Lawyers to Plastics Makers: Prepare for ‘Astronomical’ PFAS Lawsuits

At an industry presentation about dangerous “forever chemicals,” lawyers predicted a wave of lawsuits that could dwarf asbestos litigation, audio from the event revealed.

The defense lawyer minced no words as he addressed a room full of plastic-industry executives. Prepare for a wave of lawsuits​ with​ potentially “astronomical” costs​. Speaking at a conference earlier this year, the lawyer, Brian Gross, said the coming litigation could “dwarf anything related to asbestos,” one of the most sprawling corporate-liability battles in United States history.

Mr. Gross was referring to PFAS, the “forever chemicals” that have emerged as one of the major pollution issues of our time. Used for decades in countless everyday objects — cosmetics, takeout containers, frying pans — PFAS have been linked to serious health risks including cancer. Last month the federal government said several types of PFAS must be removed from the drinking water of hundreds of millions of Americans .

“Do what you can, while you can, before you get sued,” Mr. Gross said at the February session, according to a recording of the event made by a participant and examined by The New York Times. “Review any marketing materials or other communications that you’ve had with your customers, with your suppliers, see whether there’s anything in those documents that’s problematic to your defense,” he said. “Weed out people and find the right witness to represent your company.”

A spokesman for Mr. Gross’s employer, MG+M The Law Firm, which defends companies in high-stakes litigation, didn’t respond to questions about Mr. Gross’s remarks and said he was unavailable to discuss them.

A wide swath of the chemicals, plastics and related industries are gearing up to fight a surge in litigation related to PFAS, or per- and polyfluoroalkyl substances, a class of nearly 15,000 versatile synthetic chemicals linked to serious health problems.

PFAS chemicals have been detected almost everywhere scientists have looked: in drinking water, in rain falling over the Great Lakes , even in Antarctic snow . They are thought to be present in the blood of nearly every American . Researchers have linked exposure to PFAS to testicular and kidney cancers, developmental delays in children, decreased fertility, liver damage and thyroid disease. The man-made chemicals are so long-lasting that scientists haven’t been able to reliably identify how long it might take for them to break down.

PFAS-related lawsuits have already targeted manufacturers in the United States, including DuPont, its spinoff Chemours, and 3M. Last year, 3M agreed to pay at least $10 billion to water utilities across the United States that had sought compensation for cleanup costs. Thirty state attorneys general have also sued PFAS manufacturers, accusing the manufacturers of widespread contamination.

But experts say the legal battle is just beginning. Under increasing scrutiny are a wider universe of companies that use PFAS in their products. This month, plaintiffs filed a class-action lawsuit against Bic, accusing the razor company for failing to disclose that some of its razors contained PFAS.

Bic said it doesn’t comment on pending litigation, and said it had a longstanding commitment to safety.

The Biden administration has moved to regulate the chemicals, for the first time requiring municipal water systems to remove six types of PFAS . Last month, the Environmental Protection Agency also designated two of those PFAS chemicals as hazardous substances under the Superfund law, shifting responsibility for their cleanup at contaminated sites from taxpayers to polluters.

Both rules are expected to prompt a new round of litigation from water utilities, local communities and others suing for cleanup costs.

“To say that the floodgates are opening is an understatement,” said Emily M. Lamond, an attorney who focuses on environmental litigation at the law firm Cole Schotz. “Take tobacco, asbestos, MTBE, combine them, and I think we’re still going to see more PFAS-related litigation,” she said, referring to methyl tert-butyl ether, a former harmful gasoline additive that contaminated drinking water. Together, the trio led to claims totaling hundreds of billions of dollars.

PFAS were an industrial marvel when chemists at Dupont in the 1940s synthesized the material, a remarkably durable compound resistant to water, stains, heat and grease. It quickly became a mainstay in DuPont’s Teflon nonstick pans and 3M’s Scotchgard fabric protector. A powerful fire suppressant, it helped firefighters battle flames. Today, they are used for everyday items as varied as microwave popcorn bags, shampoos, raincoats and firefighting foam.

But the very qualities that have made PFAS so valuable have also prevented them from breaking down naturally in the environment. As PFAS entered the environment from factories, products and landfills, the chemicals have started to accumulate in water, air and soil.

Industry documents released through litigation show that manufacturers found adverse health effects from PFAS exposure as early as 1961 . But it wasn’t until the early 2000s that questions increasingly emerged in public about their safety. In 2005, the E.P.A. fined DuPont $10 million , at that time the largest administrative fine ever levied by the agency, for failing to disclose PFAS’s adverse effects.​​

All that has set the stage for a potential legal storm. Unlike tobacco, used by only a subset of the public, “pretty much every one of us in the United States is walking around with PFAS in our bodies,” said Erik Olson, senior strategic director for environmental health at the Natural Resources Defense Council. “And we’re being exposed without our knowledge or consent, often by industries that knew how dangerous the chemicals were, and failed to disclose that,” he said. “That’s a formula for really significant liability.”

Sandy Wynn-Stelt of Belmont, Mich., brought one early case. A year after she lost her husband to liver cancer in 2016, she discovered that the Christmas tree farm in front of her home, which had seemed such an idyllic setting, had been a dumping ground for PFAS-laden tannery waste from Wolverine World Wide, the maker of Hush Puppies shoes.

Wolverine had been among the first to license 3M’s Scotchgard for its waterproof footwear. Mrs. Wynn-Stelt got her blood tested, and found PFAS levels hundreds of times the norm. In 2020, she was diagnosed with thyroid cancer.

She sued Wolverine and 3M, and reached a settlement in 2021. Separately, nearly 2,000 local residents settled a class-action lawsuit against Wolverine. The region’s water source remains polluted with PFAS.

“Those lawyers are exactly right. This is going to be huge, now that people are starting to hold companies accountable,” Mrs. Wynn-Stelt said.

Wolverine declined to comment. 3M said it continued to “address PFAS litigation by defending itself in court or through negotiated resolutions.”

Much of the course of future litigation hinges on the evidence over PFAS’s health risks. There is broad scientific consensus that certain PFAS chemicals are harmful. “There’s a weight of evidence,” said Linda Birnbaum, a toxicologist and the former director of the National Institute of Environmental Health Sciences. “Multiple studies by different investigators, and in different populations.”

Max Swetman, another MG+M partner who presented with Mr. Gross at the February industry conference, addressed the research in his remarks to the group. “There’s a whole lot of new science being created,” he said. “It’s not the best for us.”

Still, some of the research could be vulnerable to criticism, he said. Getting the right experts to testify was crucial, he said. “Epidemiologists, if you get the right one, is always going to be your best expert in trial.”

Mr. Swetman was unavailable to comment on his remarks, according to his law firm.

One challenge facing medical research lies in the sheer number of different PFAS chemicals that have now entered the environment, each of which can have slightly different health effects, said Steph Tai, associate dean at the University of Wisconsin’s Nelson Institute for Environmental Studies and an expert in the use of science in environmental protection and litigation.

“The other thing, too, is that it takes a long time for health effects to show up,” Dr. Tai said, so the only way that scientists have been able to assess those effects is through long-term studies. Researchers must essentially look for what is referred to as “natural experiments,” according to Dr. Tai, comparing people who are naturally less exposed to PFAS with those who are more exposed. That inevitably leads to some uncertainties.

The industry has scored some major victories. Last November, the United States Court of Appeals for the Sixth Circuit tossed out a lawsuit that would have covered every Ohio citizen in a major case over exposure to PFAS, ruling that a firefighter who brought the lawsuit failed to prove that the PFAS found in his blood specifically came from the companies he sued.

3M phased out most uses of two of the most widely used PFAS chemicals, PFOS and PFOA, in the early 2000s, and DuPont in 2015 stopped using PFOA. 3M has said it will phase out the manufacturing of PFAS chemicals by the end of next year. The company will also work to discontinue their use in products, though that’s contingent on the company finding substitutes.

“As the science and technology of PFAS, societal and regulatory expectations, and our expectations of ourselves have evolved, so has how we manage PFAS,” 3M said.

DuPont referred inquiries to Chemours, the company that was spun off in 2015. Chemours declined to comment.

A long and difficult cleanup is beginning. President Biden’s 2021 infrastructure law provides $9 billion to help communities address PFAS contamination, and the E.P.A. has said $1 billion of that money would be set aside to help states with initial testing and treatment. Meantime, new kinds of PFAS are still being released into the environment. Scientists are working to learn more about them.

The Pregnant Workers Fairness Act: What U.S. Employers Need to Know

A new federal law requires organizations with 15 or more employees to accommodate all health needs at work arising from pregnancy, childbirth, and related conditions.

This year in the U.S., the Equal Employment Opportunity Commission (EEOC) issued final regulations to implement the Pregnant Workers Fairness Act (PWFA), a new federal law that requires the federal government as well as private, state, and local employers with 15 or more employees to accommodate all health needs at work arising from pregnancy, childbirth, and related conditions. The authors, who have counseled and trained hundreds of employees, businesses, and attorneys on the new law, outline what leaders need to know to support their pregnant workers while avoiding unnecessary EEOC charges and litigation.

The ground rules of pregnancy accommodation have recently shifted significantly. In April, the Equal Employment Opportunity Commission (EEOC) issued final regulations to implement the Pregnant Workers Fairness Act (PWFA), a new federal law that requires employers to make reasonable accommodations for pregnancy, childbirth, and related medical conditions.

15 men brought to military enlistment office after mass brawl in Moscow Oblast

Local security forces brought 15 men to a military enlistment office after a mass brawl at a warehouse of the Russian Wildberries company in Elektrostal, Moscow Oblast on Feb. 8, Russian Telegram channel Shot reported .

29 people were also taken to police stations. Among the arrested were citizens of Kyrgyzstan.

A mass brawl involving over 100 employees and security personnel broke out at the Wildberries warehouse in Elektrostal on Dec. 8.

ACELYRIN, INC. Announces Positive 16-week Data From its Global Phase 2b/3 Trial of Izokibep in Psoriatic Arthritis to be Shared During Late-Breaking Oral Presentation at EULAR 2024

LOS ANGELES, June 05, 2024 (GLOBE NEWSWIRE) -- ACELYRIN, INC. (Nasdaq: SLRN), a late-stage clinical biopharma company focused on accelerating the development and delivery of transformative medicines in immunology, today announced that positive results from the company’s global Phase 2b/3 clinical trial of izokibep in psoriatic arthritis (PsA) will be shared as a late breaking oral presentation at the 2024 European Alliance of Associations for Rheumatology Congress taking place June 12-15 in Vienna, Austria. Izokibep is a small protein therapeutic designed to inhibit IL-17A, a validated mechanism for the treatment of PsA and other immune-mediated diseases.

Title: Efficacy and Safety of Izokibep, a Novel IL-17A Inhibitor, in Patients with Active Psoriatic Arthritis: Week 16 Results from a Randomized, Double-Blind, Placebo-Controlled, Multicenter Phase 2b/3 Study Date/Time:  Saturday, June 15, 2024; 9:30am - 9:40am CEST Presenter: Philip Mease, MD, MACR, Director of Rheumatology Research at Swedish Medical Center

About the Phase 2b/3 Psoriatic Arthritis clinical trial The Phase 2b/3 clinical trial (NCT05623345) is a global, multi center, randomized double-blind, placebo-controlled trial evaluating the safety and efficacy of izokibep dosed subcutaneously 160 mg every week (QW) or every two weeks (Q2W) and 80 mg every four weeks (Q4W) versus placebo. 351 adult patients with active PsA were enrolled across 71 sites in the United States and Europe and randomized across the four arms.

About Psoriatic Arthritis Psoriatic arthritis (PsA) is a chronic immune-mediated inflammatory disease characterized by multiple manifestations including destructive joint inflammation, psoriasis, and enthesitis (painful inflammation of the small, dense tissues that connect ligament and tendons to bone), all contributing to reduced quality of life. It is estimated that approximately 30% of the 125 million people living with psoriasis worldwide will also develop PsA over time. There remains a large unmet need for more effective therapies to treat PsA across all disease manifestations.

WWDC 2024: How to Watch Apple's keynote on June 10

The event starts at 1pm et, with news on ios 18, macos, visionos and more..

Apple’s Worldwide Developers Conference (WWDC) keynote is right around the corner . The festivities kick off on Monday, June 10 at 1PM ET. The keynote address is available to the public and you can watch it via Apple’s event website or on the company’s YouTube channel . Alternatively, you can just stay here and watch our embed.

This is WWDC, so it’ll be a software-focused event . Apple will most likely reveal many of the main features of iOS 18 and iPadOS 18. It’s also possible we’ll get updates for watchOS, macOS and even visionOS, which is the operating system behind the Vision Pro headset.

This is Apple, however, so the rumor mill is grinding at a feverish pace. The whole world has gone AI crazy, to varying degrees of success , but Apple has remained mostly mum on the technology. Given the current tech climate, it seems likely that changes sooner rather than later. WWDC would be the perfect place to unveil what the company has been working on.

To that end, Apple is reportedly developing its own AI chatbot, likely an update to Siri. Rumors swirl that this tech isn’t ready yet, so Siri will remain just a fairly decent alarm clock for now. The company has, however, entered into a partnership with OpenAI to integrate ChatGPT into iOS 18, according to Bloomberg’s Mark Gurman . If Gurman is right, and he usually is, we’ll see something about that. The upgraded Siri will likely get a mention, but won’t be on devices until at least early 2025.

As for software updates, it looks like iOS 18 will finally bring RCS support to Messages . This messaging protocol offers end-to-end encryption and better media sharing. It’ll also improve texting compatibility with Android devices. Rumors indicate that Apple Music may get an OpenAI-powered tool that auto-generates playlists and Notes might get a voice-recording option. Other apps like Mail, Fitness and Health are expected to get new features, but there are no details as of this writing.

There’s also those ever-tantalizing words of “just one more thing.” Last year, the company used WWDC to officially unveil the Vision Pro . Apple won’t introduce a new device category this year, the AVP was its first since Apple Watch, but there should be a Vision Pro global availability announcement and some updated features.

Despite last year's Vision Pro reveal, we're not expecting a lot of hardware news. It’s possible we’ll get a new Apple TV streaming box and, if we’re lucky, an AirPods Max refresh with USB-C. Don’t hold out hope for new tablets or laptops, as Apple recently released both iPads and MacBooks — though Apple could drop the just-released M4 chip in the MacBook Pro. The Mac mini and Mac Studio are both overdue for an update, as well. But it's possible we get none of the above. There won’t be new iPhones until September, and the same goes for Apple Watch.

On the opening day of Computex 2024 in Taipei, Arm CEO Rene Haas shared how the company is enabling 100+ billion Arm devices ready for AI from cloud to edge by 2025.

Do we have enough energy for AI?

One of the key questions Haas addressed was if the world has enough energy to power the increasing compute needs of AI. While we have seen some amazing innovation around AI, the industry is in an interesting dilemma where the better the processors get to handle the performance requirements of AI, the greater the energy demands.

With Arm’s DNA born of devices designed to run off batteries, Haas believes this is why we’re seeing greater adoption of Arm by leading cloud service providers such as AWS, Google, and Microsoft. Arm is the world’s most power-efficient CPU, and the power savings it delivers are already driving incredible AI innovation according to Haas.

It’s all about the software

Leading power-efficiency is what Arm has been most known for over the company’s 30+ year history and the foundation of what has enabled it to become the world’s most pervasive compute platform. Yet according to Haas, what really makes Arm unique is a software ecosystem unlike any other.

As Haas pointed out, Arm has become the de-facto choice for every major operating system in the world. The AI PCs recently announced by Microsoft are a great example of this, where the most-used apps are now running natively on Windows on Arm . In fact, with an ecosystem of 18 million software developers, more developers design on Arm CPUs than any other processor today.

This developer support is incredibly important if we want to experience the societal changes AI can unleash from the tiniest devices at the edge to training and inference in the cloud. Developers need to be able to take the innovation they are doing with AI and have it run on the hardware in a performant, power-optimized, highly executable and predictable state.

To ensure this happens on the Arm compute platform, Haas introduced Arm KleidiAI , part of a new suite of AI compute libraries that make it easier for developers to run their AI applications on Arm. Haas said, “If there’s anything we’ve learned over Arm’s 30-plus years, as great as the hardware is, if you don’t have something that developers can get access to, the hardware is not going to do you much good.”

For example, as developers work on their models in frameworks such as TensorFlow, PyTorch, Llama 3 and MediaPipe, KleidiAI enables them to go into the abstraction layer and take advantage of the underlying hardware features for AI workloads to achieve their full performance potential.

To speak to the advantages of KleidiAI from an ecosystem perspective, Haas shared videos of executives from Samsung Mobile, Meta and Google on how Arm and KleidiAI will enable them to accelerate AI innovation on Arm across multiple markets.

Arm Compute Subsystems for Client

In addition to all the great work Arm is doing to enable the AI developer ecosystem, it needs to continue to deliver higher-performing and more power-efficient products. To share more on this, Chris Bergey, SVP and GM for Arm’s Client Line of Business, took the stage to talk about the recently announced Arm Compute Subsystems (CSS) for client devices.

This is the first time that Arm has introduced physical implementations of its CPUs and GPUs in leading edge 3 nanometer nodes. According to Bergey, this is important because the Arm ecosystem can now take proven, physical implementations of these cores on leading 3 nanometer nodes and get to market faster with greater confidence.

CSS for Client enables chipmakers to focus on their differentiation around the platform and what Armv9 architecture can bring to their next-generation products. When you combine this with KIeidiAI, developers have the tools required to take full advantage of these next-generation hardware technologies.

Haas closed by further reinforcing Arm’s commitment to AI by delivering the most complete compute platforms on the planet. With innovations like Arm CSS and Kleidi AI, he expects that more than 100 billion Arm devices will be ready for AI by the end of 2025. It’s an incredible number of devices that Haas said will not only reshape the industry but also the entire planet.
