60-unit housing development proposed for town of Marshall. When is the public hearing?
MARSHALL - As more and more locals are getting priced out of Asheville, housing in Madison County is at a premium , but a new project could bring close to 60 units to the town of Marshall.
On June 17, when the Marshall Town Board meets for its monthly meeting, the board will host a public hearing for an annexation and a rezoning request from applicant from Cynthia Wilson Brigman and Daniel Van Brigman, of Newland.
According to an application submitted April 10 to the town by Daniel Brigman and Patrick Bradshaw, vice president of engineering firm Civil Design Concepts, the applicants are requesting a rezoning to Residential 2 (R2), as the property is currently zoned Residential Agricultural (RA).
The request for an annexation is required in North Carolina General Statutes as part of its Chapter 160 updates.
"For purposes of this section, an area shall be deemed "contiguous" if, at the time the petition is submitted, such area either abuts directly on the municipal boundary or is separated from the municipal boundary by the width of a street or street right-of-way, a creek or river, or the right-of-way of a railroad or other public service corporation," reads General Statutes 160A-31, Annexation by petition.
The project, Residences at Holly Ridge, is proposed for 21 acres in a gated community located behind the Marshall Ingles on U.S. 25-70, near Madison High School.
According to the application, the project proposes five structures in four phases.
In the first phase, one 12-unit structure will be built, with plans to construct four more units with 12 units each throughout the course of the next three to five years.
Additionally, four of the 12 units within each structure will be designed and constructed to accommodate Americans with Disabilities Act accessibility guidelines.
According to the application, the applicant's intent of the development is to create a "mountain side" development reflecting the "mountain" architecture — wood, stone and heavy timber.
"Aligned with the vision of Marshall, this project will be completed in a tranquil, beautiful setting overlooking the mountains of Marshall and Madison County while providing essential housing for generations to come," the Brigmans and Bradshaw said in the application.
"This project will provide convenient access to shopping, recreation and historic Downtown Marshall. The wooded setting will provide residents access to hiking and biking."
The application also alludes to the town's Comprehensive Land Use Plan, and said the "development will preserve existing scenic and natural resources while maintaining the mountain heritage and historic character of Marshall and Madison County."
Potentially making reference to the county's monthslong deliberations on its ridge top development , the application made sure to clarify that once completed, the five structures will be "at a significant distance from each other, preserving the mountain viewshed and mountain ridge."

Kaitland Finkle is a Land of Sky regional planner who serves as the town of Marshall's zoning administrator.
Finkle said the two-part public hearing is a curious one, as the project doesn't have any road frontage.
"Their legal access is through the Ingles parking lot, which I think is interesting," said Finkle.
Finkle cautioned that she suspects the town may not have the infrastructural capabilities to accommodate the project.
"Right now, it's all going to depend on water capacity," Finkle said. "Unfortunately, I don't think the town has enough capacity to support it, but it's a really cool project."
In January, the town of Mars Hill rejected an application from Givens Estates for a rezoning, citing water and sewer capabilities.
Mars Hill Town Manager said while the town was supportive of the project in general, newer developments had put a strain on the town's water and sewer.
According to Bennett, from 2019 to 2022, with the addition of a 100-unit subdivision in 2019 and an additional 58-unit subdivision in 2022, the town saw a 36% increase in water production, from 52 million gallons to 75 million gallons.

Regency Development testing the waters with Miami Beach townhome project
Elliman’s Darin Tansey is leading sales with prices ranging from $3.5M to $4.2M
Regency Development Group is trying something new in Miami Beach.
The developer, led by Igor Michin, Alex Troyanovsky and his son Michael Troyanovsky, is launching sales of Villa17, a 10-unit townhouse project in Miami Beach, according to a press release. Regency tapped Douglas Elliman’s Darin Tansey to lead sales of the townhomes planned for 1719 Jefferson Avenue, and prices range from $3.5 million to $4.2 million, Michael Troyanovsky confirmed.
Units will range from 2,500 to 3,000 square feet and span four bedrooms, four bathrooms and one half-bathroom, the release shows. Regency is also offering different furniture and design packages for interested buyers, Troyanovsky said.
Troyanovsky expects some of the project’s buyers will be transplants from the Northeast. According to Tansey, Villa17’s target buyer demographic is likely already familiar with Miami Beach, and looking for an active, pedestrian-centric lifestyle. He anticipates they will sell quickly.

“The local crowd, I think, is really going to take to this,” he said. “This product does not exist in Miami Beach.”
Miami Beach has been a hub of development activity in recent years, with a pipeline of predominantly luxury condo projects. A townhouse development marks a deviation from the norm by a group of relative newcomers. A significant advantage to doing townhouse projects is the shorter construction timeline, Michael Troyanovsky said.
“They’re just all so quick,” he said. “We don’t expect anything longer than 14 months from the time we break ground.”
The developers bought the site for Villa17 in November for $4.4 million, records show. They plan to break ground on the townhomes in the fourth quarter of this year and finish construction in late 2025 or early 2026, according to Troyanovsky.
Regency expanded into South Florida from Chicago in 2022, beginning with three luxury condo projects in Bay Harbor Islands . The third nine-unit condo development launched sales in March , with prices ranging from $4 million to $9 million. The developer is also planning a townhouse project in Fort Lauderdale, according to its website.
And according to Troyanovsky, the firm is also looking at sites for future projects across the state, including locations in Boca Raton, Palm Beach and Naples.
Townhome development with Des Moines skyline views coming to banks of Raccoon River
Another townhome project is coming to Indianola Road south of the Raccoon River, promising prime views of the downtown Des Moines skyline.
Adam Sieren, owner of Premier Construction Services, plans to develop 35 units on the hillside overlooking the south bank of the river at 16 Indianola Road. Across from St. Anthony Church and School, it's the former site of Clifton Heights Presbyterian Church..
The Summit Townhomes would closely neighbor the Elevate Townhomes, a 41-unit complex Sieren developed to the west , where Indianola Road meets the Southwest Seventh Street bridge. But unlike their more luxurious counterparts that start at $450,000, the Summit Townhomes would be designated as affordable for entry-level workforce, seniors and families.
Sieren says he's pursuing state workforce housing tax credits for the project to the tune of $160,000, with a potential local match from the city of Des Moines in the form of a tax abatement.

The townhomes will still be listed for about $285,000 each — the high end of what Iowa allows for its incentivized projects. Across the river at Hubbell's Gray's Station development, townhomes start at roughly $350,000 for a two bedroom,2 1/2 bath unit but can balloon to nearly $1 million for a stand-alone townhome with three bedrooms and three baths.
According to Realtor.com, the median listed home price in Des Moines was $241,000 as of April. The median sale price was $208,500.
"Building into that hill is not cheap," Sieren said of 16 Indianola Road's sloping site. "But we're going to make them as affordable as we can. Building affordable right now, especially single-family, is not always the cheapest."
The units will have two bedrooms, two bathrooms and a garage. The development was originally slated to have 45 homes, but plans were whittled down to add greenspace.
"It's a nice little spot," Sieren said. "You're off downtown enough that you're not right in the thick of it, but you're within walking distance of Principal Park. And you've got capitol views to the east."
The land is currently undeveloped. Sieren said construction could begin in spring 2025.
Downtown's southwest corridor is getting homier
While construction on the Summit Townhomes is slated to start next year, a planned expansion to the Elevate development recently brought another 11 townhomes.
When those sell out, Sieren said, his company will begin work on another 18 luxury units.
Sieren's townhomes, as well as the in-progress Bricktop 36 townhomes on Thomas Beck Road across from the Confluence Brewing Co., are some of the first housing projects in what city leaders believe to be a hot spot for development. Des Moines adopted a blueprint in 2021 titled South of Gray's Lake Master Plan that suggested developers transform the 140 acres along Thomas Beck Road, stretching from Southwest Seventh Street to Fleur Drive, from its current industrial and office use to a vibrant "urban green neighborhood."

Biden-Harris Administration Invests More Than $653 Million in Ports to Strengthen American Supply Chains
WASHINGTON – Today, the U.S. Department of Transportation’s Maritime Administration (MARAD) announced over $653 million to fund 41 port improvement projects across the nation under the Port Infrastructure Development Program (PIDP). As part of President Biden’s Investing in America agenda – a key pillar of Bidenomics – this funding will help grow capacity and increase efficiency at coastal seaports, Great Lakes ports, and inland river ports. A significant portion of domestic and international U.S. commerce by weight , (over 2.3 billion short tons) moves by water. The port improvement projects announced today will strengthen supply chain reliability, create workforce development opportunities, speed up the movement of goods, and improve the safety, reliability and resilience of ports. These investments are part of the largest dedicated funding for ports and waterways in history – nearly $17 billion through the President’s Bipartisan Infrastructure Law.
“Everything from the food we eat to the cars we drive to the lumber and steel used to build our homes passes through America's ports, making them some of the most critical links in our nation’s supply chain,” said U.S. Secretary of Transportation Pete Buttigieg . “These investments will help expand capacity and speed up the movement of goods through our ports, contributing to cleaner air and more good-paying jobs as we go.”
When President Biden took office, the pandemic was putting enormous pressure on global supply chains, which were too weak to handle the strain. Americans were paying more and waiting longer for everyday goods. At one point, more than a hundred ships were waiting to dock at West Coast ports. This contributed to inflationary prices. This Administration and port workers stepped up to the challenge. Now, there’s been more than a 90 percent decrease in the number of container ships waiting for berths at U.S. ports and global container shipping costs are down by more than 80 percent from their peak in 2021. These investments represent the Biden Administration’s continued focus on improving U.S. ports and strengthening our supply chains to be more resilient to shocks to the system in the future. The PIDP improves port and related freight infrastructure to meet the nation’s freight transportation needs. The program provides planning support, capital funding, and project management assistance to improve capacity and efficiency of ports in both urban and rural areas. Awards announced today include more than $172.8 million for 26 small ports to continue to improve and expand their capacity to move freight reliably and efficiently, thereby boosting local and regional economies while protecting surrounding communities from air pollution.
“Modernizing the nation’s port infrastructure is vital to the reinforcement of America’s multimodal system for transporting goods. The advantages of cargo movement on water extend well beyond the maritime domain,” said Maritime Administrator Ann Phillips . “By funding port infrastructure development, the Biden-Harris Administration is ensuring that goods move reliably and in greater quantities, strengthening supply chain resiliency across all modes of transportation, and addressing the negative impacts of port operations on public health and the environment that have harmed communities living near ports.”
Projects were selected based on their ability to improve the safety, efficiency, or reliability of the movement of goods, as well as on how well they would improve port resilience. Other factors considered during the project evaluation process included the amount of non-federal funding an applicant committed to the project and how well the project enhanced economic vitality, supported workforce development, addressed climate change and sustainability, and advanced equity and President Biden’s Justice40 Initiative.
Select grants include:
Dock Infrastructure Replacement ($43,376,746) Cold Bay, Alaska This project will include the design, permitting, and construction of a new dock to replace the community’s only existing dock, which is nearing the end of its useful service life. The new dock will be designed and built to accommodate commercial use, freight and fuel transportation, private vessel use, and public uses like emergency medical services and public transportation through the Alaska Marine Highway System. Safety is improved by creating a wider working area on the dock for clear operational lanes for trucks and dockworkers. The new dock will also improve the overall resilience of the port due to the use of stronger materials that will better withstand the harsh conditions common to this area.
North Harbor Transportation System Improvement Project ($52,633,331) Long Beach, California The project will add a third intermodal railroad track to the Dominguez Channel Bridge; relocate and modernize Pier B Street, on-dock roadways, and associated utilities; and realign Pico Avenue, including replacing and relocating aging utilities in the area. The rail expansion and roadway improvements will enhance cargo movements to and from the port, increase safety at key railroad crossings near the port, and increase internal road capacity to create more space for tractor trailer operations. The project is located in a Historically Disadvantaged Community.
Reconstruction of Berth PN-308 at Port Newark ($32,000,000) Newark, New Jersey The project will reconstruct Berth PN-308. The new berth will have a 75-year service life, increase live load criteria from the current 500 pounds per square foot (psf) to 2,000 psf, and incorporate resiliency enhancements to the new structure such as a high-level platform and prestressed precast concrete planks. The new facilities will increase the port’s capacity to handle projected increases in dry bulk goods and provide an additional layer of reliability for the regional and national supply chain. The project also improves port resilience by raising the elevation of the berth to better withstand flood events. Ko’Kwel Wharf Improvements Project ($7,729,650) North Bend, Oregon The project will fund repairs to the dock facing Lot 2 of the Ko’Kwel Wharf, bring 800-amp service and a shore power outlet box to the wharf to reduce or eliminate the need for idling diesel engines, and include development phase activities leading to the future extension of the Wharf dock. The dock repairs, which will renovate and upgrade dangerous and dilapidated conditions, will increase load capacity by 85 percent and contribute to more efficient movement of goods. Additionally, the installation of shore power enhances safety by decreasing diesel fumes, which adversely impact communities adjacent to the Wharf.
Port of Ogdensburg Terminal Expansion Project ($5,107,649) Ogdensburg, New York The project includes an approximately 435-linear-foot expansion of the Port of Ogdensburg’s main dock terminal along with installation of a mooring dolphin system and associated dredging necessary to establish a new roughly 100-foot-wide by 500-foot-long berthing area immediately adjacent to the new terminal dock wall structure. The project improves efficiency and reliability by deepening and extending the port’s primary cargo berth to increase the size and number of vessels that can be docked simultaneously. The berth extension will also lead to more efficient operations by reducing choke points and alleviating staging and cargo transfer capacity shortfalls.
Wabasha Barge Terminal Project ($2,545,297) Wabasha, Minnesota This project will construct a new inland river barge terminal at Upper Mississippi River Mile Marker 760 and develop the necessary access road and utilities to support its operation. The project will improve flood and supply chain resilience by creating a new terminal on the Mississippi River that will be constructed to be more resistant to flood related closure. The new terminal will also provide additional capacity for the movement of agricultural commodities and other cargo on the river.
North Gate Relocation and Access Optimization ($10,950,805) Wilmington, North Carolina The project will construct approximately 4,000 feet of elevated roadway access to the general cargo terminal, relocate the North Gate security checkpoint, install a new gate operating system, improve existing at-grade railroad crossings, construct buildings for badging, guardhouse, and cargo control, construct a truck queuing area, and install EV charging infrastructure and solar panels. The new facilities will improve the safety, efficiency, and reliability of the port by increasing railroad capacity, reducing truck delays resulting from railroad operations, and increasing supply chain reliability for U.S. exporters. The project also improves the resilience of this strategic seaport by implementing new security technology and cyber prevention tools to ensure operational resilience.
Port of Tacoma Husky Terminal Expansion Port One ($54,233,330) Tacoma, Washington The project will reconfigure the Husky terminal yard for better truck circulation, install roughly 40 refrigerated cargo racks and related power supplies, and relocate on-terminal structures. The new facilities will safely, efficiently, and reliably increase cargo throughput by tripling refrigerated cargo (“reefer”) capacity at the port. The project advances port resilience as its design accounts for sea level rise and storm surge.
Velasco Terminal Sustainable Expansion Project ($15,958,380) Freeport, Texas The project includes construction of a new approximately 36,900-square-foot cross-dock warehouse, related site improvements on a roughly 10-acre site, and a new terminal access truck gate. The cross-dock facility will enable cargo to be unloaded, sorted, and loaded onto trucks without interfering with other terminal traffic, reducing congestion. The warehouse design improves safety by incorporating wider maneuvering, loading, and aisle-way space for forklifts, which will reduce hazards for forklift operators and warehouse workers. The new truck gate will reduce truck turn times to improve productivity and enhance safety by adding truck lanes off the adjacent roadway.
Agricultural Maritime Export Facility – Phase 2 ($9,276,352) Milwaukee, Wisconsin The project will construct two grain storage silos, make electrical service upgrades, and fund purchase of additional grain and cargo handling equipment to expand the capacity of the port to handle the movement of grain commodities. The project will improve efficiency by expanding grain storage capacity for staging inbound and outbound grains by over 1.3 million bushels. The grain handling equipment will also expedite the movement of grains and the new facility will allow the port to handle two commodities simultaneously.
Port of Blencoe Infrastructure Development Project ($10,262,240) Blencoe, Iowa The project will establish a new port at a site along the Missouri River. The project will consist of constructing a new commodity handling facility, storage for liquid commodities, receiving and handling equipment, conveyors, elevating legs, and additional infrastructure development such as internal road construction and site leveling to accommodate use of the southern side of the property for heavy industrial use. The project improvements will eliminate double handling of cargoes by streamlining transfers directly from barge to vessel and generate resulting improvements in safety, efficiency, and reliability. The project will benefit grain shippers by reducing transport costs by increasing competitiveness and the volume of grain that can be handled. The new facility will also decrease the travel time required for shippers to move their grain to market.
River Valley Slackwater Harbor Project ($15,096,000) Fort Smith, Arkansas The project will construct a slackwater harbor off the main channel of the Arkansas River. The harbor will be approximately 1,000 feet long and 200 feet wide and have the capacity to moor and offload up to eight barges at a time. The harbor will have roughly 2,000 feet of dock frontage with a 50-foot-wide concrete deck for mobile cranes. The grant will also fund design services and project management. The new harbor enhances reliability of the port because it will be less susceptible to operational disruptions and damage resulting from fluctuations in the flow rate of the river. The project significantly increases the throughput capacity of the port. The project will also improve port resilience because the concrete deck will be constructed above the 100-year flood level to ensure year-round operation even in the face of flooding events. Business | Development firm attached to Superblock project files bankruptcy for ailing construction, supply businesses
The firm, Mayson-Dixon Properties & Development, wants to discard subsidiaries that left a trail of lawsuits and debts ahead of Monday’s bankruptcy filing. If approved by the court, the two companies, Modern Builders and Modern Suppliers, will be liquidated to pay creditors under Chapter 7 of the federal bankruptcy code.
Modern Builders and Modern Suppliers both estimated in court filings that they have less than $50,000 in assets. Modern Builders listed $2.25 million in liabilities and Modern Suppliers listed $1.6 million, though there is some overlap between the two.
Modern Builders also listed a $119,000 debt to the IRS.
A related consulting business under the Mayson-Dixon umbrella also owes more than $200,000 in unpaid federal taxes, according to three liens filed in Baltimore City Circuit Court. It’s not clear whether those include Modern Builders’ debt to the IRS.
Jayson Williams, Mayson-Dixon’s CEO, said in a statement that the bankruptcies were a strategic move aimed at sustaining his business’s “core operations in consulting, construction management, and real estate”
“This was not an easy decision, but it is a necessary step to preserve the heart of our business. The construction industry faces unique financial challenges, with many businesses encountering bankruptcy due to economic fluctuations, project delays, and cash flow issues from slow or non-payment,” Williams said. “By taking this action, we are positioning our company for a stronger future, free from the financial burdens that impacted our general contracting subsidiaries.”
Mayson-Dixon owns a 5% stake in the Superblock project, according to an agreement between the city and Westside Partners, the team of firms tapped to transform the once-thriving retail district along Howard Street into a commercial, residential and retail strip.
Williams often has been the face of the project, advocating publicly for the Superblock redevelopment and generating buzz as an up-and-coming developer with deep ties to Baltimore. The name “Mayson-Dixon” includes a combination of Williams’ first name and that of his life and business partner, Matthew Newcomer.
Both men grew up along the Mason-Dixon line in different parts of Maryland, they have said in court filings. Williams also has a background in political consulting, where the Mayson-Dixon brand got its start in 2015.
The company pivoted during the pandemic and ultimately became Mayson-Dixon Properties and Development, a firm that included a construction company, Modern Builders, and a building supply company, Modern Suppliers.
Mayson-Dixon has signed on to several ambitious projects across the city in recent years, including a “zero-energy” development in a blighted block along West North Avenue , a housing project in East Baltimore’s Eager Park and the Superblock.
By last year, however, Mayson-Dixon and its daughter companies were starting to show signs of distress, court records show. All told, the companies have faced eight breach of contract lawsuits in both Baltimore City and Prince George’s County since 2022. Some suits have been dismissed by agreement, likely meaning a settlement was reached, but four were still pending in Baltimore when the bankruptcies were filed. The two cases filed in Prince George’s County both resulted in judgments against Modern Suppliers.
Unpaid taxes attributed to the Mayson-Dixon Companies LLC also date back to 2021, the IRS liens show. The liens themselves were filed in October, January and March.
Modern Builders’ work on the North Avenue project recently was the subject of a lawsuit over unfinished construction. Vacant homes that were slated for redevelopment in 2021 remain unfinished and the developer leading the project is suing Frankenmuth Insurance Co., which issued a $3.5 million performance bond for Modern Builders to work on the job.
Modern Builders had completed “only a small fraction” of its work in August 2022, 10 months after beginning the job, the lawsuit claims. The complaint also describes “widespread and sometimes dangerous installation defects,” including doing work without consulting the project plans and failing to supervise construction on the site.
Modern Builders was in arbitration with the developer on that project before filing for bankruptcy.
Another pending lawsuit against Modern Builders levies similar claims. Ark Yorkewood, the owner of a multi-family housing development in North Baltimore’s Glen Oaks neighborhood, sued Modern Builders and Frankenmuth in February 2023.
“Modern was habitually late, failed to use project funds to pay its subcontractors and failed to procure materials with the money entrusted to it by Ark Yorkewood,” the company alleged in the complaint.
The $4.5 million project fell months behind schedule and was protested by subcontractors who said Modern Builders had not paid them, according to the lawsuit. Units renovated by the company also experienced plumbing leaks that caused ceilings to collapse in other units, the complaint claims. Modern Builders disputed the claims in court.
Frankenmuth, Ark Yorkewood and the developer behind the West North Avenue project are among the nearly 40 creditors listed in the Modern Builders bankruptcy.
The Superblock redevelopment, which has struggled to get off the ground in previous iterations , is in the financing stage after receiving a key approval from the Commission for Historical and Architectural Preservation last year .
Colin Tarbert, the president and CEO of the Baltimore Development Corp., said in a statement that BDC has established a target settlement date of Sept. 30.
“To meet this deadline, the development team must secure the necessary equity and financing to complete construction plans for the project and purchase the properties from the City,” Tarbert said. “Given the concerning deterioration of the properties, it is imperative that progress is made promptly to either move forward with the project or consider alternative options.”
