Resume Tips for Disabled Persons 

  • Disability is an umbrella term that covers any mental or physical impairment, from chronic diseases to physical injuries to mental disorders. 

If you’re living with any disability, it’s normal to wonder whether your resume should mentiong the said disability, or if there are any best particular practices that it should follow. 

In this section, we’re going to give you our best tips on how to make a resume that stands out.

#1. Don’t Mention Your Disability

The first thing you should know is that you’re not legally obliged to mention your disability on your resume . 

At the start of your job hunt , your goal should be to stand out from other applicants and secure job interviews. So if your disability doesn't hinder your application in any way, there's no reason to disclose it on your resume. Not mentioning the disability ensures sure that the hiring manager isn’t subsciously biased against you as a candidate.

That said, we're not saying that you should lie about your disability - or anything else for that matter. Rather, you should choose the right time and place to talk about it. 

A good option is during your job interview. Once you know you have recruiters’ attention and interest, you should let them know about your disability and how it impacts your professional life. 

Alternatively, you can inform the hiring manager about your disability once you’ve scheduled the job interview - especially if you need certain accommodations (e.g. wheelchair accessibility).

#2. Explain Any Employment Gaps 

It often happens that disabled people have frequent or long employment gaps on their resumes.

Now, for recruiters, employment gaps often equal huge red flags most commonly relating to a candidate’s lack of dependability, professionalism, or work ethic. 

As such, you want to make sure you explain every employment gap recruiters may notice on your resume, so they don’t assume you’ll be an unreliable employee. 

Again, you don’t have to disclose your disability to explain your employment gaps if you don’t want to. Writing “illness and recovery” next to the dates of your employment gap is more than enough to show recruiters you had a valid reason not to be working. 

Alternatively, you can add a short description of what happened to you during the time and what you did to stay on track professionally, while not being at work. Here is how you’d go about that on your resume:

#3. Pay Attention to the Format

You may have all the right achievements and qualifications to make you the ideal candidate for the job and still miss out on recruiters’ attention due to poor resume formatting . 

Recruiters have limited time to review hundreds of resumes, and as such, they’re a lot more likely to read yours if it’s well formatted and easy to read.

If it’s a jumbled mess, though, they won’t even skim through it.

To make sure that’s the case, here are some resume layout elements you should pay attention to: 

  • Format. Out of all the resume formats out there, recruiters worldwide prefer the reverse-chronological format . It starts by listing your most recent work experience last and goes back in time from that point on. 
  • Font. Stick to fonts that won’t give recruiters an eyesore and that look good both on a computer screen and on paper. Think of Roboto, Ubuntu, and Overpass fonts as strong do-s and Comic Sans and Papyrus fonts as permanent don’t-s. 
  • Line spacing. Go for a 1.0-1.15 line space throughout the text. It will help you save space without making your resume look overcrowded. 
  • Bullets. You can use bullet points to sum up and organize important information in each section without it looking like a block of text. 
  • Length. The optimal resume length is one page . Recruiters are busy people who get thousands of resumes each month, so be respectful of their time and keep your resume within the recommended length.

#4. Include All Essential Resume Sections

Once you get formatting out of the way, you can dive into the essentials of writing a resume. 

First and foremost, this means including these must-have sections for any resume: 

  • Contact information. In your contact information section, list your full name, a working phone number, a professional email address, and your location. You can optionally include your job title and links to your LinkedIn profile or professional website. 
  • Resume summary/objective. The resume summary comes right after the contact information and aims to grab recruiters’ interest from the get-go. It’s a 2 or 3-sentence-long summary of your career, including your years of experience, skills, qualifications, and 1-2 top achievements. Less experienced candidates ( recent graduates or entry-level professionals), on the other hand, can use a resume objective, which should communicate your motivation for getting into a field, in addition to your skills and qualifications.  
  • Work experience. Arguably the most important part of your resume, the work experience section should reflect your achievements and responsibilities in your previous roles. For every work entry, make sure to include the title you held, the company name and location, the dates you were employed, and your accomplishments and responsibilities in bullet points. 
  • Education. Your education section should be brief and concise - especially if you have plenty of work experience to add to your resume. Make sure to include the program name and degree, the institution’s name, and the years attended. Optionally, you can include your CGPA and any Honors you received during your studies.  
  • Skills. The skills section is typically divided into soft skills and hard skills. Soft skills include communication skills, interpersonal skills, etc., whereas hard skills are job-specific (e.g. C++ for programmers, Adobe Illustrator for illustrators, etc.). Make sure to prioritize listing the skills that you’ll use for the job in a day-to-day setting, and if you have the extra space afterward, you can also list the less essential ones (e.g. soft skills).

#5. Highlight Your Qualifications 

Learning skills and getting qualified on the job is always an option, but showing that you’re already qualified for the position will give you a big competitive advantage compared to other applicants. 

So, go through the job description to see exactly what the requirements of the role are and highlight any qualifications you have that match them (e.g. software platforms, equipment knowledge, regulatory programs, etc). 

Here are the three sections you can best take advantage of to mention your qualifications: 

  • The skills section (under hard skills). 
  • The work experience section (you can mention, for example, how you acquired a specific qualification in bullet points under a past work entry). 
  • The resume summary (along with your key skills and 1-2 top achievements). 

And here's an example of how you can highlight your qualifications in your resume summary: 

  • Responsible and dedicated office manager with 7+ years of experience. I have excellent interpersonal and computer skills and am highly proficient in Microsoft Word, Excel, Outlook, and PowerPoint . Selected and incorporated a new project management software in my last workplace that improved office productivity and helped us reach our department KPI-s 5 weeks faster.   

#6. Quantify Your Achievements

Claiming you've achieved something professionally is one thing; being able to back it up with numbers is another thing entirely. 

Quantifying your achievements can help recruiters put them into context and understand exactly how well you can drive results. 

An easy way to do this is to follow the Laszlo Bock formula , which goes like this: 

“Accomplished [X] as measured by [Y] by doing [Z].”

  • Centers for Independent Living - These facilities help people live independently and offer services such as job training and career coaching.
  • AbilityJobs - This is the largest job site for disabled workers. Every employer using this site is specifically looking for employees with disabilities, including prominent organizations such as the Central Intelligence Agency, Deloitte, Amazon, and Wells Fargo.
  • Disabled Person - This job board offers career opportunities in various industries, including accounting, architecture, marketing, and management.
  • Getting Hired - This is another job board with tens of thousands of available jobs from inclusive employers. Getting Hired also holds recruiting events and publishes guides on inclusivity-related topics.
  • USA Jobs - USA Jobs is the federal government’s official job site. It allows you to search for competitive and non-competitive job opportunities. The latter can happen through the Schedule A program , which allows federal agencies to use their authority to hire disabled workers without requiring them to compete for the job.
  • Job Accommodation Network - The JAN provides free one-on-one expert consultations on job accommodation solutions, self-employment options, the ADA, etc.
  • Ticket to Work - Ticket to Work provides career development services to Social Security disability beneficiaries between the ages 18 to 64 and want to work, including counseling, training, and job placement.
  • AbilityOne - This federal agency generates work for people with disabilities; over 40,000 people who are blind or have significant disabilities, including about 3,000 veterans, are employed through AbilityOne.
  • Veteran Readiness and Employment - The Department of Veterans’ Affairs offers employment and career building services, including job training, resume development, and career coaching. They can help you set up accommodations at your job as well.
  • Workforce Recruitment Program - The Workforce Recruitment Program connects employers with college students and recent graduates who have disabilities and are ready to enter the workforce.
  • National Collaborative on Workforce - This site provides a variety of helpful resources for people with disabilities who are new to the workforce. For example, the High Tech program helps disabled youth explore careers in math, science, and technology.

Dealing With Workplace Discrimination Against Disabilities

Although there are laws in place to protect disabled people from workplace discrimination, unfortunately, discrimination still happens from time to time. 

If you are discriminated against, it’s important to know your rights and how you can best deal with the situation at hand. 

Here is what you can do to tackle such cases: 

#1. Know Your Rights 

The Americans with Disabilities Act (ADA) is the most popular, but not the only piece of legislation protecting people with disabilities from discrimination and ensuring they get fair treatment. 

Let’s break down how some of the major laws regarding people with disabilities work and what they guarantee: 

  • ADA. The ADA protects people with disabilities from discrimination. Title I and Title II of the ADA deal with employment issues such as hiring practices, salaries, promotions, benefits, and firing practices. The ADA covers private businesses as well as state and government entities and requires employers to provide “reasonable accommodations” to both employees and job seekers. 
  • Rehabilitation Act. The Rehabilitation Act covers federal government entities. Specifically, it prohibits private employers and organizations that receive over $10,000 annually through federal assistance from discriminating against qualified applicants with disabilities.
  • Workforce Innovation and Opportunity Act (WIOA). With a general aim to provide training and career services to all job seekers, there are several parts of the WIOA that concern disabled persons specifically. For example, it requires US Job Centers to upkeep physical and programmatic accessibility for people with disabilities and provides pre-employment transition services for students with disabilities.
  • Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA). The VEVRAA covers federal contracts and subcontracts of $100,000 and more. These contractors are legally required to provide equal access to employment activities to disabled veterans.

The laws outlined above are enforced by the Equal Employment Opportunity Commission (EEOC). However, not all organizations are covered by the laws the EEOC enforces. 

Federal government entities, for example, are bound by these laws regardless of their size. Private businesses, on the other hand, as well as state and local government entities with less than 15 employees, are not legally required to follow all of them. 

#2. Understand Harassment and Protection from Retaliation 

Harassment in the workplace consists of any unwelcomed conduct, including offensive jokes, insults, the display of offensive objects or pictures, and physical assault or threats. 

Harassment becomes illegal when it creates a hostile work environment or an employee gets fired for refusing to put up with it. Acting against workers who try to utilize any given anti-discrimination law is also illegal - this is called protection from retaliation. 

Specifically, employers cannot act against employees for talking to a supervisor about workplace discrimination, for refusing to follow directions that would result in discrimination, for filing an employment discrimination complaint, or for assisting an EEOC investigation. 

#3. File an Employment Discrimination Complaint 

Filing an employment discrimination complaint might seem a bit confusing, especially if you’ve never done it before. 

This, however, should in no way be a reason not to exercise your rights. 

All you need to know is that the EEOC has divided its national jurisdiction into 15 districts, each with its own field office. To file an employment discrimination complaint, you should find and contact the EEOC field office with jurisdiction in your area. 

You should get all the information regarding the process, documents, and deadlines from the field office. 

#4. File a Lawsuit 

If the EEOC field office decides the complaint consists of an ADA violation on the employer's side, they can move forward with litigation. If they don't, you still have the right to sue them in civil court. 

The amount of money an employment lawyer can win you in such lawsuits depends on whether the employer is found to have violated the ADA before. The maximum penalty is $75,000 for the first offense and $150,000 for subsequent violations.

For example; “Librarian at Smith University” Preferred Location -If the job that you are applying for has more than one location, place your preferred location here. If the job that you are applying for is only offered at one location, then you can omit this heading. Preferred Job - If you are responding to an ad that has multiple job offerings, be sure to identify the job that you are applying for. Do it under this heading. Also, if the ad supplies you with a job number, this is where you put it. Resume Objective or Key Point -This section should not be longer than 500 words. The more concise you make it, the better. In this section, you have to catch the eye of the employer. You want tell the potential employer why you are the person that they should hire. Do not blabber. Be concise. Don’t be afraid to put a key sentence in bold print to catch their attention. For example! “I was involved in the planning and opening of our local city’s library.” Remember, the objective is to sell your skills to the employer. DO NOT LIE ! Be honest with your potential employer. Do not write anything that you can not substantiate. Work Experience-Usually, it is advised to place your most recent job first followed by other jobs that you may have had. Be sure to put accurate dates, addresses and phone numbers so that the potential employer can verify what you have put down. We suggest that you place the most relevant job first. For instance, in this example, you are applying for a job as a Librarian. If you last job was at Circuit City but your job previous to that was as a Library, then, by all means put the Library job first. Get the drift? Also, the employer here is looking for continuity of work. Be prepared to answer any time gaps in work. For instance if you worked from 2001-2002, then your next job was in 2004, the employer is going to question why weren’t you working during that time. You need to have an answer. It’s acceptable to say that you went back to school or you needed to attend to a family matter during that time or you volunteered. Have a positive response. Education - Here your most recent attendance to your first. Don’t forget to put the school’s name, address, phone number and times you attended. Also, put the degree earned. It is also important if you took course work that didn’t lead to a degree if it is in the field that you’re applying for. For example; a certificate in Library Management or a graduate course in “Library Cataloging in the Digital Age.” Other Relevant Experiences - This is where you can tell them about your life experience. For example; being president of the local PTA or treasurer of the local Little League. Anything that might show a skill that is required in the job that you are seeking. References -Give references only when asked for. Under this heading, we suggest that you put, References upon request. Also, be sure before giving a person as a reference that you speak to them and make sure that they will give you a positive reference. Do not assume that simply because you asked for a reference that it will be positive. Many people make that mistake. Resume Writing Resume writing is very important in your pursuit of employment. It has often been said that your resume is a mirror of you. Remember, your resume is the first contact a potential employer has with you. That being said, there are a couple of things that must realize are unacceptable: 1) Spelling : make absolutely sure that all the spelling and grammar is correct. Misspelled words are a definite turn off. Use your spell checker and grammar checker for sure. However, proof read the resume yourself. For instance, if you want to use the word “they” and type the word “the”, the spell checker will not pick that up. If you are not meticulous enough to make sure that your resume is correct then why would an employer believe that you will be any different on their job? 2) Fonts : When typing your resume, don’t get cute with fancy fonts. Simply pick a blocked font like Times Roman or Ariel. 3) Paper : Good paper is a must but fancy paper is a no no in our opinion. Please note that white paper is the paper of choice. Don’t send a resume with colored paper. 4) Type your resume in black ink only. Bold face when appropriate. Do not use colored ink. You should write a resume template, a generic resume about you and keep it as a word document. We say this because we believe that you should tailor your resume to the particular job that you are going for. How do you do this? Read the job description so that you can customize your resume to that particular job. By this we mean emphasizing particular strengths that you have for that job. Never lie on a resume. Your resume should have a Title to it. Of course put your name, address and phone number. Also put your cell phone if you have one. Clearly identify the number as your cell number though. If the job that you are applying for has a job number, put it on the resume. This shows that you have taken the time to do some homework about the job. Next , we believe that you should put your Resume Objective. Describe your career or position objective. Do it briefly and be to the point. Follow this with your Education. For Education, reverse chronological order we believe is the way to go. Make sure that you put all of your degrees, certificates and any other courses or seminars that pertain to the job that you are applying for. Work Experience is next. Chronological order in our opinion is not necessary here. Put first the work experience that most closely resembles the job that you are applying for. Then you’re other jobs. Other Relevant Information is next. Here, talk about experiences that will strengthen your position for this job. For instance, if you are applying for a managerial position in a business where you will be leading a bunch of employees, its relevant that you are the president of you local little league. It demonstrates your people and management skills. Get the drift! Salary is a difficult question . Some say to put your salary requirements on your resume, others say not to. In our opinion, you need to be flexible and creative. We suggest that you look at the salary range for that particular job. If it is satisfactory to you, then state under the Salary heading of your resume something like “the salary range offered for job number 1234 is acceptable to me”. That does a couple of things. It tells the reader of the resume that you are willing to take the job at the salary offered. It also tells them that you want to negotiate for the upper end of the range. This way you won’t short change yourself or take yourself out of the hunt for the job. Remember, the objective of the resume is to get you called in for an interview. You don’t want anything including salary to stop you from being called in. If the job description does not offer a salary range but a fixed amount, we suggest that you simply acknowledge that the salary figure and state that it is acceptable. If the job description does not state anything about salary, we suggest that under your salary heading that you put something like “salary is open to discussion”. Writing and Formatting a Resume that can be Scanned: What Job Seekers with Disabilities Need to Know Because we are living in an information age where technology drives most interactions, resumes sent via E-mail and traditional paper are likely to be scanned for key information by a machine, not a human being. What It Means to have Your Resume Scanned by a Machine Because employers receive more resumes than they can process efficiently, they are switching to text-searching or artificial intelligence software to track resumes. These systems use optical scanners to put resumes into the computer which then searches for skills that match a job description. Optical character recognition–OCR–software looks at the image to distinguish every letter and number and creates a text file. Such systems are important because they significantly lessen the time it takes to search for qualified applicants to fill a job. These systems can also help employers by creating a centralized resume pool in companies that have a decentralized human resource function. Why Resume’s that can be Scanned are Important to Your Search In order to efficiently review resumes, an increasing number of employers are letting computers take the first crack at selecting a first round of applicants for certain jobs. Because computers are programmed to search for certain words, every word in a resume is important in the selection process. Artificial intelligence software “reads” the text and extracts important information such as your name, address, work history, experience and skills. A clear resume allows the scanner to obtain a clean image in order to maximize “hits” (when one of your skills matches the computer search). How to Prepare a Resume that Will Scan to Jobs You are Seeking Following are important tips on making your resume “scan-friendly.” -Use a standard typeface such as Courier, Helvetica, Futura, Optima, Universe or Times with a point size of 10-14. -Use black ink on white 8 1/2 × 11 inch paper. Do not use colored paper. -Use only capital letters or boldface to emphasize important information. Do not use italics, underlining, boxes, graphics, or horizontal or vertical lines. -Avoid a two-column format or resumes that look like newspapers or newsletters. -Use only a laser-quality printer. -Do not fold or staple pages. -If faxing, use fine resolution and follow up with a mailed original. Avoid “formatting peculiarities.” If you use E-mail, save your file as “text only” or “ ASCII ” to avoid the possibility that your word processor and your prospective employer’s word processor are incompatible. E-mail a copy of your resume to yourself to make sure it looks the way you meant it to look. Use “key-words”phrases, terms, industry jargon, and titles to describe your abilities. Describe your experience with concrete words rather than vague terms. Be sure to use state-of-the-art terminology to describe yourself. If you have been out of the job market awhile, research new developments in your field and use up-to-date terms to present your skills. Savvy job seekers often mimic the words a company uses in its help-wanted ads. The more skills and facts you provide, the more opportunities you have for your skills to match available positions. -Be concise and truthful. -Use more than one page if necessary. -If you have extra space, describe your interpersonal traits and attitude. Key words could include: time management, team player, dependable, leadership, and responsibility. -Use a keyword summary of your skills at the top of your resume to get the attention of robotic and human inspectors. For example, if you are looking for an entry level position in architecture, your keyword summary might include: BS in Architecture, internship experience with large commercial project, knowledge of AutoCAD, PhotoShop, AccuRender, 3-D Studio. Place your name on its own line at the top of the page. Use the standard format for your address below your name. Then list each phone number on its own line.

For job search purposes you may choose to have two versions of your resume: -One to send for the computer to read (A format that can be scanned and detailed descriptors). -One for people to read during an interview (a creative layout, enhanced typography, and summarized information.) -Be sure to proofread your resume before sending it.

How Hiring Managers and Recruiters Use Electronic Applicant Tracking Systems Typically, hiring personnel set up a search request and tell the computer whether certain qualifications are required or desired. Many resume-scanning systems then rank the candidates they select from the system. The first step in any career search is to reflect on what is most important to you as you begin your search. To that end, the Cawley Career Education Center is a space where you can ask questions about all aspects of personal career development. Understanding your rights under the ADA

As a person with a disability, it is good to know what your status is under the Americans with Disabilities Act of 1990. 

As it pertains to career services, the ADA:  

  • Helps people with disabilities access the same employment opportunities and benefits available to people without disabilities.
  • Applies to employers with 15 or more employees.
  • Requires employers to provide reasonable accommodations to qualified applicants or employees. A “reasonable accommodation” is a change that accommodates employees with disabilities so they can do the job without causing the employer “undue hardship” (too much difficulty or expense).
  • Defines disability, establishes guidelines for the reasonable accommodation process, and addresses medical examinations and inquiries.
  • Regulated and enforced by the U.S. Equal Employment Opportunity Commission(link is external). 

It is important to note that while you may qualify as being disabled under the ADA, it does not guarantee employment. You must also be qualified for the job for which you are applying by having or demonstrating the skill, experience, education, and other job-related requirements for the position.

You also must be able to perform what are called the essential functions of the job with or without reasonable accommodation. These ‘essential functions’ are often what is listed as the responsibilities or job duties in a typical job announcement. 

What qualifies as being “disabled”

According to the ADA, a disability is described in the following way

(1) Disability The term “disability” means, with respect to an individual (A) a physical or mental impairment that substantially limits one or more major life activities of such individual; (B) a record of such an impairment; or (C) being regarded as having such an impairment (as described in paragraph (3)).

(2) Major Life Activities (A) In general For purposes of paragraph (1), major life activities include, but are not limited to, caring for oneself, performing manual tasks, seeing, hearing, eating, sleeping, walking, standing, lifting, bending, speaking, breathing, learning, reading, concentrating, thinking, communicating, and working.

(B) Major bodily functions

For purposes of paragraph (1), a major life activity also includes the operation of a major bodily function, including but not limited to, functions of the immune system, normal cell growth, digestive, bowel, bladder, neurological, brain, respiratory, circulatory, endocrine, and reproductive functions.

(3) Regarded as having such an impairment

For purposes of paragraph (1)(C):

(A) An individual meets the requirement of “being regarded as having such an impairment” if the individual establishes that he or she has been subjected to an action prohibited under this chapter because of an actual or perceived physical or mental impairment whether or not the impairment limits or is perceived to limit a major life activity.

(B) Paragraph (1)(C) shall not apply to impairments that are transitory and minor. A transitory impairment is an impairment with an actual or expected duration of 6 months or less.

Disclosing Your Disability Status

Once you know if you qualify as disabled under the ADA, the next step is what do you do with the information you have? That is, do you disclose your status to a (potential) employer? It is important to know that you do NOT have to disclose at any point in the process. This decision is entirely up to you and how comfortable you feel disclosing your disability.  If you do choose to disclose, there are generally three opportunities to do so. 

  • In your application documents (i.e. resume, cover letter, personal statement)
  • In an interview
  • After you start working for the organization
  • In a request for reasonable accommodation during the interview process, or once on the job

Requesting Reasonable Accommodations

Once you are in an internship or a job, you may find that requesting reasonable accommodations can help you perform your job to the best of your abilities. Please know that requesting accommodations is incredibly personalized, both for the person requesting, and for the organization. It often requires some form of medical proof (not of the disability, but that you are working with a medical professional) and some type of negotiation with your manager and appropriate human resources office.

Begin with application 

The process of requests often begins with your job application. It is very common to see a question somewhere on an application page asking you to disclose your disability status. This is because many organizations who work with the federal government (Georgetown included) have to prove that approximately 7% of their workforce qualifies as disabled, in order to obtain federal funding. This information is often kept on hand for data purposes, but is more anonymous and does not get passed along to hiring managers. 

You may also request accommodations as part of your job interview process – whether that is requesting virtual interviews, more time for skills assessments, etc. 

If I disclose, who has access to that information?

This is considered Personally Identifiable Information (PII), and often is only available to an HR manager. The HR Manager may let the people hiring know you have an accommodation, but cannot disclose specific information about the request. 

Job Search Strategies

What should i put on my application documents.

Whether you choose to disclose your disability on your resume or cover letter depends on how comfortable you feel with potential employers having this information.  A career counseling appointment at the career center would be an excellent space to speak with a trained counselor about the question of whether and how to disclose on your resume. There are many employers that are wonderful at accommodating persons with disabilities,  but there are still many who are not. When deciding which company is best for you, consider what it would mean to you to work for a company that supports their disabled workers.

Some questions to consider:

  • Will I insist on working for a company that I know is disability-friendly?
  • Will I consider companies that imply being disability-friendly?
  • What does working for a diverse company mean to me?
  • Is the company you are interested in an disability-friendly organization?
  • Do you see benefits like an EAP program, paid time off and paid sick leave, or unlimited administrative leave for medical appointments? 
  • Is your identity as a disabled person a part of your career journey? Is it something you want known? 
  • What do others (for example: peers, alumni, current employees) say about the organizational culture? Keep in mind that every opinion, good or bad, may come with some amount of bias.

Questions you can ask an employer in an interview

  • “Would you say that your company has a diverse employee base?”
  • “What types of reasonable accommodations do you offer?”
  • “Does your organization have a disability affinity group?”
  • “What is your organization’s approach to work-life balance?”
  • “What is your organization’s work mode?”

Illegal Interview Questions

Did you know that it is against the law for employers to ask you certain questions in a job interview? For example, it is illegal to ask anyone their disability status, even if (and especially if) that disability is a physical one.

Handling Improper Interview Questions from Middlebury College’s Interview Preparation Guide :

“When you interview for a job, your prospective employer is supposed to ask job-related questions. The focus of interview questions should address your qualifications and abilities to perform the functions of the job. In the U.S., employment law prohibits employers from discrimination on the basis of certain “protected classes.” In federal law, these categories include race, color, religion, sex (including pregnancy, sexual orientation, or gender identity), disability and genetic information (including family medical history). What should you do if you feel that the interviewer is asking an improper (and possibly unlawful) question? You have a few options: 

  • You are free to answer the question. However, keep in mind that if you provide this information and give the “wrong” answer, you may jeopardize your chances of getting hired. There may be legal recourse available to you if you feel that you have been discriminated against, but this is not the preferred outcome for most job applicants. •   
  • You can refuse to answer the question. Unfortunately, depending on how the refusal is phrased, you run the risk of appearing uncooperative or confrontational, and losing the job. Again, there may be legal recourse, but this is hardly an ideal situation. 
  • You can examine the question for its intent and respond with an answer as it might apply to the job. For example, if the interviewer asks, “Are you a U.S. citizen?” or “What country are you from?” you have been asked an improper question. You could respond, however, with “I am authorized to work in the United States.”

What is a disability-friendly organization?

While there are no perfect organizations out there, employers, especially post-Covid, are trying to do a better job in including disabilities within broader conversations about diversity and inclusion. Below are a few places where you can find out more information about organizations that could be friendly to people with disabilities.

  • For Federal Organizations – Check out this list of project managers within government who are responsible for bringing diverse candidates into their agencies, including persons with disabilities. You can search the directory by agency and by State. It is a great way to reach out to people to better understand the culture of an agency.

Does federal law prohibit discrimination on the basis of Disability identities?

Yes. You are protected under the Americans with Disabilities Act. Please see our earlier section on the details of what is and is not covered under the act. 

While the law is well intentioned, and every organization complies with the letter of the law, do not be surprised if you run across organizations who do not abide by the spirit of the law. The law does also not protect individuals against micro-agressions, gossip or other forms of subtle discrimination. 

How can I find an employer’s non-discrimination policy?

Search company websites or job announcements for their non-discrimination policies. You can often find these policies in the “Careers”, “Jobs,” “About Us”  or “Diversity” sections of their sites. If you cannot find a company’s policy or the language is unclear, consider calling the company and asking for a copy of the policy in writing.

How to Handle Workplace Discrimination

Workforce discrimination occurs in many ways. There are federal laws that prohibit discrimination against individuals on the basis of race, color, national origin, sex, religion, disability, pregnancy, and age. Employers are responsible for complying with the law, but you are responsible for making sure you know and protect your rights.

A task force of faculty, students, and staff has created a report of recommendations aimed at building a more inclusive and supportive campus community for students with disabilities. Changes will allow students to better leverage the many resources available on campus and instructors will receive more coordinated support for the delivery of accommodations.

Some implementation steps will begin next year, including more prominently highlighting disability in the university’s Inclusion, Diversity, Equity, and Access in a Learning Environment (IDEAL) initiative and the creation of a centralized office tasked with providing seamless and integrated services.

“The task force report is not meant to serve as a one-size-fits-all solution to supporting and advancing the well-being of students with disabilities at Stanford,” said task force co-chair Paul Fisher, professor of pediatrics and of neurology and neurological sciences. “Rather, we hope it serves as a high-level set of recommendations that set the course for changes that will ultimately improve the lives of students on our campus. Some of these will be things we can accomplish quickly, and others will take more time.”

Charged by Susie Brubaker-Cole, vice provost for student affairs, and Patrick Dunkley, vice provost for institutional equity, access, and community, the task force was co-chaired by Fisher and Susan Weersing, associate dean for graduate and undergraduate studies in the School of Humanities and Sciences.

“I want to recognize the incredible and vital work this committee has done over the past year,” Brubaker-Cole said. “It is because of their hard work and commitment that we now have a road map for creating a more inclusive and accessible environment for every student, regardless of disability.”

While the task force’s work was primarily focused on the student experience at Stanford, Dunkley said he hopes the recommendations will serve as a reference point for future staff accessibility efforts.

“It goes without saying that staff are a key component of our community here at Stanford, and caring for the needs of staff is vital to creating a community that is truly inclusive, accessible, and equitable,” said Dunkley. “We were intentional in including staff on the task force as a means of building a bridge between these efforts and the support of our staff. Our plan is that some of the changes suggested in this report will be applied to staff as well.”

What students had to say

Working closely with Institutional Research & Decision Support, the task force compiled demographic and survey data on the disability community and met with a broad set of students, staff, and faculty stakeholders. Members interviewed students with disabilities and referenced experiences among themselves and research previously conducted by the disability student community.

Among the key demographic findings was a substantial increase in students registering with the Office of Accessible Education, and the most significant growth in accommodation type has been among students with registered psychological disabilities such as anxiety and depression or sleep disorders. Still, some students shared with the task force that they choose not to register with OAE for several reasons, including fear of stigmatization, a lack of understanding of what is required to receive accommodations, or a lack of resources to obtain the required medical documentation.

Throughout the task force’s work, six key themes emerged:

  • A need to centralize support for students and instructors into one office
  • A recognition that Stanford has staff and faculty with significant expertise in providing accommodations and support
  • A recognition that efforts are at times dependent on the dedication of community members acting within a system in need of improvement
  • A recognition that instructors and academic departments need more and different types of support in delivering student accommodations
  • A recognition that students are taking on an added burden of changing campus culture
  • A lack of clarity around leveraging resources and the continued need for students to self-advocate

“Every student deserves to learn and live within a campus community in a meaningful, enriching, and equitable way,” Dean of Students Mona Hicks said. “And while Stanford does have many programs and systems in place to support students with disabilities, it can be difficult to know where to start. Having a more centralized approach could help alleviate some of the stress students feel navigating those resources.”

Following the six themes, the task force recommended changes, which fell into three broad categories: systemic changes, academics and academic support, and community life.

In the coming year, Brubaker-Cole and Dunkley’s teams will begin implementing the task force’s key recommendations, beginning with highlighting disability as a core piece of the university’s IDEAL initiative.

“We must fully integrate disability into IDEAL and recognize the need for change on our campus,” Dunkley said. “We must ensure that all members of our campus community feel like they belong and are supported at Stanford, regardless of their intersecting identities. Diversity and inclusion are critical to our research and educational missions, and we must ensure all in our community have access to the many opportunities and benefits available here.”

In addition, work will begin immediately to create one central office, comprising the many offices already supporting students with disabilities, that would be accountable for the coordination and delivery of services. Staff who support students already and many members of the task force will be crucial in helping chart the next steps, Brubaker-Cole said. There will also be a national search for a leader of the office. The central office will help ensure a singular point of contact for students with disabilities and create a central entity responsible for responding to needs and opportunities in the student community.

“This office will also be responsible for ensuring the continued implementation of the task force’s recommendations because we recognize our work must continue to evolve as the needs of our students change,” said Brubaker-Cole. “We want to continue increasing access to physical spaces and developing the necessary support students need beyond the classroom. This will include continuing to develop community space and programs such as the DisCo, which has been an integral place for community building and support for our disability community on campus.”
