among partners. It leads also to the diversion of not only love but also resources as most people that cheat in marriages neglect their family responsibilities. I also believe that most cases of unfaithfulness are caused by emotional affairs. On most occasions, people who lack self-control indulge in affairs that may lead to family problems (Seiden and Billett Chapter 2).

Additionally, some people hurt their partners by expressing love and care for their former spouses. Thus, it is crucial for a person who is cheated on to seek a divorce to avoid heartbreaks and contraction of sexually transmitted diseases.

Effects of emotions

According to what takes place in many societies, it is very difficult to associate freely with emotional people. Emotional people are used to quarreling and disagreeing with everything and everyone in society. They have also a tendency of taking everything, including even jokes, very serious. On most occasions, they cannot differ jokes from personal abuse, and their habit of being too secretive also worries very much. However, most people are unaware of the emotional state of their partners as they marry them and find out about the latter after living with them for some time. Since it is difficult to stay with an emotional person as a wife or husband, it may be better for one to seek a divorce in such a case.

Difference in likes

I also believe it is very difficult for persons with different likes to stay together; the difference in likes between married individuals leads to confrontations and mental tortures. They also make married people not only perform activities differently but also disregard each other’s opinions. Thus, it may be a way-out for the parties involved to divorce in such a situation to grant themselves and their children an opportunity of advancing in life.

I know it is very difficult for any person to build a family and plan his/her future with an immature person as a spouse. Immature people are often associated with immature actions. In addition to making the wrong decisions, they also indulge in shameful activities. Immature people also love being supervised, which is an activity that is very difficult to implement. Additionally, it is very difficult to come into agreement with immature persons because of their childish decisions and opinions. If a person marries immature individual hope that his/her partner will change, he may be disappointed because, as a rule, his/her spouse may change, but he/she may not like it. Thus, such people should seek a divorce in case they cannot bear the immaturity of the partner.

It is also evident that none will tolerate having a drug abuser as a wife or a husband. Drug addicts make their families suffer from violence. Additionally, most drug addicts are hard not only to manage but also to share ideas with. Thus, it is crucial for a partner who is exposed to abuses in a family to seek divorce.

Social differences

I believe it is hard for people from different backgrounds to build a family because any family requires a solid foundation, i.e. material basis. That is why people having different social statuses may face the great challenge of accepting the differences in education, views, etc. Additionally, the family members and in-laws from a low stratum tend to be problematic. Thus, the marriage of such people may be broken by the inability to accept social differences and go through economic challenges.

In conclusion, divorce is a societal lawful process that takes place between disagreeing partners in a marriage. These differences are mainly caused by variation in ideas and likes. Loss of love, cheatings, emotions, and immaturity have also been found to trigger divorce. Most people also end up in divorce because of drug abuse and lack of communication as a result of antisocial behavior. The majority of people consider it an inappropriate way of solving marriage problems. However, most of the marriage problems are beyond human ability and owing to the reasons mentioned, I completely disagree with the topic “if I were to get married, I would never consider divorce to be a viable option for any reason.”

They were certainly so in mine, in which several intervening factors complicated the ability to develop effective psychological coping mechanisms. I was nine years old when my parents got divorced. The divorce was not due to mutual consent or irreconcilable differences but the fact that my mother had an affair with my father's best friend, subsequently leaving the country. Being abandoned by my mother has had lingering effects on my psyche, impacting my ability to form intimate relationships and to trust others. Using my example, it is possible to evaluate the developmental, environmental, cultural, and systemic issues at stake during a major family trauma like divorce. The study also points out how an individual can cope with a divorce situations to prevent adverse psychological impacts. The research is an important step in investigating psychological aspects of divorce, and it will help find solutions and strategies of avoiding divorces.

Introduction

According to Wilson (2009), the termination of a marital union is what can best describe the term “divorce”. It involves canceling of responsibilities and reorganizing legal duties that have concerned a marriage; hence, dissolving bonds of matrimony between married spouses is under the rule of laws that govern a marriage under the Matrimonial Act. The primary reasons for a divorce are the lack of independence, personality clash, and insufficient sex. It requires a rigorous legal process that involves the issues of alimony, child custody, and child support, parenting time, division of debts, and the distribution of property.

Self-Assessment: Barnes-Vulcano Rationality

The Barnes-Vulcano rationality helps to assess the degree to which a belief is true to an individual. In my assessment about the cause of a divorce using the BVRT test, I had a score of 139 in the category of the lack of communication as the major cause. The score implies that the main cause of my divorce is communication. When the latter fails, the marital union is always bound to fail too. For a good relationship to survive, each party must be free to express his or her feelings regarding personal issues. By a matter of fact, each person is brought up in a different environment by different individuals. Therefore, character traits differ to the disadvantage of the other individual (Wilson, 2009). A lot of people suffer from a narcissistic personality disorder, whereby a person has got a sense of own importance and completely lacks empathy for others. The disorder causes a lot of problems in many aspects of life, be it at school or work, in financial affairs and mostly marriages.  A narcissistic person is disappointed or unhappy most of the time, if not admired or a special favor is not accorded to the individual. A marriage requires tolerance due to conflicting personality traits and behaviors. If any conflict is to arise, communication is important. Issues like planning or raising children, money management, job opportunities, and religion must be solved through a healthy dialogue and communication (Noller, 2002, p. 33). Financial issues are another reason for a divorce, but I did not have a high score in the BVRT test. My score was 130, and this implies that the result is negative. They can be due to budget problems, unavoidable debts because of a bad spending habit of an individual, and a reduced or low income. When a couple struggles to survive due to low finances, it will indeed lead to a conflict in the marriage and finally a divorce. Another common cause of the latter is cheating or infidelity. When one partner realizes the other is not faithful in the relationship, it will breed hatred and the need for separation. There is also the feeling of betrayal and insecurity due to a significant probability of getting sexually transmitted infections and HIV. Infidelity also lowers the self-esteem of an individual and the social standing of both parties (Wilson, 2009, p. 45).

Narcissistic Personality and Divorce

People with the narcissistic personality disorder are more likely to become victims of a divorce as compared to others. They have arrogant traits of character, need for admiration, and the lack of empathy for other people. The traits of a narcissistic personality do not provide an ample environment for creating relationships. Narcissistic people are self-centered, demanding, and manipulative, and it makes them unsuitable for a marriage. In most cases of divorce, one of the partners has characteristics of a narcissistic personality. The narcissistic personality disorder is a natural characteristic, and, therefore, it is very difficult for an individual to change. Most of the divorces, involving people with the narcissistic personality disorder, are influenced by very petty issues that can be solved through a dialogue. Narcissistic people always believe that they hold the best opinion, but it is not possible in a marriage because partners are expected to listen to each other and make decisions collectively. Women are more affected by the narcissistic disorder than men are. In most cases when a man has such a disorder, the marriage has a higher chance of surviving than in situations when a woman is a victim. After a couple has divorced, a wide range of effects will certainly occur. However, they will differ depending on personal circumstances of each party. As it has been mentioned earlier in the essay, men, women, and children suffer from consequences and effects of divorce differently. In most cases, the couple experiences sadness, anger, guilt, anxiety, low self-esteem, loneliness, and isolation. The above feelings are unavoidable after a divorce has been filed to the time of its completion. It also adds other roles and responsibilities in case there are children to be cared for. In the process of divorce, being a tedious legal procedure, lawyers must be used. Expenditures will eventually lead to financial losses, as both spouses will have spent money on legal matters before dividing their property. Hence, both parties will lower their standards of living. As a result, children suffer psychologically more as they lack parental guidance (Wilson, 2009, p. 56). They cannot make choices of their own relating to the question with which parent they are going to live. They also suffer from prejudices on the part of those children who come from a family with both parents.

Social Thinking and Social Influence

Divorce has an impact on social thinking. One of the social influences of divorce is that children also undergo psychological problems. Most of them have problems in choosing the parent to stay with. Children may also face psychological problems as communication between parents and children reduces. The relationship of children with other people in society changes because they isolate themselves from the public. They stop performing their routine chores in society. A divorce may affect the children’s marital life, whereby they will not feel comfortable in any marriage. Ladies fear getting married because of the challenges they have seen from the example of their divorced parents. Young men are very brutal, and this makes their marriage life very complicated (Noller, 2002, p. 68).

Psychology and Physical Health of the Divorced Partners

A divorce has a significant impact on the psychological and physical health of the affected couples. Due to modern life hassles, frustrations, demands and deadlines, stress caused by a divorce has a significant effect on the couple concerned, though it is sometimes important as it helps a person to perform under pressure and gives motivation for one to do his or her best. The best way to overcome stress due to a marriage breakup is recognizing the signs and symptoms associated with it. In most cases, stress due to a divorce is divided into four major types, namely, cognitive, emotional, physical, and behavioral. The most common is emotional, which includes instability, agitation, feeling of being overwhelmed, and depression. The major cognitive stress symptom is constant worrying, memory problems, pessimism, and a poor judgment. It is not easy when a divorce happens. The breakup of marriage will trigger unsettling feelings and lots of pain. Divorces do not only represent a loss, but shared dreams and commitments are also shattered. When people are faced with a divorce, it is good to recognize different feelings, take a break and share feelings with a family and friends, as they are the best to assist and help get through these stressful moments. Divorcing couples should also have knowledge of the locus of control as in many cases, a divorce is an event that one single individual cannot control. It is an external locus of control (Myers, 2004, p. 78). Coping up with a divorce is not an easy task. Marriages involve many sacrifices on the part of the two partners, and, therefore, the divorce will be one of the most complicated incidences in their life. One of the strategies of coping with stress is having psychological counselling. A person should get counselling from a marriage expert to reduce stress that comes because of a breakup. The two partners must get an advice on how to interact with children and withstand pressure from society and relatives (Lerner, 2009, p. 97).

Self-Assessment and Monitoring

The most crucial method of coping up with stress is assessing and monitoring oneself through the divorce period. One of the mechanisms to assess and monitor oneself is trying to accept the divorce. Most people suffer from it because they do not accept that their marriage has come to an end. Women and men will try to fight for their marriage through legal or physical battles, but these will only worsen the situation. Psychologists argue that a person must be given adequate time to think about his or her decision without any external influence. Partners should stay away from each other so that they can reduce the effects of the divorce (Amos, 2002, p. 134). Another strategy of coping with the divorce effects is communication. It is very effective in solving any kind of disputes. Partners who have gone through a divorce should find time for each other so that they can ease their mutual pain. A divorced couple can be in a love relationship without living together. Instead of a divorce, most partners may chose separation. Most of the problems in marriages arise because of the daily interaction between the wife and husband (Wilson, 2009, p.63). Communication between divorced people helps them to look back at their differences, and this can give them ideas about living together in a happy life. Most divorces arise because some partners do not understand each other well, and this is a very serious challenge for most families. The most important thing for all married people is to understand their partners, and this can be achieved through communication only.

Self-Disclosure: Friendship and Love

When faced with a divorce, it is good to perceive it in a healthy way with different feelings, give oneself a break and share feelings with a family and friends, as they are the best to assist to get through a trying moment. Divorcing couples should also have knowledge of the locus of control as in many cases, a divorce is an event that one single individual cannot be able to control. It leads to social avoidance and social distress; this is mainly because society judges the divorced couple harshly by blaming them why they have not managed to preserve the marriage (Clarke-Stewart & Brentano, 2006). As far as personal experiences are concerned, self-monitoring has helped me to cope with the divorce situation, as I understand that human beings must differ in ideas. It has helped me to regulate my behavior to accommodate to social situations and avoid distress and social avoidance. I try to do my best in the situation I have found myself in by utilizing my time and energy in meaningful activities.

Marriage and divorce are common experiences faced by majority in the population. Healthy marriages are essential for the mental and physical health of couples. In the western cultures, 90% of the population marries by the age of fifty years. However, marriages, in the recent years are facing a lot challenges due to various misunderstandings between the couple or failure to understand what a marriage requires either of the individuals to do. Therefore, divorce has become a common experience to many people as the only way out of the problems being faced in marriages. There are different types of marriages; traditional marriage, Christian marriage and civil marriage. The Christian marriage entails the couple to abide by what the Bible states in accordance to marriage. According to the Bible (1st Corinthians7) a man is allowed to have a sexual relation with a woman and therefore it states that every man should have his own wife as well as the case with women. It is as well stated in Genesis that a man shall leave his father and mother and hold fast to his wife and they shall become flesh and blood. This is a proof that the Bible clearly supports marriages. On the other hand, the Bible condemns divorce as it is seen as a way of committing adultery. In the book of Matthew19, it is clearly stated that whoever leaves his wife and marries another, commits adultery. This means that God does not want whatever He has joined together to separate. However if unbelieving partner (one who does not believe in God) separates, the other partner is not enslaved to the action of the other. In this case, the divorced partner is called to the peace of Christianity. In the current society, marriages do not go well as stated in the bible. In most cases, the reason behind this is lack of enough knowledge on what the bible requires one to do being a married partner. A few percentages are not successful in their marriage encounter due to misunderstandings and others due to cases of traditional and civil marriages. In the western countries, marriage law allows contracts during marriage, whereby, an individual can marry for a certain period of time. Therefore, marriage is not taken seriously and with the same intensity as it is taken in the Christian marriage or as stated by the bible. Copying skills have influenced other countries to pick up this kind of marriage as in the western marriage probably to reduce the burden expected of a person during a marriage life. According to my view on divorce, married couples should withstand challenges that come with the encounter. Couples should take their time to understand each other before a decision for divorce is made. This is because, in many cases of divorce, the divorced couples usually come into terms after a period of separation. Despite their reasons, this is evident that divorce is not always the best option. In other cases, divorced couples usually fail in their succeeding marriages. The routine is usually similar to the previous marriages. As stated in the bible, for the believers, that whoever divorce their partners, are termed with the act of being sexually immoral. The bible states that, a believer should not, at any case, leave his/her partner, however, if the unbelieving partner decides to leave his/ her partner, the other partner is set to live in the peace of the believers. This means that a partner is only allowed to remarry in the situation above as stated in 1st Corinthians. In cases where children are involved, divorce should not be an option at any circumstance. This is to reduce cases of single parenting which is a rising issue around the world. Divorce has many effects both socially and spiritually on the concerned families. The most affected individuals are children. Hardly do we witness a positive outcome of a divorce but in any case, it is observed that, the advantages are one sided, such that, either the wife or the husband takes the privileges of being a divorcee. The children are left with the feeling of grief, and depression and this affects their live socially and spiritually. According to the Christian faith, unless death separates a married couple, both their parents should/must raise children. Otherwise, divorce has brought an evil belief to our children in such a way that, they do not believe in marriages due to their experiences with their parents. In most cases, children become demoralized in their social life and unacceptable character begins to develop within them. These may include behavior such as; smoking and excessive drinking, abuse of drugs, and sexual immorality. On the side of the divorce couples, divorce may become unhealthy to them too. These effects may include; increased susceptibility to sickness, a propensity for crime, higher risk of stroke among other effects. It is therefore evident that, divorce has more negative impacts than positive ones.

Here are the divorce steps you may have to go through before the court declares your marriage is over.

Divorce cannot happen overnight. In fact, many states have a divorce waiting period. This means a certain amount of time must pass between the time you separate and/or the time you file for divorce and the time your marriage is officially over.

The waiting period before divorce could range from as little as a few weeks to as long as a year, although there are some locations that don’t impose a waiting period at all.

During the waiting period, you may be informally or formally separated from your spouse.

• If you are informally separated, you live apart. In some states you can do this in the same house.
• If you are legally separated, you have a written agreement or order about money, custody and support. This can be helpful if your spouse is not being cooperative (for example, by not allowing you access to your home or children or by denying you financial help you need).

It is very important you understand whether your state requires a period of separation before your marriage ends and how your state defines separation. Otherwise, you could end up delaying your divorce. An experienced divorce attorney can explain this aspect of the divorce process where you live.

Determining the Grounds for Divorce

When you are ready to move forward with the divorce process, you’ll have to decide whether to file a petition asking for a fault divorce or a no-fault divorce.

All states allow no-fault divorce. This means neither party is alleging any specific wrongdoing as justification for the divorce. Instead, the divorce is just based on the fact you and your spouse have irreconcilable differences. A no-fault divorce is granted even if your spouse does not want the divorce.

Some states also allow for fault divorces. This means there are specific grounds for divorce such as abuse, abandonment or adultery.

Fault divorces can be more complicated and expensive, but you may request a fault divorce for several reasons. You may want it on record that you believe the other party was to blame for your breakup. Or you may think you can influence the court’s decisions about issues such as asset division or custody by proving your spouse wronged you.

Filing for Divorce

Filing is one of the most crucial steps of divorce. In this part of the process, you actually file paperwork with the court to begin the process of formally dissolving your marriage.

If your state imposes a waiting period, make sure you have been separated for the required length of time before filing for divorce so you don’t have to begin the process over again.

You also need to make sure you file your petition for divorce in the appropriate court. This is usually the family or divorce court in the county in which you or your spouse live, as there are residency requirements in most locations. These rules require you to have lived in the area for a certain period of time before divorcing there.

You need to provide some crucial information in your petition for divorce including:

• Names and contact information for you and your spouse
• The grounds for divorce
• Whether you have children and, if so, their personal identifying information including their ages and locations
• What you desire with regard to the division of property and child custody, as well as whether you are asking for alimony or child support.

You need to pay a divorce filing fee when you submit your petition for divorce (or you can complete a request to waive the fee if paying it would be a financial hardship). Fees vary based on location.

When you file for divorce, your spouse must be formally notified. You can request that the sheriff serve your spouse with divorce papers or hire a process server.

If you do not know the location of your spouse, you still need to attempt to ensure they receive notice of the divorce filing. You can do this by publishing notices in local newspapers if the court gives you permission.

Before you can move forward with the divorce process, you must be able to provide proof to the court that your spouse was served (or that you attempted to serve the papers).

In most cases, when you serve your partner with divorce papers, they have a set period of time to respond.

If your partner does not do so, you can petition the court and request a default divorce (also sometimes called an uncontested divorce). The court typically will move forward, awarding you all that you requested and dissolving your marriage. If you and your spouse have children together, however, the court ensures it is acting in the children’s best interests before making decisions regarding them.

Typically, however, your spouse will respond after you have filed a petition for divorce. This means your spouse will submit an “answer” to your initial petition for divorce. Your spouse might agree with you in the answer or may disagree with your assertions. Your spouse can also file a counter-complaint and introduce new allegations or information for the court to consider.

If your spouse responds, they typically must serve you with a copy of that response and provide proof of this service to the court in order for proceedings to continue.

In some cases, a temporary hearing will be held after a petition for divorce is filed but before the official court proceedings begin to dissolve the marriage. This is especially likely in states where there is a long waiting period between the time a couple separates and the time divorce can take place.

In the temporary hearing, the court can address issues that are unable to wait until the full trial to dissolve your marriage. This could include:

• Creating a temporary custody arrangement
• Awarding temporary financial support for spouses or children
• Putting a domestic violence restraining order in place

The final step before your marriage is dissolved involves either negotiating a divorce settlement the court can sign off on or going to trial to decide how support, custody and division of assets will work.

It is generally best if you can move forward with an uncontested divorce in which you and your spouse come to an agreement on the issues involved in ending your marriage. How long does a divorce take?

In this article we examine anti-Semitism as expressed by a sample of residents of the Moscow Oblast (Soviet Union). Based on a survey conducted in 1920, we begin by describing anti-Jewish prejudice and support for official discrimination against Jews. We discover a surprisingly low level of expressed anti-Semitism among these Soviet respondents and virtually no support for state policies that discriminate against Jews. At the same time, many of the conventional hypotheses predicting anti-Semitism are supported in the Soviet case. Anti-Semitism is concentrated among those with lower levels of education, those whose personal financial condition is deteriorating, and those who oppose further democratization of the Soviet Union. We do not take these findings as evidence that anti-Semitism is a trivial problem in the Soviet Union but, rather, suggest that efforts to combat anti-Jewish movements would likely receive considerable support from ordinary Soviet people.

Deferred prosecution agreements (or DPAs) have been used with increasing frequency, particularly in corporate criminal prosecutions, over the past two decades. By allowing prosecutors to offer a path for rehabilitation without ever having to bring charges against a defendant, deferred adjudication presents a valuable tool for progressive prosecutors to use in a broader movement for criminal justice reform. However, data on how prosecutors use DPAs––how often they are offered, and who they are offered to––has long been lacking. Drawing on a recent national experiment studying state and local prosecutors, we aim to supplement the existing data to help answer these questions. We then draw on this more complete picture of how prosecutors at all levels are using DPAs to conclude that, contrary to congressional intent, DPAs have come to be used in practically every corporate criminal prosecution, while they are offered to resolve only a small fraction of individual prosecutions. We argue that this troubling trend not only runs contrary to the legislation that initiated deferred prosecution agreements but is unjustified on public policy grounds. This misalignment can likely be remedied by using deferred adjudication more frequently in individual prosecutions, presenting a valuable tool to respond to the endemic challenges of overcriminalization and mass incarceration, while still holding individuals accountable for crime. Increasing the use of deferred adjudication allows individuals facing criminal charges an opportunity at rehabilitation without the collateral consequences and reputational tarnish of prosecution.
